MINUTES OF THE MAY 27, 2009, SPECIAL MEETING OF THE BOARD OF TRUSTEES AMERICAN LEGION MEMORIAL CIVIC CENTER - COMMUNITY HALL 6140 DEMPSTER STREET MORTON GROVE, ILLINOIS 60053 Pursuant to proper notice in accordance with the Open Meetings Act, the Special Meeting was called to order at 6:30 pm by Mayor Daniel Staackrnann who led the assemblage in the Pledge of Allegiance. Clerk Kalogerakos called the roll. In attendance were: Elected Officials: President Daniel Staackmann, Trustees Dan DiMaria, Larry Gomberg, William Grear, Sheldon Marcus, and John Thill, Village Clerk Tony Kalogerakos Village Staff: Village Administrator Joseph F. Wade, Corporation Counsel Teresa Hoffman Liston, Fire Chief Tom Friel, Director of Family and Senior Services Jackie Walker O'Keefe, Family and Senior Services Coordinator Bud Swanson, Emergency Management Agency Coordinator John Hill Also Present: Approximately five guests President Staackmann stated the purpose of this meeting was to allow Jackie Walker O'Keefe, the Director of the Family and Senior Services Department, the opportunity to present a "Family and Senior Services 101 ". Ms. Walker O'Keefe began by stating the mission of the Family and Senior Services division is to "add life to years, not just years to life ". She then gave a brief history of the establishment of the department. She related in 2000 the department was know as the Department of Health and Human Services. It was then restructured and became known as the Department of Family and Senior Services. The health inspection aspects were incorporated in the Building Department. Also in 2000, the Village purchased the American Legion Memorial Civic Center. In 2001, the Village and the Park District entered into an Intergovernmental Agreement which incorporated, among other things, senior citizen recreation programming and created the position of a Senior Citizens Activities Coordinator. In 2002, the Department moved to the new Civic Center. The Department is comprised of social work services, nursing services, outreach services, management of the senior center, senior transportation, and building maintenance and rental facilities. The department maintains an informational and reception desk which greets the public, schedules bus rides, and processes registration of multiple events. It is made up of three part -time receptionists. Social work services are performed by Ms. Walker O'Keefe which include employee assistance, crisis intervention, police social work, referrals to various social agencies, and additional programming. The Outreach service is performed by one part-time outreach worker who manages the Chore Program, contacts new seniors with orientation packages, and assists the Village nurse and members of the Department with other functions. The nursing services are performed by one part -time registered nurse and include a myriad of screenings, consultations, and wellness programs. The Senior Activities programming function is conducted by one full -time activities coordinator which includes managing the Village's sponsored trips, clubs, the production of a monthly newsletter and the solicitation of sponsorships for these programs. The Senior Bus Program includes two busses and four drivers. The operating budget for this program is approximately $120,000 per year. The bus is used to transport seniors throughout Morton Grove and to the Rush North Shore hospital in Skokie. It is also used for transportation to and from Village sponsored trips. h12008, there were approximate 8,260 total trips taken (each one -way transportation of a passenger is considered a trip) and from the beginning of 2009 through the end of March 2009 there were 2,108 trips taken. The Department's Financial Assistance Program was budgeted in 2009 with $20,000 to provide assistance to residents for payment of Village solid waste bills and other utility bills. There is a limit of $300 per year, per person in need of assistance. Ms. Walker O'Keefe disseminated a survey showing the difference in financial assistance funding among neighboring municipalities. Morton Grove's allocation of approximately $35,000 per year was the highest allocations among six neighboring suburbs. Mr. Swanson reported on the Civic Center operation, revenue, and expenses which included in 2008, $286,696 in expenses and approximately 590,000 in rental income. Mr. Swanson noted the operation of the Civic Center without expenses related to the rental operation were $214,936 per year. Ms. Walker O'Keefe advised the Board that currently the Senior Center had approximately 500 members at a cost of $15.00 per year. A discussion ensued about raising membership rates for 2010. Ms. Walker O'Keefe answered questions from the Board. There being no further business, Trustee Thill moved to adjourn the special meeting. CALL TO ORDERIPLEDGE OF ALLEGIANCE Village President Daniel J. Staackmann called the meeting to order at 7:30 p.m. After leading the assemblage in the Pledge of Allegiance, he directed the Village Clerk to call the roll. III. ROLL CALL Village Clerk Tony Kalogerakos called the roll. Present were: Trustees Dan DiMaria, Larry Gomberg, Bill Grear, Shel Marcus, and John Thill. IV. — APPROVAL OF MINUTES Regarding the minutes of the May 11, 2009, regular meeting, Trustee Thill moved, seconded by Trustee Marcus, to accept the minutes as presented. There was no discussion. Motion passed unanimously via voice vote. V. PUBLIC HEARINGS NONE Vl. SPECIAL REPORTS a. Mayor Staackmann outlined the qualifications for the candidate for the office of Trus- tee. He stated Ms. Maria S. Toth received a bachelor's degree from DePaul Univer- sity, had been on a number of Village commissions since 1997, and was an excellent choice to fill the remainder of the open Trustee position. Trustee Thill moved and Trustee Grear seconded a motion to appoint Maria S. Toth to the position of Village Trustee for the remainder of the term for that Trustee seat (April 2011). There was no discussion. Motion passed: 5 ayes, 0 nays. Tr. DiMaria aye Tr. Gomberg aae Tr. Grear aave Tr. Marcus ave Tr. Thill ave- Mayor Staackmann then swore in Ms. Toth as Village Trustee, and congratulated her. He declared Ms. Toth had been dully installed, and wished her well in the service of the Village. Ms. Toth introduced her family and thanked her friends. She then took her position on the dais. VII. RESIDENTS' COMMENTS (Agenda Items Only) Eric Poders. Mr. Poders expressed concern over Ordinance 09 -07 wherein he felt the ordi- nance restricted his opportunity to videotape, take pictures, and record meetings he attended in the Village. He stated he would like the Board to either change or reconsider the language contained in this ordinance. Minutes of June 0, 2009 Board Meeting RESIDENTS' COMMENTS (Agenda Items Only) (continued) Georgianne Brunner. Ms. Brunner stated she is the Volunteer Coordinator for Morton Grove Days Commission for the upcoming July 4th event and asked anyone interested in volunteer- ing for this event should contact her at 847/967 -0725 or through the Village or Park District websites. She also stated there will be a Chamber of Commerce pancake breakfast on the morning of July 4 from 8:00 am to 10:00 am. She hoped to see everyone there. VIII. PRESIDENT'S REPORT a. Mayor Staackmann presented and sought concurrence with the following board /commission reappointments: Loren Benson to the Appearance Commission, Donna Hedrick to the Economic Development Commission, Harry Cook to the Board of Environmental Health, Anthony Hofeld to the Fire and Police Commission, Joe Hedrick to the Police Pension Board. Trustee DiMaria moved to concur with the reappointments, seconded by Trustee Thill. The motion passed unanimously-via voice vote. Mayor Staackmann presented and sought concurrence with the following board /commission appointments: Ron Stein to the Appearance Commission, Gail Kachoyeanos to the Appearance Commission, Georgianne Brunner to the Board of Environmental Health, Martin Kite to the Cable and Telecommunication Board, Mark Matz to the Cable and Telecommunication Board. Trustee DiMaria moved to concur with the appointments, seconded by Trustee Thill. The motion passed unanimously via voice vote. Mayor Staackmann stated he is aware of the many property maintenance issues that exist throughout the Village and he wanted everyone to know the Village is diligently working on resolving these issues. He noted many properties have already been ticketed and he asked for everyone's patience concerning this issue. He then stated if anyone has knowledge of any maintenance issues to please either contact the Building Department or himself. IX. CLERK'S REPORT Clerk Kalogerakos had no formal report. He did announce June 12, 2009, is the date of the changeover to digital tv. He stated if anyone has questions they can call the Cable and Tele- communications Hot Line which has been set up to be active on June 12, 2009, at 847/663- 3055. Residents can also contact a website at www.dtv.gov to receive additional information concerning this conversion. X. STAFF REPORTS a. Village Administrator Mr. Wade stated the work on the Metra railroad bridge over Golf Road is anticipated to begin next Monday, June 15, 2009. Lanes will be reduced to one in each direction so it is recommended alternate routes be taken. Updates, as they become available will be on the Village's website. XI STAFF REPORTS (continued) b. Corporation Counsel Corporation Counsel had no formal report. REPORTS BY TRUSTEES a. Trustee DiMaria Minutes of June 8, 2009 Board Meeting'. 1) Trustee DiMaria presented for a second reading Ordinance 09 -07, Amending Title 1, Chapters 5 and 7 of the Municipal Code of the Village of Morton Grove Regard- ing Setting a New Time for Village Board Meetings, and Rules Regarding Nonofficial Recordings of Public Meetings by Tape, Film, or Other Means. This ordinance changes the start time of Village Board meetings to 7:00 pm, and updates the rules regarding the non- official recordings of public meetings by tape, film, or other means which will now require noti- fying the presiding officer or chairperson of that meeting of his /her intent to record and when- ever practical that any special requests be made at least two business days in advance. There was no discussion. Trustee DiMaria moved to approve Ordinance 09 -07. Trustee Thill seconded the motion. Motion passed: 6 ayes, 0 nays. Tr. DiMaria acre Tr. Gomberg aye Tr. Grear aye Tr. Toth aye 2) Trustee DiMaria presented for a second reading Ordinance 09 -08, Declaring a Moratorium on New Multi - Family Residential Housing Units in the C -1 Commercial District of the Village. He reiterated from the last meeting that in order to attract and retain commercial retail establishments within the Village, a study restricting or prohibiting multi- family housing units within the C -1 commercial district (which encompasses Dempster, Wau- kegan, Golf and Oakton) will be done when this ordinance is passed. It will also place a six - month hold on any future multi - family housing projects in the C -1 district while the Board and staff review the issue of restricting multi - family housing projects and prepare amendments to the Unified Development Code. Trustee DiMaria moved to approve Ordinance 09 -08. Trustee Toth seconded the motion. A brief discussion ensued wherein it was clarified that this was for a six month period or until an alternate decision is made regarding building multi - family units in the C -1 district. Trustee Gomberg 1) Trustee Gomberg presented for a first reading Ordinance 09 -09, Amending Title 2 of the Village's Municipal Code to Add a New Chapter 18 Entitled "Finance Advi- sory Commission ". This advisory commission will advise the Board on various financial conditions which exist in the Village. Those include but are not limited to the capital program and funding sources, the annual proposed budget, the condition of the bond rating, and fiscal stability. This ordinance will appear for its second reading on the June 22, 2009, Agenda. REPORTS BY TRUSTEES (continued) Trustee Gomberg Minutes. of June 8; 2009 Board Meeting 2) Trustee Gomberg presented for a first reading Ordinance 09 -10, Granting an Amendment to the Special Use Permit for the Property Located at 8710 Ferris and 8701 Lincoln Avenue for a Planned Unit Development. This ordinance would grant the devel- oper to increase the amount of town homes for this planned unit development back to 65 from 64, a change that was allowed with Ordinance 07 -07. The approval of this ordinance will once again formally grant the original amendment to the special use permit granted pursuant to Or- dinance 08 -58. This ordinance will appear for its second reading on the June 22, 2008, Agenda. Trustee Gomberg congratulated the newly appointed Trustee Toth. He stated they have al- ready worked together in other capacities and he is looking forward to working with her on this Board. Trustee Gomberg also congratulated the newly appointed commissioners and knows the dedication it takes to do their job. He praised all of them for their dedication. Trustee Gomberg stated a Condominium Association is once again being discussed and he is involved in meetings and outreach programs. He will keep everyone apprised as more infor- mation becomes available. C. Trustee Grear Trustee Grear had no formal report. He expressed a welcome to Trustee Toth. Trustee Marcus 1) Trustee Marcus presented Resolution 09 -30, Authorizing the Execution of a Contract with RJN Future Enterprises, Inc. for Replacing Shingled Roofs at the American Legion Memorial Civic Center. He noted the roofs, particularly over the main hall and kitchen have been experiencing leaks for a number of years and they have been becoming more frequent. RJN Future Enterprises of Morton Grove has submitted the lowest qualified bid at $31,500. Trustee Marcus moved, seconded by Trustee Toth, to approve Resolution 09 -30. Trustee Thill questioned the Building Commissioner as to why these roofs failed after only fourteen years. Mr. Hildebrant stated he felt it was not due to the materials. Toth ave Trustee Marcus congratulated Ms. Toth and knows she will be a great asset to the Board. REPORTS BY TRUSTEES (continued) e. Trustee Thill Minutes of June 8, 2009 toard Meeting 1) Trustee Thill presented Resolution 09 -31, Authorizing the Purchase of a New Hydraulic Breaker HP -1250. Trustee Thill noted this piece of equipment would replace a breaker which is no longer worth the cost of repair. This sole source purchase will be from West Side Tractor at a cost of $18,167. Trustee Thill moved, seconded by Trustee Marcus, to approve Resolution 09 -31. Trustee Thill asked Public Works Director Andy DeMonte what is a hydraulic breaker for the benefit of those present. Mr. DeMonte stated the hydraulic breaker is an air hammer that is mounted on the end of a backhoe. This breaker will replace a twenty year old piece of equipment. Mayor Staackmann then called for a vote. Motion passed: 6 ayes, 0 nays. Tr. DiMaria aye Tr. Gomberg aye Tr. Grear aye ` Tr. Marcus aave Tr. Thill aye Tr. Toth aye 2) Trustee Thill presented the first reading of Ordinance 09 -11, Establishing the Prevailing Rate of Wages for Laborers, Mechanics and Other Workers in the Village Employed in Performing Construction of Public Works for the Village. He stated this annual approval is required to comply with the requirements of the Illinois Prevailing Wage Act. Upon passage, the rates will be posted and made available for inspection by any inter- ested parties as well as filed with the Secretary of State and the Illinois Department of Labor along with publishing the rates in the Village's legal newspaper, the Morton Grove Champion. This ordinance will appear for its second reading on the June 22, 2009, Agenda. 3) Trustee Thill presented Resolution 09 -32, Authorizing the Approval and Participation in a Contract between Superior Road Striping, Inc and the Northwest Mu- nicipal Conference for the 2009 Lane Marking Program. He stated this contract is negoti- ated through the Northwest Municipal Conference which affords the member municipalities including the Village economies of scale for this specialized work. The estimated cost for this project is $30,000, however it is noted this is a unit price contract and the final cost will be based on the actual quantity of work performed. Trustee Thill moved, seconded by Trustee Marcus to approve Resolution 09 -32. Trustee Thill asked where the striping will be this year. Mr. DeMonte responded he did not have that information on hand but the Engineering Department will provide him a copy tomor- row. He noted this is annual maintenance that is performed on asphalt roadways only. Motion passed: 6 ayes, 0 nays. Tr. DiMaria aye Tr. Gomberg aye Tr. Grear aye Tr. Marcus aye Tr. Thill aye Tr. Toth avee Minutes of June 8, 2009 Board Meeting REPORTS BY TRUSTEES (continued) e. Trustee Thill (continued) 4) Trustee Thill presented Ordinance 09 -12, To Amend the Municipal Code to Restrict Parking on Crain Street Between Marmora Avenue and Menard Avenue within the Village. Trustee Thill stated area residents have voiced their concern about the difficulty of parking in front of their property. This is due primarily to the fact that Julia Molloy School does not have enough parking spaces in its own parking lot. After review by the Traffic Safety Commission the recommendation was to install a Zone 11 parking restriction; however staff felt this particular zone would not negate the school parking situation. Staff has therefore rec- ommended a Zone 1 parking restriction be put into place which would restrict parking be- tween the hours of 6:00 am and 3:00 pm on school days and would more effectively restrict this area. This ordinance will appear for its second reading on the June 22, 2009, Agenda. Trustee Thill thanked the Fire Department for their excellent annual report and placed it on the dais for anyone to inspect. He also stated the Historical Society museum is having an open house and garden tour on June 20, 2009, from 1:00 pm to 4:00 pm. He also noted he had Champion Heritage Tree nomination forms and we, as citizens of Morton Grove, should be proud of our many historical trees. He then noted the Chamber of Commerce will hold a bowling night on July 11 from 6:30 pm to 9:00 pm. The cost will be $20 and he believed food would be available. Trustee Toth Trustee Toth had no formal report. She did state she was thrilled to have been appointed to this Board and thanked everyone for their warm welcome. She has served the Village in other capacities since 1997 and is now looking forward to the challenges ahead. She acknowl- edged her family members and friends and thanked them for all their support. XIL OTHER BUSINESS Trustee Grear stated he has been meeting with various chairpersons of boards and commis- sions, as well as commission members, and residents and it was noted inconsistencies exist in the Village Code relative to appointment procedures, removal procedures, setting times for meetings, meeting procedures, and compensation for board and commission members. After speaking with Mayor Staackmann and Corporation Counsel, Trustee Grear made a motion to review the Municipal Code regarding Village board and commissions, and propose amend- ments to the regulations contained in that portion of the Code, if appropriate. Trustee DiMaria seconded the motion. A brief discussion ensued and it was decided a small committee would be formed with the help of the Village President to review these inconsistencies. Motion passed: 6 ayes, 0 nays. Tr. DiMaria aye Tr. Gomberg aye Tr. Grear aye Tr. Marcus ave Tr. Thill aye Tr. Toth aye Trustee DiMaria welcomed Trustee Toth to the Board. Trustee DiMaria recommended De- partment Directors sit at the table with the Village Administrator to expedite responses to Vil- lage Board questions during Village Board meetings. It was felt this may save time and any inconvenience. It was then suggested Mayor Staackmann take time to look into this matter. XIII Minutes: of June 8, 2009 Board Meeting WARRANTS Trustee Gomberg presented the Warrant Register for May 25, 2009, in the amount of $404,526.11. He moved to accept the Warrants, seconded by Trustee Marcus. Trustee Thill questioned a line item on page 4 which was for an annual charge of $8,600 for an annual emergency generator PN contract. Mr. Horne did not recall this particular item but stated he would get back to Trustee Thill. Trustee Thill questioned a line item on page 13 for $905 which was for chip cards for the Metra meters. Mr. Horne stated these are the cards that passengers can pay for ahead of time and store monies on for parking in the Metra lots. Mayor Staackmann then called for a vote. Toth aye Trustee Gomberg presented the Warrant Register for June 8, 2009, in the amount of $602,556.99. He moved to accept the Warrants, seconded by Trustee Grear. Trustee Thill questioned a line item on page 15 which was for $5,300 to Terracon Consult- ants. Mr. Horne stated this was a final bill /payment for an EPA remediation study performed within the Lehigh /Ferris TIF District, Site "B'. Tr. Marcus Mayor Staackmann then called for a vote. Ms. Went expressed her concern about deputy clerks and stated this was a topic close to her heart since she was Village Clerk for 12 years. Ms. Wendt felt Village em- ployees should not be asked to be deputy clerks because their allegiance could be tested. Mr. Kansoer stated he concurred with the appointment of Ms. Toth. He also did not want to be confrontational but he had great concern about the passage of Ordi- nance 09 -07. He felt government should be transparent and cautioned the Board on the en- forcement of this ordinance. Bonita Lagutous. She expressed her concern about the reconstruction of Dempster Street and the installation of a center lane and making it a "super highway'. She stated people will not walk from the parking lots the Village is making and removing street parking is a mistake for the local businesses. Minutes of June 8; 2009 Board Meeting'. Mayor Staack- mann stated there have problems getting vendors and volunteers for this endeavor. He sug- gested contacting the Chamber of Commerce and Economic Development Director Bill Neuendorf. Trustee DiMaria and Trustee Marcus stated the Village has been looking at a farmers' market for some time and suggested Ms. Otte attend the next Economic Develop- ment Commission meeting. They are always looking for individuals with energy and drive. Eric Poders. Mr. Poders stated the Village has been looking at a Farmers' Market for over two years. He said "we" are also looking into a community garden which he has been per- sonally working on. He was disappointed at the passage of Ordinance 09 -07 and will be in Lisa Madigan's office in the morning. Trustee Thill. Trustee Thill stated Dempster Street is out of the Village's hands. He stated the Village is working diligently to stay ahead of the curve so the State does not "railroad" the Village into anything. In 1980 -81 he operated a Waukegan Road retail store called Metro Golden Memories and broadcast his "Those Were the Days" program from a radio studio in Morton Grove from 1980 to 1987; and WHEREAS, from October 2006 thru September 2007 lie hosted the nationally syndicated old -time -radio series When Radio Was, replacing Stan Freberg. The program was heard in more than 200 markets from coast -to- coast; and WHEREAS, a founding member of the Board of Directors of Chicago's Museum of Broadcast Communications, he is the Midwest's leading radio historian and a resource for public libraries, metropolitan daily and community newspapers, and colleges and universities throughout the country. LDC's tasks will be to identify areas of landscape plantings by assessing sidewalks, existing vegetation, sculpture and other features that will enhance the appearance of the Fire Station site landscape including the green area on Lincoln Avenue and the Library front area open space. Prepare Conceptual Design Plans LDC will develop conceptual landscape planting design plans for the Fire Station site and the Library green space fronting Lincoln Avenue. The planting design will include investigating the use of native plantings and creating special planting features in the existing open space area. These concepts will be designed to blend with the existing basic landscape and walkways accommodating existing and future special elements such as sculpture and /or fountains. Probable construction costs will be estimated in this phase. Prepare Construction Documents. Bid, and Construction Phase Services LDC will develop construction documents and probable costs of construction for receipt of competitive bids from construction contractors for the landscape improvements. PART II: FINAL DESIGN & CONSTRUCTION DOCUMENT WORK ITEMS Task 4 Design Development Plan and Cost Estimate 4.1 Prepare separate Final Landscape Design Plans (LD) for the fire Station and Library project areas that illustrates consensus of landscape design elements and styles developed in Task 3. These plans will be colored for presentation purposes. Each Plan will initiate the development of Construction Documents for landscape plantings that may be incorporated into MAI's corridor improvements for the entire project area. 4.2 Prepare general estimate of probable construction costs for each site utilizing the LD as the basis. Task 5 Construction Document Preparation 5.1 Construction Documents will be developed using the LD as the basis, that are assumed to be bid as one package with both the Fire Station and Library projects, and may include the following: . Landscape planting plans, plant list and planting details. • Sidewalk layout plans and details for special pedestrian paving, where appropriate. • Existing tree protection plan and details. . Project Initiation Meeting: One (1) meeting with key staff and other stakeholders. . Design Workshop: A design workshop will be conducted with the Village and Library staff and MAI project engineers to review schematic concepts for the project design components with the out come resulting in a final landscape design plan consensus. • Design Concept Review Meetings (1 total): Prior to the development of Construction Documents, one (1) meeting will be held with the appropriate Village staff. Task 7 Meetings — Part 11 7.1 Task 7 provides for one (1) meetings in Part Ii, Tasks 4 and 5 for each project included in this proposal, for a grand total of 2 meetings: • Construction Document (CD) Preparation Review: A CD review will occur during the construction documentation process at 50 %, complete. A total of one (1) meeting is included in this task. Members shall be residents of the Village of Morton Grove, and to the extent possible, shall possess training, understanding, interest, experience or a professional background in financial matters. The Finance Director or his designee shall be the staff liaison to provide administrative and technical assistance to the Commission. B. Commissioners shall serve terms of three (3) years or until his or her successor has been appointed. Initially, Commissioners shall serve staggered terms so that at least one (1) person shall be appointed to a one (1) year term, at least two (2) persons shall be appointed to a two (2) year term, and at least two (2) persons shall be appointed to a three (3) year term. C. The Village President shall aimually appoint one (1) member of the Commission to serve as its chairperson and another member to serve as its vice chairperson. The chairperson shall preside at all meetings of the Commission unless the chairperson is absent or unable to act for any reason, and in such event the vice chairperson shall perform the functions of the chairperson. D. All records and files of the Connnission shall be maintained in the office of the Village Staff Liaison. 2 -18 -2: MEETINGS: A. The Commission shall hold regular meetings pursuant to a scheduled times established in December of each calendar year by the Village President with the concurrence of the Board of Trustees. The meeting shall be held on Village property unless otherwise approved by the Village President. B. All meetings shall be scheduled and be held in compliance with the Illinois Open Meetings Act. Notice of said meeting shall also be given pursuant to the Illinois Open Meetings Act. C. Special meetings may be called by the Village President, the Chairperson, or by a majority of a quorum of the members of the Commission. All special meetings shall comply with the Illinois Open Meetings Act. D. All meetings shall be open to the public except as allowed by the Illinois Open Meetings Act. E. A majority of the duly appointed Commission members shall constitute a quorum. A quorum must be present for the transaction of business at any Commission meeting. If a quorum is not present, the secretary of the Commission will adjourn the meeting and post a notice of an adjournment to include time, place and date of the next meeting. F. Official action may be taken by the Commission only at a duly called meeting, pursuant to the vote of majority of Commission members present. The Chairperson shall vote in the same manner and under the same circumstances as other Commission members. 2 -18 -3: RULES AND PROCEDURE: The parliamentary procedure prescribed in Robert's "Rules of Order" shall be followed as far as applicable, except the Commission may adopt its own rules of procedure which shall always take precedence. 2 -18 -4: FUNCTIONS, POWERS AND RESPONSIBILITIES: A. Except as expressly provided otherwise in this Municipal Code, the Commission shall serve in an advisory role, and shall make all recommendations to the Village Board of Trustees regarding the development of policies and procedures. To advise the Corporate Authorities regarding the general long term and strategic financial direction of the Village. 2. To assist the Corporate Authorities in informing the residents of the Village of Morton Grove of the present and future financial status and long term financial strategies and opportunities for the Village. 2 -18 -5: COMPENSATION: Commissioners shall serve without compensation, but may be reimbursed for expenses incurred in the operation and conduct of affairs of the Commission which have been previously approved by the Village Administrator. SECTION 3: The terms and conditions of this ordinance shall be severable and if any section, term, provision, or condition is found to be invalid or unenforceable for any reason by a court of competent jurisdiction, the remaining sections, terms, provisions, and conditions shall remain in full force and effect. SECTION 4: In the event this ordinance or any part thereof is in conflict with any statute, ordinance, or resolution or part there, the amendments in this ordinance shall be controlling and shall supersede all other statutes, ordinances, or resolutions but only to the extent of such conflict. Except as to code amendments set forth above in this ordinance, all chapters and sections of the Morton Grove Pillage Cdde as amended shall remain in full force and effect. The authority of the ARC to provide disaster services was reaffirmed by federal law in the 1974 Disaster Relief Act (Public Law 93 -288) and in the 1988 Robert T. Stafford Disaster Relief and Emergency Assistance Act. The purpose of this Memorandum of Understanding (MOU) is to create a working relationship between the American Red Cross of Greater Chicago (herein referred to as "ARC ") and the Village of Morton Grove in preparing for and responding to disaster situations at all levels and assisting emergency response efforts, where necessary. This agreement describes the broad framework for cooperation between the two organizations to provide assistance and support services to victims of major emergencies or disasters as well as emergency responders, and to coordinate emergency preparedness activities where practical and beneficial. Accordingly, the Village of Morton Grove and the American Red Cross, Greater Chicago Chapter agrees that: 1) The American Red Cross and the local municipality will each provide disaster relief services according to the mandate, policies, and procedures of their individual organizations, and pursuant to Village of Morton Grove's Code of Ordinances, as attached. 2) Both organizations will endeavor to coordinate efforts and maintain communications to maximize timely and comprehensive services to disaster clients and prevent duplication of efforts. 3) To the extent of its abilities, the American Red Cross will provide, at no charge to disaster victims, disaster relief assistance including emergency mass care and individual assistance for individuals with urgent and verified disaster- caused needs. Assistance is provided to sustain human life, reduce the harsh physical and emotional distress that prevents victims from meeting their own basic needs, and promote the recovery of victims when such relief assistance is not available from other sources. 4) American Red Cross assistance to disaster victims is not dependent upon a local, state or federal declaration. All American Red Cross Disaster Services are provided in accordance with the American Red Cross Disaster Services Regulations and Procedures. The American Red Cross will maintain administrative and financial control over its activities. 5) In carrying out its responsibilities to provide for mass care in peacetime disasters, including precautionary evacuations and peacetime radiological emergencies /nuclear accidents, the American Red Cross will operate appropriate shelter facilities and arrange for mass feeding and other appropriate support. In doing so, the American Red Cross Together, we can save a life One Serving the seven counties of northeastern Illinois uniteaway will pay related costs only when such activities are under administrative control of or authorized by the American Red Cross, or when prior written agreements have been made for some other organization to provide emergency services on behalf of the American Red Cross. 6) Close liaison will be maintained between the Village of Morton Grove and ARC by conference, telephone, facsimile, email, and other means to facilitate the coordination of resources, both human and material, and the cooperation of the parties in areas of mutual interest. 7) To facilitate client access to additional Village resources, the American Red Cross with the approval from the client will share the disaster clients contact information with the Village of Morton Grove. 8) The Village of Morton Grove and ARC will include representatives of the other in its committees, task forces, and working groups formed to mitigate, prepare for, respond to and recover from disasters or other emergencies. 9) During emergency operations, the Village of Morton Grove may provide workspace for liaisons of the ARC in the Village of Morton Grove's Emergency Operations Center and other locations as appropriate, and the ARC agrees to supply such liaison personnel, if requested to facilitate the communication between agencies and vice versa. 10) The Village of Morton Grove and ARC agree to keep the other informed of developing disaster and emergency situations and of any known victim or emergency responder needs relating to the disaster or emergency situation. 11) ARC will operate shelters and arrange for mass feeding and other appropriate support, as available. The Village of Morton Grove volunteers will assist ARC in staffing and arranging for meals as appropriate. 12) During major emergency events or disasters where ARC services are deemed necessary by the Village of Morton Grove; ARC and the Village of Morton Grove will advise each other on the actions they have taken, in order to ensure effective assistance to all disaster victims and to ensure efficient use of resources. 13) Vehicles operated by or for the Red Cross will be considered authorized emergency vehicles for the purpose of proceeding to or entering a disaster site. 14) Each organization agrees to continue cooperative efforts in the areas of disaster preparedness, training, and planning. The parties hereto agree to attempt, in all respects, to coordinate efforts between the two in accordance with the terms of the Agreement and the responsibilities enumerated herein to best serve the community. This Memorandum of Understanding does not create a partnership or a joint venture, and neither party has the authority to bind the other. Staff and visitors at Julia Molloy School (Niles Twsp Dist for Special Education 4807) regularly park on the 5800 block of Crain Street because the school's parking lot does not have enough parking spaces. Existing parking on this segment is already restricted on the north side to Village residents displaying a Morton Grove vehicle sticker. Julia Molloy School staff has been able to obtain an adequate number of off - street parking spaces at the adjacent privately -owned properties for Monday through Thursday. The Traffic Safety Commission was supportive of the Village implementing parking restrictions during days and hours when school is in session. The Traffic Safety Commission then recommended Zone 1 1 parking restrictions be implemented. However, Zone I I parking restrictions limit parking between 6:00 am and 9:00 am, only which would not provide the solution the Traffic Safety Commission had supported, nor the request made by the residents. Therefore staff is recommending Zone I parking restrictions which limits parking on school days between 8:00 am and 3:00 pin except for vehicles displaying the Zone 1 special parking permit, the Traffic Safety Commission also recommended the Village furnish twenty special parking permits to the Julia Molloy School to be limited for use by school staff on the third Monday of certain months. Public Works Department, Police Department Costs will be associated with the signage materials, installation and perpetual maintenance. The cost of the materials is approximately $210.
