To authorize the Village Engineer to notify the Illinois Department of Transportation (IDOT) the Village
of Morton Grove concurs with IDOT's intention to accept the bid of A. Lamp Concrete Contractors, Inc.
To allow IDOT to award a construction contract for the proposed improvements on Dempster Street
between Ferris Avenue and Central Avenue.
The Village has been the lead agency for developing long- awaited improvements to roadway and
sidewalk areas of Dempster Street between Ferris Avenue and Central Avenue. The Village hired
McDonough Associates, Inc. to prepare construction plans and specifications for the project, which
includes replacing the curb and gutter, constructing a new asphalt surface, sidewalk replacement,
streetscape improvements, landscape improvements, traffic signal modernization, street lighting
installation and pavement markings. The Village Board reviewed the final design of the proposed
improvements at their regular Village Board meeting on November 9, 2009. The construction contract for
these improvements was competitively advertised for bidding in compliance with IDOT requirements,
which meets or exceeds the Village's bidding requirements. Eleven bids were received, publicly opened
and read by representatives of the State of Illinois on Friday, April 23, 2010. IDOT desires to award the
contract to the low bidder, A. Lamp Concrete Contractors, Inc. of Schaumburg, Illinois in the amount of
$4,776,280.20. The Village concurs with this award since A. Lamp has previously performed work in the
Village on smaller projects in a satisfactory manner. In order to do so, IDOT needs concurrence from the
Village by May 14, 2010, to award the contract to the low bidder. This concurrence is required because
the Village will then be committed to providing the financial participation in the improvements on
Dempster Street. Public Works staff recommends awarding the contract to A. Lamp,
Public Works, Engineering Division
The estimated contract value is $4,776,280.20. Since this is a unit price contract, the final contract
amount will be based on the actual quantity of work performed. Village and IDOT staff estimated before
bidding the federal sources would need to provide $3,947,256 with the Village providing the remainder
$1,514,142 for a total funding amount of $5,461,398. The 2010 Annual Budget allocated $250,000 from
Lehigh- Ferris TIF District Fund and $1,060,000 from the Capital Projects Fund, totaling $1,310,000.
Although there appears to be a funding shortfall on the part of the Village, Village staff anticipates this
amount of funding will be sufficient to meet the Village's financial responsibility for this project based
upon the $685,118 differential between the estimated cost and the low bid amount.

To amend the Adopted 2010 Budget for various capital projects within the Lehigh - Ferris TIF District.
To reflect current cost estimates for projects in the Lehigh - Ferris TIF District..
The Lehigh - Ferris TIF District contains a wide variety and large number of public and private
improvements. The primary source of funding for these improvements has been the proceeds from a bond
issue in 2007 in the amount of $9.2 million, and TIF increment generated within the District, The 2010
Budget, as adopted, pursuant to Ordinance 09 -32 listed anticipated capital projects and improvements
totaling $8,512,000. Since the passage of the budget, the Village has received truer bids, confirmed
negotiated fees, and refined estimates of cost for such projects and has determined the correct amount to
be budgeted is $7,528,000. This change in anticipated expenditures is also due to the fact that the
schedule for some project has changed since the 2010 Budget was prepared. The $2.5 million project to
improve the grade crossing of the Metra tracks at Lincoln Avenue will likely not occur in 2010. Moving
most of this allocation from the 2010 Budget (and into a future year Budget) decreases the overall
anticipated expenditure from the Capital Projects total in the Lehigh - Ferris TIF District Fund, even though
estimated costs for most 2010 projects have increased. The proposed amendments will provide better
fiscal management of the expenditures in the Lehigh - Ferris TIF District Fund.
Public Works, Engineering Division and Finance Department
This ordinance will amend the 2010 Budget by reducing the allocation for capital projects from
$8,512,000 to $7,528,000, but also eliminates three projects (i.e. Railwalk, Metra Yard Relocation and
Metra Grade Crossing Improvements) from the planned number of projects to be completed in 2010.

Legislative Summary
Resolution 10 -37
Introduced: May 10, 2010
Synopsis: To authorize the Village President to execute a "Local Agency Agreement For Federal
Participation" with the Illinois Department of Transportation for the Central Avenue Resurfacing
Improvement.
Purpose: The agreement between the Village and IDOT is necessary in order to receive the American
Recovery and Reinvestment Act (ARRA) funding that was programmed by the North Shore
Council of Mayors and placed the project on the letting schedule with the State for June 11, 2010.
Background: Federal American Reinvestment and Recovery Act funds were allocated to the North Shore
Council of Mayors (NSCM) by the Chicago Metropolitan Agency for Planning (CMAP). All
member communities of NSCM were offered to apply for these funds for a single eligible
infrastructure improvement project. The Village received ARRA funding to resurface Lehigh
Avenue. Construction bids were lower than estimated costs for most projects within NSCM,
leaving a budget surplus. Village staff anticipated this possibility and began developing an
additional project to have ready to accept funding if surplus funding became available. Morton
Grove is one of three communities able to take advantage of the surplus funding. Central Avenue
was identified as a federal aid eligible route and in need of resurfacing to improve the driving
surface, reduce maintenance costs and extend the useful life of the street. The proposed limits of
construction are from Church Street to Golf Road. The Village applied for and received ARRA
funding through the North Shore Council of Mayors as a Local Area Pavement Preservation
Project for construction. This project will be substantially similar to the Lehigh Avenue ARRA
resurfacing project. The work is scheduled to begin in early- September 2010.

To provide a guarantee to the State of Illinois that all work performed by Village forces
within the State's rights -of -way will conform to the conditions on the permit granted by the
Illinois Department of Transportation (IDOT), to hold harmless the State of Illinois while
performing permitted work, to assume all liability for damages pertaining to the performance
of the work, and authorize the Village Administrator, Director of Public Works, Building
Commissioner and Village Engineer to sign IDOT working permits on behalf of the Village.
Increase efficiency in performing work and reducing the cost of work when performing
repairs or improvements on the various elements of Village -owned infrastructure including,
but not limited to, water mains, sewers, street lighting, traffic signals, sidewalks, landscaping
trees and signage.
This is a routine guarantee provided by many municipalities. IDOT and the Village let this
guarantee lapse since 1995. IDOT recently brought the matter to the Village's attention when
we applied for a permit. IDOT requires a permit and financial security (highway bond)
within their rights -of -way. This is similar to the Village's permit process for work performed
within the Village's own rights -of -way. Municipalities have an option of providing the
financial security for each repair or may provide a guarantee that all work performed by the
Village within the State's rights- of-way will conform to their requirements of the
performance for the work. Providing this guarantee will eliminate the time and cost of
procuring a bond for each permit.
Public Works Department
There is no cost associated with this guarantee.

The Public Works Department will forward the guarantee to IDOT for their records.

To amend Title 4, Chapter 4, Articles A and C of the Village Municipal Code so
the Municipal. Code remains current and relevant.
The purpose of this ordinance is to eliminate a redundant requirement for
electrical contractor licensing and to update the licensing requirements for
contractors regulated by the Illinois Department of Financial and Professional
Regulation (IDFPR.)
4 -4A currently exempts electrical contractors registered anywhere in Illinois
from paying a license fee to the Village as well as exempting all requirements
for an electrical contractor registered anywhere in Cook County. Eliminating
this chapter will eliminate confusion in the subsequent Title 4-4C since
licensing of electrical contractors is also covered under this Title. Malting this
change will now require electrical contractors to obtain a Village of Morton
Grove contractor's business license. It will also update the requirements as
regulated by the Illinois Department of Financial and Professional Regulation
along with contractor insurance requirements concerning electrical contractors.
This ordinance will also change the time period of the annual license from
twelve months beginning May 1 of each year to a one year period from the date
the license is issued.
