CALL TO ORDER
Village President Dan Staackmann called the meeting to order at 7:30 p.m. After leading the
assemblage in the Pledge of Allegiance, he directed the Village Clerk to call the roll.

Gomberg, Bill Grear, Shel Marcus, and John Thill.

APPROVAL OF MINUTES
Regarding the Minutes of the April 27, 2009 Regular Meeting, Trustee DiMaria moved,
seconded by Trustee Thill, to accept the Minutes as presented. There was no discussion.
Motion passed unanimously via voice vote.

PRESIDENT'S REPORT
Mayor Staackmann presented for a first reading Ordinance 09 -07, Amending Title 1,
Chapters 5 and 7 of the Municipal Code of the Village of Morton Grove Regarding
Setting a New Time for Village Board Meetings, the Appointment of Deputy Clerks,
and Rules Regarding Nonofficial Recordings of Public Meetings by Tape, Film, or
Other Means.
This ordinance will change the start time of Village Board meetings to 7:00 p.m.; authorizes
the Village Clerk to appoint up to four (4) Deputy Clerks, and updates rules regarding the non-
official recordings of public meetings by tape, film, or other means.

2. Next, Mayor Staackmann proclaimed the week of May 10 —May 16, 2009 as "National Police
Week" in the Village, and Friday, May 15, 2009, as "Peace Officers Memorial Day." He
urged all citizens to join in commemorating police officers, past and present, who, by their
faithful and loyal devotion to their responsibilities, have rendered a dedicated service to their
communities and in doing so, have established for themselves an enviable and enduring
reputation for preserving the rights and security of all citizens.
3. Mayor Staackmann then proclaimed May 17 —May 23, 2009 as "National Public Works Week ",
noting that the health, safety, and welfare of Morton Grove greatly depends on the Public
Works systems and programs (such as water, sewers, streets and highways). He encouraged
everyone to recognize the contributions which Public Works officials make every date to our
health, safety, comfort, and quality of life.
4. Mayor Staackmann then declared the assignments for Department and Committee liaisons:
a. Trustee DiMaria will be the liaison to the Community and Economic Development Department,
the Waukegan Road TIF Review committee, the Comprehensive Plan committee, the Real
Estate Committee, the Lehigh /Ferris TIF Review committee, the Economic Development
Commission, and the Dempster Street Corridor Plan committee. His back -up will be Trustee
Thill.
b. Trustee Gomberg will be the liaison to the Finance Department, Community Relations Com-
mission, Northwest Municipal Conference, and the Condominium Association. His back -up is
yet to be named.
c. Trustee Grear will be the liaison to the Fire Department, the Emergency Management Agency,
the RED Center, NIPSTA, and the Police and Fire Commission. Trustee DiMaria will be his
back -up.
d. Trustee Marcus will be the liaison to the Family and Senior Services Department, the Police
Department, the Board of Environmental Health, the Police and Fire Commission, the IT
Communications department, and the Chamber of Commerce. Trustee Gomberg will be his
back -up.
e. Trustee Thill will be the liaison to the Public Works Department, Capital Projects, the Traffic
Safety Commission, the Natural Resource Commission, the Solid Waste Agency of Northern
Cook County (SWANCC), and the Advisory Commission on Aging. Trustee Marcus will be his
back -up.
f. Clerk Kalogerakos will be the liaison to the Legal Department and the Cable and Telecommu-
nications Commission. Temporarily, until a new trustee is appointed, Mayor Staackmann
will be the liaison to the Building Department, Zoning Board and Plan Commission, Capital
Projects, and Appearance Commission, Trustee Grear will be his back -up.
5. Mayor Staackmann announced that he is taking applications /resumes for the open trustee
seat and all open commission seats. This will also be posted on the Village's website. He
said that he and a committee of at least one other trustee would hopefully be able to make
some decisions on these openings within the next 30 days.

VII. PRESIDENT'S REPORT (continued)
6. Mayor Staackmann said that the Village had received correspondence from Rep. John
D'Amico (5h Dist.) informing him that the Village will be receiving Illinois Department of
Transportation (IDOT) funding for new roadway lighting on Waukegan Road from Main
Street to Dempster, valued at $430,000. Mayor Staackmann expressed his gratitude to
Rep. D'Amico and to Rep. Elizabeth Coulson, Rep. Lou Lang, and Senator Ira Silverstein
and Senator Jeffrey Schoenberg for their efforts in this matter and their ongoing support of
the Village.
Vlll. CLERK'S REPORT
Clerk Kalogerakos had no formal report, but noted that Cook County property owners may still
appeal their property tax assessments at a workshop on May 19 at the Skokie Public Library
at 7:00 p.m. More information can be found at www .cookcountyboardofreview.com.
IX. STAFF REPORTS
A. Village Administrator
Mr. Wade announced that the Village Board Meeting scheduled for Monday, May 25, 2009,
was cancelled due to the Memorial Day Holiday.
2. Mayor Staackmann added that the time change of the Board meetings would officially begin
with the second Board meeting in June (June 22).
B. Corporation Counsel:
Ms. Liston had no report.

A. Trustee DiMaria:
TRUSTEES' REPORTS
Trustee DiMaria presented for a first reading Ordinance 09 -08, An Ordinance Declaring a
Moratorium on New Multi - Family Residential Housing Units in the C -1 Commercial
District of the Village of Morton Grove.
He explained that, in order to attract and retain commercial retail establishments within the
Village, a study restricting or prohibiting multi - family housing units within the C -1 commercial
district is being proposed. This ordinance will place a six -month hold on any future multi-
family housing projects in the C -1 district while the Board and staff review the issue of restrict-
ing multi - family housing projects in the C -1 district and draft appropriate amendments to the
Unified Development Code. The C -1 district basically includes commercial properties on
Dempster Street, Waukegan Road, Golf Road, and Oakton Street. Because multi - family
development is now allowed in the CR district, it may be desirable to eliminate multi - family
housing from the C -1 district. Time is needed to evaluate the options and obtain market
information as to the viability of retail properties in the C -1 district.

Trustee Marcus asked if this issue would be looked at again in six months.
Corporation Counsel Liston said that this ordinance places a six -month moratorium on the
issuance of permits. The Board and staff will review the codes to determine if the moratorium
should be lifted in six months or if the Board takes some other sort of action.
Trustee Gombera:
Trustee Gomberg presented Resolution 09 -27, Authorization for the Village to Update
Authorized Signatures on Village Bank Accounts.
He explained that, with the changeover of the Village Board after the April 2009 election,
various institutions will require the filing of a Village resolution for the new designation of
authorized signatories. With the departure of Mayor Krier and the appointment of a new
Finance Director, it is necessary to update the authorized signatures on the Village's bank
accounts.
Trustee Gomberg moved, seconded by Trustee Thill, to approve Resolution 09 -27. Motion
passed: 5 ayes, 0 nays.

Trustee Gomberg, in his role as liaison to the Community Relations Department, noted that
May is Asian - Pacific Heritage month. He congratulated all the various cultures that comprise
"Asian- Pacific ", commenting that over 20% of Morton Grove's population falls into the Asian -
Pacific category.
C. Trustee Grear:
Trustee Grear had no formal report. He thanked Building Commissioner Ed Hildebrandt
for looking into and promptly resolving an appearance problem that he had brought to his
attention. Trustee Grear also thanked Public Works Director Andy DeMonte for the tour of the
facilities he received; it was very educational. He also reported that he had met with Acting
Police Chief Mark Erickson and next week would be meeting with Fire Chief Tom Friel.
D. Trustee Marcus:
Trustee Marcus had no formal report. He said, regarding the IDOT grant, that it's of the utmost
importance for the Village to have a good working relationship with its State and Congres-
sional legislators, who can advocate for the Village and funnel some taxpayer dollars back to
the Village to fund some of its various projects. Trustee Marcus publicly thanked Rep. John
D'Amico, Rep. Lou Lang, Rep. Elizabeth Coulson, State Senators Ira Silverstein and Jeffrey
Schoenberg, and Congresswoman Jan Schakowsky, for all their efforts on behalf of the
Village of Morton Grove and its citizenry.

Trustee Thill
Trustee Thill presented Resolution 09 -28, Appointing a Director and Alternate Director to
the Solid Waste Agency of Northern Cook County (SWANCC).
He explained that, as a member of SWANCC, Morton Grove is entitled to appoint a Director to
serve on the Agency's Board. The Board of Directors approves the yearly budget for the
Agency, and sets policy for the region's long -term plan to manage the area's garbage. This
resolution will authorized Trustee Thill as the Village's Director to SWANCC's Board, with
Trustee Gomberg and Village Administrator Joe Wade as the Alternate Directors.
Trustee Thill moved, seconded by Trustee DiMaria, to approve Resolution 09 -28. Motion
passed: 5 ayes, 0 nays.

2. Next, Trustee Thill presented Resolution 09 -26, A Resolution Allowing the Extension of
the Janitorial Services Contract with Crystal Maintenance Service Corp., Mount
Prospect, Illinois.
Trustee Thill said that Crystal Maintenance Service had been awarded the janitorial contract
after a competitive bidding process in 2008. Crystal Maintenance Service has agreed to
continue providing their services at no increase in cost from the June 1, 2008 pricing. This
resolution will approve the extension of the janitorial contract to May 31, 2010, with no
increase in contract price.
Trustee Thill moved to approve Resolution 09 -26. Trustee Marcus seconded the motion.

3• Regarding the recent news stories about the Village of Crestwood's use of tainted water to
augment its water supply, Trustee Thill said he had asked Mr. DeMonte to do some research
on the Village's water. The Village does have five dry cleaners (one does the cleaning off -
premises). The EPA monitors the four who do their cleaning onsite. The Village does not have
any well water. Trustee Thill was pleased to report that "our water is pure."
As liaison to the Traffic Safety Commission, Trustee Thill mentioned that residents on Crain
Street had a problem with Malloy School parking overflowing onto Crain, and were looking for
some type of resolution. The Commission's recommendations will be brought up at a future
Board meeting. However, the MCC stepped in and offered to allow parking on their site on
Mondays, Tuesdays, Wednesdays, Thursdays. They are not seeking compensation for this;
they're just being good neighbors. Trustee Thill commended the MCC for their action, stating
that the Village is grateful and appreciates this gesture.

XI. OTHER BUSINESS

2. Trustee Marcus said that, as the liaison to the Chamber of Commerce, he has been ap-
proached by businesses on Waukegan Road, complaining that the lights keep going out.
Public Works looked into it and said it was a Commonwealth Edison problem. ComEd came
out and said there was an issue over a certain part. Trustee Marcus and the businesses are
concerned that this may be an ongoing problem. Mr. DeMonte said that ComEd reported they
had fixed the problem. Lyon Pinner Electric, the electrical contractor, has also checked into it.
All parties are aware of the problem and are trying to make sure it's permanently resolved.
XII. WARRANTS
Trustee Gomberg presented the Warrant Register for May 11, 2009 in the amount of
$362,817.40. He moved to accept the Warrants, seconded by Trustee Thill. There was no

XIII. RESIDENTS' COMMENTS
Rudy Firenza, 7628 Lake, Mr. Firenza said that he's come to numerous Board meetings re-
garding the sanitary sewer backing up in his neighborhood. He said he had asked the previ-
ous mayor to investigate this with Cook County/Water Reclamation District. He hopes that
someone from the Village had investigated and if there are any answers. Mayor Staackmann
said he would talk to Public Works about this and get back to Mr. Firenza.
XIV. ADJOURNMENT /EXECUTIVE SESSION
There being no further business, Trustee Marcus moved to adjourn to Executive Session to
discuss personnel, collective bargaining negotiations, the purchase and sale of real estate,
and pending and probably litigation. Trustee Thill seconded the motion. Motion passed:

The Board Meeting adjourned to Executive Session at 7:55 p.m.

Thill. Also attending from Village staff were Village Administrator Wade, Corporation Counsel
Liston, Public Works Director DeMonte, and Economic and Community Development Director
Neuendorf.

This resolution will authorize the Village Board meetings to begin at 7:00 pm rather than 7:30 pin, anc
will update rules regarding the nonofficial recordings of public meetings by tape, film, or other means.
Beginning meetings at 7:00 pm will be more convenient for the public and Village staff and will allow
for more effective discussion and resolution of Village business.
Village Code Section 1 -5 -7 sets the time and place of all regular Village Board meetings currently to
the second and fourth Monday of each month beginning at 7:30 pm. Recently, the newly elected
Village President and members of the Board of Trustees have requested the Village Board meetings
begin at 7:00 pm. Also, Section 1 -5 -5 establishes rules of procedures for Village Board meetings.
Rule 9 establishes rules regarding nonofficial recording of public meetings by tape, film, or other
means. Under the State of Illinois' Open Meetings Act, all non- closed sessions of public meetings may
be recorded. The Corporate Authorities are required to pass reasonable regulations defining these
recordings. Recently, a resident had voiced concern about the Village's requirement that "Any person
seeking to record a meeting note the Village Administrator of his or her intent to record said meeting
in advance." While this rule has never been used to prohibit any person to record a Village meeting
and is intended to advise Village staff, officials, and the public the meeting is being recorded, the
Corporate Authorities believe a clarification of this rule may be beneficial. Section 3 of this ordinance
revises Rule 9, Section C, Paragraph 3 to provide that, "Any person seeking to record a public meeting
must notify the presiding officer or Chairperson of that meeting of his or her intent to record the
meeting. Whenever practical, any request far special accommodations should be made at least two
business days before the meeting. "'This ordinance will amend the Code to effectuate these changes.
All departments and commissions will be informed of the updated changes to the Municipal Code.

ORDINANCE 09 -07
AN ORDINANCE AMENDING TITLE 1, CHAPTERS 5 AND 7 OF THE
MUNICIPAL CODE OF THE VILLAGE OF MORTON GROVE
REGARDING SETTING A NEW TIME FOR VILLAGE BOARD MEETINGS, AND
RULES REGARDING NONOFFICIAL RECORDINGS OF PUBLIC MEETINGS BY
TAPE, FILM, OR OTHER MEANS
WHEREAS, the Village of Morton Grove (VILLAGE), located in Cook County, Illinois
is a home rule unit of government under the provisions of Article 7 of the Constitution of the
State of Illinois, can exercise any power and perform any function pertaining to its government
affairs, including but not limited to the power to tax and incur debt; and
WHEREAS, the Board of Trustees recently requested Board meeting times be changed
so the regular Board meeting would begin at 7:00 pm; and
WHEREAS, an ordinance amendment is required to implement the requests of the Board
of Trustees and the Village Clerk; and
WHEREAS, the Corporate Authorities deem it to be in the best interest of the Village to
implement the aforedescribed modifications.
NOW. THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION l: The Corporate Authorities do hereby incorporate the foregoing
WHEREAS clauses into this Ordinance as though fully set forth therein thereby making the
findings as hereinabove set forth.
SECTION 2: Title I of the Municipal Code entitled Administrative, Chapter 5 entitled
Village Board of Trustees, Paragraph 7 entitled Meetings is hereby amended by repealing the

Board of Trustees at any meeting shall constitute proof of waiver of notice of such

B. Quorum: A majority of the elected members of the Board shall constitute a quorum to do
business. The President shall, for the purposes of quorum, be considered as one of the
elected members of the Board. A smaller number however, may adjourn from time -to-
time. No ordinance shall be passed, no ordinance shall be repealed, and the enforcement
of any ordinance shall not be stayed, except with the concurrence of a majority of the

To attract and retain commercial retail establishments within the Village, a study
restricting or prohibiting multi - family housing units within the C -1 commercial
district is being proposed.
To place a six month hold on any future multi; family housing proj ects in the C -1
District while the Village Board and staff review the issue of restricting multi-
family housing projects in the CA District and draft appropriate amendments to
the Unified Development Code.
Few large commercial sites remain in the C -1 District that basically includes
commercial properties on Dempster St, Waukegan Rd, Golf Rd, and Oakton St.
With multi - family development allowed in the CR district, it may be desirable to
now eliminate new multi- family housing from the C -1 district; or at least limit
multi - family units to upper floors of mixed use buildings. Time is needed to
evaluate the options and obtain market information as to the viability of retail
properties in the C -1 district.

AN ORDINANCE DECLARING A MORATORIUM ON NEW MULTI - FAMILY RESIDENTIAL
HOUSING UNITS IN THE C -1 COMMERCIAL DISTRICT OF THE VILLAGE OF MORTON GROVE
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home rule
unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois, and can
exercise any power and perform any function pertaining to its local government affairs; and
WHEREAS, multi- family residential housing units of various configurations are currently special
uses in the C -1 and C -2 commercial districts, and permitted on special uses in the C -R commercial district;
and
WHEREAS, the C -1 commercial district is the Village's main commercial district and is located
primarily along Dempster Street and Waukegan Road within the Village of Morton Grove; and
WHEREAS, there are very few parcels within this district available or expected to be available in a
lot size of one acre or more; and
WHEREAS, in order to attract and retain restaurants and retail establishments within the Village,
Village staff and officials are currently studying restricting or prohibiting multi - family housing units on
larger parcels within the C -1 commercial district; and
WHEREAS, the Village is interested in maintaining the proper balance of commercial and residential
uses in the Village; and
WHEREAS, additional time is necessary to fully evaluate, draft, and consider a change in the
Village's Municipal Code regarding such restrictions; and
WHEREAS, until the Village Board is able to complete its review, it is in the best interest of the
Village to declare a temporary moratorium on the approval of subdivision plats, special use permits, planned
unit developments and construction permits for multi- family residential housing units including attached
dwellings, multi family dwellings, community residences, and senior citizen housing in the C -1 commercial
district; and
WHEREAS, it is contemplated the Village will require up to six months before the Corporate
Authorities of the Village of Morton Grove will be able to fully evaluate and enact airy proposed
modifications to its Municipal Code regarding restricting multi - family residential units in the C -1
commercial district;
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Ordinance as though fully set forth therein thereby making the findings as hereinabove set forth.
SECTION 2: There is hereby established a moratorium upon the approval of preliminary subdivision
plats, final subdivision plats, special use permits, planned unit developments or construction permits for all
types multiple family development including, but not limited to: attached dwellings, multiple- family
dwellings, community residences, and senior citizen housing within the C -1 commercial district of the
Village of Morton Grove for a term of six months from the date of passage of this ordinance, or until the
enactment of legislation regulating multi- family units in this district, which ever occurs first.
SECTION 3: Nothing in this ordinance will be construed to prohibit the continuation of plats of
subdivision, special use permits in good standing, or current building permits for multi - family residential
housing units which were approved prior to the effective date of this ordinance.
SECTION 4: This Ordinance shall be in full force and effect upon its passage, approval, and
publication as required by law. _

WHEREAS, the Village President and Board of Trustees have determined it is in the best
interest of the Village to amend the Village Code to provide for a permanent standing
commission known as the Finance Advisory Commission to assist the Corporate Authorities and
Village staff to review and make recommendations to the Corporate Authorities regarding the
Village's investments, expenditures, indebtedness, and general financial policies.
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION l: The Corporate Authorities do hereby incorporate the foregoing

SECTION 2: Title 2 of the Municipal Code of the Village of Morton Grove is hereby
amended by adding a new Chapter 18 in its entirety as follows:

2 -18 -1: COMMISSION CREATED, MEMBERSHIP, TERM OF OFFICE:
A. There is hereby established a Finance Advisory Commission for the Village of Morton
Grove. The Finance Advisory Commission shall consist of no less than five (5) and no
more than seven (7) commissioners appointed by the Village President with the
concurrence of a majority of the Board of Trustees. Members shall be residents of the
Village of Morton Grove, and to the extent possible, shall possess training, understanding,
interest, experience or a professional background in financial matters. The Finance Director
or his designee shall be the staff liaison to provide administrative and technical assistance
to the Commission.
B. Commissioners shall serve terms of three (3) years or until his or her successor has been
appointed. Initially, Commissioners shall serve staggered terms so that at least one (1)
person shall be appointed to a one (1) year term, at least two (2) persons shall be
appointed to a two (2) year term, and at least two (2) persons shall be appointed to a three
(3) year term.
C. The Village President shall annually appoint one (1) member of the Commission to serve
as its chairperson and another member to serve as its vice chairperson. The chairperson
shall preside at all meetings of the Commission unless the chairperson is absent or unable
to act for any reason, and in such event the vice chairperson shall perform the functions
of the chairperson.
D. All records and files of the Commission shall be maintained in the office of the Village
Staff Liaison.
2 -18 -2: MEETINGS:
A. The Commission shall hold regular meetings pursuant to a scheduled times established in
December of each calendar year by the Village President with the concurrence of the
Board of Trustees. The meeting shall be held on Village property unless otherwise
approved by the Village President.
B. All meetings shall be scheduled and be held in compliance with the Illinois Open
Meetings Act. Notice of said meeting shall also be given pursuant to the Illinois Open
Meetings Act.
C. Special meetings may be called by the Village President, the Chairperson, or by a
majority of a quorum of the members of the Commission. All special meetings shall
comply with the Illinois Open Meetings Act.
D. All meetings shall be open to the public except as allowed by the Illinois Open Meetings
Act.
E. A majority of the duly appointed Commission members shall constitute a quorum. A
quorum must be present for the transaction of business at any Commission meeting. If a
quorum is not present, the secretary of the Commission will adjourn the meeting and post
a notice of an adjournment to include time, place and date of the next meeting.
F. Official action may be taken by the Commission only at a duly called meeting, pursuant
to the vote of a majority of Commission members present. The Chairperson shall vote in
the same marmer and under the same circumstances as other Commission members.
2 -18 -3: RULES AND PROCEDURE: The parliamentary procedure prescribed in Robert's
"Rules of Order" shall be followed as far as applicable, except the Commission may
adopt its own rules of procedure which shall always take precedence.
2 -18 -4: FUNCTIONS, POWERS AND RESPONSIBILITIES:
A. Except as expressly provided otherwise in this Municipal Code, the Commission shall
serve in an advisory role, and shall make all recommendations to the Village Board of
Trustees regarding the development of policies and procedures.
B. The Finance Advisory Commission shall have the following powers and responsibilities:
1. To advise the Corporate Authorities regarding the general long term and strategic
financial direction of the Village.
2. To work with the Finance Director /Treasurer of the Village of Morton Grove to
review existing and potential revenues and expenditures, and assist in identify
means to achieve and maintain fiscal stability.
3. To review the annual proposed Budget.
4. To review the Village's capital program and funding sources and make
recommendations to the Corporate Authorities regarding same.
5. Upon request of the Village President, to review Village's investments,
indebtedness, potential indebtedness, and condition of Village's bond rating.
6. To assist the Corporate Authorities in informing the residents of the Village of
Morton Grove of the present and future financial status and long term financial
strategies and opportunities for the Village.
2 -18 -5: COMPENSATION: Commissioners shall serve without compensation, but may be
reimbursed for expenses incurred in the operation and conduct of affairs of the
Commission which have been previously approved by the Village Administrator.
SECTION 3: The terms and conditions of this ordinance shall be severable and if any
section, term, provision, or condition is found to be invalid or unenforceable for any reason by a
court of competent jurisdiction, the remaining sections, terms, provisions, and conditions shall
remain in full force and effect.
SECTION 4: In the event this ordinance or any part thereof is in conflict with any
statute, ordinance, or resolution or part there, the amenchnents in this ordinance shall be
controlling and shall supersede all other statutes, ordinances, or resolutions but only to the extent
of such conflict. Except as to code amendments set forth above in this ordinance, all chapters
and sections of the MOrt0&Grove Village Code as amended shall remain in full force and effect.
SECTION 5: This ordinance shall be in full force and effect upon its passage and approval.

This ordinance will grant an amendment to the special use permit for the

the site plan to increase the total units of town homes from 64 to 65.
Purpose:
The Unified Development Code requires an amendment to a special use permit
when revisions are made to Planned Unit Developments.
Background:
In 2005, pursuant to Ordinance 05 -28, the Corporate Authorities approved a
special use permit for a Planned Unit Development at 8710 Ferris and 8701
Lincoln Avenue for the construction of 65 town homes. In 2007, at the request
of the owners, Toll Brothers, Inc., and pursuant to Ordinance 07 -07, the Village
approved an amendment to the special use permit to reduce the number of units
from 65 to 64 and to change the mix of the style of the units. The owners of the
property have again applied for an amendment to the special use permit which
would extend the changes approved in the first amendment, i.e., allow for 65
town homes with the original mix of units. Pursuant to the Unified Development
Code adopted pursuant to Ordinance 07 -07, such minor changes can be approved
without the need of going through a full formal Plan Commission process, so
long as the amendment has been approved by the Village Administrator,
Corporation Counsel, Building Commissioner, and Plan Commission
Chairperson. All these officials have approved the proposed amendment.
Approval of this ordinance will formally grant the amendment to the special use
permit granted pursuant to Ordinance 05 -28.

approve minor changes to the mix of unit types; and
WHEREAS, the applicant, Toll Brothers, Inc. has made a proper application to the Village of
Morton Grove for another minor amendment to the Planned Unit Development to change the site plan
back to 65 units of town homes and to the unit mix as originally approved pursuant to Ordinance 05-
28; and
WHEREAS, pursuant to Ordinance 07 -07 the Village adopted a Unified Development Code
which set forth an abbreviated procedure for minor revisions to special use permits and permits said
minor amendments to be made without a formal grant permission process upon the approval of the
Village Administrator, Corporation Counsel, Building Commissioner and Plan Commission
Chairperson; and
WHEREAS, the Village Administrator, Corporation Counsel, Building Commissioner and Plan
Commission Chairperson have approved the proposed amendment and have found the proposed site
plan changes meet the standards for the abbreviated procedure; and
WHEREAS, the property is zoned in the CR "Residential District' pursuant to the provisions of
the Village of Morton Grove Unified Development Code; and
WHEREAS, pursuant to the provisions of the Village of Morton Grove Unified Development
Code, the Corporate Authorities have determined the proposed amendment to the special use shall be
approved subject to conditions and restrictions as set forth herein.
NOW. THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS, AS

2005, elevations August 9 and 10, 2004.
2. Except as inconsistent with this amendment, all other provisions of Ordinance 05 -28 will
remain in full force and effect.
3. Approved amendment set forth pursuant to Ordinance 07 -07, reducing the number of town
homes from 65 to 64, and changing the mix of town homes is hereby rescinded
4. The special use as amended is granted so long as the occupant, and users of this property utilize
the property for the purposes as herein designated.
SECTION 3: The owners, lessees, and occupants of 8710 Ferris Avenue and 8701 Lincoln
Avenue their successors and assigns shall allow employees and authorized agents of the Village of
Morton Grove access to the premise at all reasonable times for the purpose of inspecting said premise
to verify all terms and conditions of the special use permit, as amended, have been met.
SECTION 4: The Village Clerk is hereby authorized and directed to amend all pertinent
records of the Village of Morton Grove to show and designate the special use permit as amended
hereunder.
SECTION 5: The Applicant /Owner shall comply with all applicable requirements of the
Village of Morton Grove Ordinances and Codes.

Objective
To award a contract for replacing the shingled roofs at the American Legion
Memorial Civic Center
Purpose:
The purpose of the contract is to replace leaking shingled roofs at the American
Legion Memorial Civic Center.
Background:
The building was purchased from the American Legion in 2000. During the 2001
building remodel the shingle roofs were not replaced since the American Legion
had replaced the roofing within five years of the purchase. The roofs, particularly
over the main hall and kitchen, have been experiencing leaks for a number of years.
The frequency and location of the leaks makes use and rental of the main hall
difficult. On April 23, 2009, the Village advertised for proposals for this project
and five contractors submitted bids ranging from $43,307 to $31,500. The lowest
qualified bidder was RJN Future Enterprises, Inc. of Morton Grove, Illinois at a
price of $31,500. The Building Commissioner recommends the bid of RJN Future

AUTHORIZATION TO EXECUTE A CONTRACT WITH
RJN FUTURE ENTERPRISES, INC. FOR REPLACING SHINGLED ROOFS
AT THE AMERICAN LEGION MEMORIAL CIVIC CENTER
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, the American Legion Memorial Civic Center was purchased by the Village in
2000 and during 2001,
the Building was remodeled; however, the singled
roofs
were not replaced; and
WHEREAS, the roofs, particularly over the main hall and kitchen
have
experienced leaks for a
number of years which
have interfered with the use and rental of the main
hall;
and
WHEREAS, the Building Commissioner has recommended the singled roofs at the American
Legion Memorial Civic Center be replaced; and
WHEREAS, on April 23, 2009 the Village advertised in the Morton Grove Champion
newspaper requesting sealed bids for replacing shingled roofs at the American Legion Memorial Civic
Center, 6140 Dempster Street, Morton Grove, Illinois based upon specifications contained in bidding
document 60 -1- (2009); and
WHEREAS, nine bid packets were distributed, and sealed bids were received from five
contractors with the following results:

WHEREAS, after a thorough review of the five bid packets it has been determined the lowest
qualified bidder able to meet the specifications in the bid documents is RJN Future Enterprises, Inc.,

WHEREAS, funds for this project have been appropriated in account 026029 - 554110,
American Legion Memorial Civic Center— Maintenance of Buildings.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Resolution as though fully set forth therein thereby making the findings as
hereinabove set forth.
SECTION 2: The Village Administrator or his designee is authorized to execute a contract
with RJN Future Enterprises, Inc., 6719 Church St, Morton Grove, Illinois 60053 for the replacement
of the shingled roofs at the American Legion Memorial Civic Center for a price not to exceed
$31,500.00 based upon their May 11, 2009, bid and village bidding document 60 -1- (2009).
SECTION 3: The Building Commissioner or his designee is hereby authorized to take all steps
necessary to manage and administer this contract and the replacement of the shingled roofs at the
American Legion Memorial Civic Center.
SECTION 4: That this Resolution shall be in full force and effect upon its passage and
approval.

This resolution will authorize the Public Works Department to purchase a new Indeeo HP
1250 hydraulic breaker.
Purpose:
To replace an existing 1989 hydraulic breaker used on the Village's 1989 John Deere 595
excavator that is no longer worth the cost of repair. This is a sole source purchase from
West Side Tractor.
Background:
The Public Works Department routinely reviews vehicles and equipment for safety,
dependability, age, and excessive repair cost by replacing or eliminating equipment that no
longer meets the department's needs. The Village currently uses a 1989 hydraulic breaker
on its excavator. This breaker's value is no longer worth the cost to repair and maintain.
The Village has identified an Indeco HP 1250 hydraulic breaker as the appropriate
replacement for the existing breaker. After research, the sole source vendor for this
equipment is West Side Tractor Sales Company in Naperville, Illinois at a cost of $18,167.
Staff recommends this equipment be purchased by the Corporate Authorities.

Objective
To establish prevailing wages for public works projects within the Village of
Morton Grove.
Purpose:
To comply with the requirements of the Illinois Prevailing Wage Act, 820 ILCS 130
et seq.
Background:
The Illinois Prevailing Wage Act requires contractor and subcontractor to pay
laborers, workers and mechanics employed on public works projects, no less than
the general prevailing rate of wages as established by the Village. "Public works"
are defined by the Act to mean all fixed works constructed by any public body, or
paid for wholly or in part out of public funds. Each year during the month of June,
the Act requires the Village to investigate and ascertain the prevailing rate of wages.
This ordinance adopts the prevailing wage rates established by the Illinois
Department of Labor for Cook County, Illinois as the prevailing wage rates for
public works projects in Morton Grove. A schedule of these rates can be found at:

of this Ordinance, the Act further requires the Village to post these rates or make
them available for inspection by any interested party; file a certified copy of the
Ordinance with the Secretary of State and the Illinois Department of Labor by July

the Village.

WHEREAS, the Village of Morton Grove ( "Village "), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article VII, Section 6 of the 1970; and
WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics
and other workers employed in any public works by the State, County, City or any public body or any
political subdivision or by anyone under contract for public works ", approved .Tune 26, 1941, as amended,
being Chapter 820ILCS 130/1 -12, Illinois Compiled Statues; and
WHEREAS, the aforesaid Act requires that the Village of Morton Grove investigate and ascertain
the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the
locality of the Village of Morton Grove employed iii performing construction of public works, for the
village; and
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: To the extent and as required by "An Act regulating wages of laborers, mechanics
and other workers employed in any public works by the State, County, City or any public body or any
political subdivision or by anyone under contract for public works" approved June 26, 1941, as amended,
the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in
the construction of public works coming under the jurisdiction of the Village of Morton Grove is hereby
ascertained to be the same as the prevailing rate of wages for construction work in the Cook County area
as determined by the Department of Labor of the State of Illinois as of June 2009, a copy of that
determination being attacW hereto as Exhibit "A" and incorporated herein by reference. The definition
of any terms appearing in this Ordinance which are also used in the aforesaid Act shall be the same as in
said Act.
SECTION 2: Nothing herein shall be construed to apply said general prevailing rate of wages as
herein ascertained to any work or employment except public works of the Village of Morton Grove to the
extent required by the aforesaid Act.
SECTION 3: The Village of Morton Grove shall publicly post or keep available for inspection by
any interested party at 6101 Capulina Avenue, Morton Grove this determination of such prevailing rate of
wage.
SECTION 4: The Village of Morton Grove shall mail a copy of this determination to any
employer, and to any association of employers and to any person or association of employees who have
filed, or file their
names and addresses, requesting copies of any
determination
stating the particular rates
and the
particular
class of workers whose wages will be affected
by such rates.

SECTION 5: The Village of Morton Grove shall promptly file a certified copy of this Ordinance
with both the Secretary of State Index Division and the Department of Labor of the State of Illinois.
SECTION 6: The Village Administrator shall cause a notice to be published in a newspaper of
general circulation within the area that the determination of prevailing wages has been made. Said notice
shall conform substantially to the notice attached hereto. Such publication shall constitute notice that this
is the determination of the Village of Morton Grove and is effective.
SECTION 7: This Ordinance shall be in full force and effect from and after its passage and
approval.

COMMUNICATIONS ELECTRICIAN - Installation, operation, inspection,
maintenance, repair and service of radio, television, recording, voice
sound vision production and reproduction, telephone and telephone
interconnect, facsimile, data apparatus, coaxial, fibre optic and
wireless equipment, appliances and systems used for the transmission
and reception of signals of any nature, business, domestic,
commercial, education, entertainment, and residential purposes,
including but not limited to, communication and telephone, electronic
and sound equipment, fibre optic and data communication systems, and
the performance of any task directly related to such installation or
service whether at new or existing . sites, such tasks to include the
placing of wire and cable and electrical power conduit or other

Synopsis:
This resolution approves a contract negotiated by the Northwest Municipal Conference with
Superior Road Striping of Melrose Park, Illinois to install thermoplastic pavement markings
in member municipalities including the Village of Morton Grove, and authorize the Village's
participation in this contract.
Purpose:
This work is necessary to maintain the condition and usefulness of thermoplastic pavement
markings on roads and at intersections throughout the Village in the interest of public safety.
Background:
The Village annually completes a Thermoplastic Pavement Marking Program. Historically,
the Village has participated in a thermoplastic lane marking contract administered by the
Northwest Municipal Conference (NWMC) in ajoint purchasing program with several
communities which creates economies of scale for this specialized work. After a competitive
bidding process, the NWMC awarded a contract to Superior Road Striping of Melrose Park
for this work on a unit cost basis. This company has previously done work in the Village in a
satisfactory manner.

WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of govermnent under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, the Public Works Department maintains pavement markings on roads and at
intersections throughout the Village for public safety; and
WHEREAS, there are twenty municipalities from the Northwest Municipal Conference
participating together this year in ajoint purchasing program for the 2009 Lane Marking Contract in
order to reduce costs: and
WHEREAS, the Northwest Municipal Conference bids this program under an Illinois
Department of Transportation contract; and
WHEREAS, participants in the Northwest Municipal Conference 2009 Lane Marking Contract
agree to only use the awarded vendor for thermoplastic lane marking; and
WHEREAS, the Northwest Municipal Conference awarded the 2009 Lane Marking Contract to
Superior Road Striping, Inc. of Melrose Park, Illinois; and
WHEREAS, the estimated Village of Morton Grove cost for this contract is $30,000.00, and
funding for the above work is included in the Village of Morton Grove 2009 Budget in General
Revenue Account 025017- 552290; and
WHEREAS, the locations included in the Village's 2009 'Thermoplastic Pavement Marking
Program includes mostly remarking crosswalks and stop bars at intersections throughout the Village;
and
WHEREAS, Superior Road Striping, Inc. has previously performed work for the Village of
Morton Grove in a satisfactory manner.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION I: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Resolution as though fully set forth therein thereby making the findings as hereinabove
set forth.
SECTION 2: The Corporate Authorities do hereby approve the 2009 Lane Marking Contract
between the Northwest Municipal Conference and Superior Road Striping, 1967 Cornell Court,
Melrose Park, Illinois, 60160, and authorize the Village's participation in this contract to complete the
Village's 2009 Thermoplastic Pavement Marking Program.
SECTION 3: The Director of Public Works and Village Engineer are hereby authorized to take
all steps necessary to participate in the 2009 Lane Marking Contract and authorize payment of same in
the not -to- exceed amount of $30,000 to Superior Road Striping of Melrose Park, Illinois.

To approve parking restrictions pursuant to the Traffic Safety Commission and Village Staff
recommendations.
To alleviate parking congestion from Julia Molloy School staff and visitors, and mitigate hindrances to
daytime snow plowing and street sweeping.
At the April 2, 2009, Traffic Safety Commission meeting a request was presented for parking restric-
tions on Crain Street between Marmora Avenue and Menard Avenue. Residents have requested zoned
parking on this street so residents have the ability to park their cars in front of their property, and to
allow public safety vehicles, streetsweepers and snow plows the ability to safely maneuver through the
thoroughfares. Staff and visitors at Julia Molloy School (Niles Twsp Dist for Special Education 4807)
regularly park on the 5800 block of Crain Street because the school's parking lot does not have enough
parking spaces. Existing parking on this segment is already restricted on the north side to Village
residents displaying a Morton Grove vehicle sticker. Julia Molloy School staff has been able to obtain
an adequate number of off - street parking spaces at the adjacent privately -owned properties for Monday
through Thursday. The Traffic Safety Commission was supportive of the Village implementing
parking restrictions during days and hours when school is in session. The Traffic Safety Commission
then recommended Zone I I parking restrictions be implemented. However, Zone 1 I parking
restrictions limit parking between 6:00 am and 9:00 am, only which would not provide the solution the
Traffic Safety Commission had supported, nor the request made by the residents. Therefore staff is
recommending Zone 1 parking restrictions which limits parking on school days between 8:00 am and
3:00 pm except for vehicles displaying the Zone I special parking permit, the Traffic Safety
Commission also recommended the Village furnish twenty special parking permits to the Julia Molloy
School to be limited for use by school staff on the third Monday of certain months.

AN ORDINANCE TO AMEND THE MUNICIPAL CODE TO RESTRICT PARKING
ON CRAIN STREET BETWEEN MARMORA AVENUE AND MENARD AVENUE
WITHIN THE VILLAGE OF MORTON GROVE
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a
home rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State
of Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur
WHEREAS, the Village established the Traf

above referenced request; and
WHEREAS, notifications of the meetings were sent to residents in the area; and
WHEREAS,
the
Traffic Safety Commission recommends
the Village require
parking
restrictions on both
sides
of the 5800 block of Crain Street between
Marmora Avenue and
Menard
Avenue, specifically Zone 11, which allows no parking between 6:00 a.m. and 9:00 a.m. except for
vehicles displaying a Zone I I special parking permit; and
WHEREAS, the Traffic Safety Commission also recommends the Village furnish twenty
special parking permits to the Executive Director of Julia Molloy School for use by school staff to be
limited to use only for the periodic staff meeting on the third Monday of certain months; and
WHEREAS, the Zone I parking restrictions do not prohibit parking during any of the
critical hours of a school day; and
WHEREAS, Rather than implementing the Traffic Safety Commission's recommended Zone
1 I parking restriction, staff has recommended the Zone 1 parking restriction be used which allows
for no more than one hour parking between 8:00 a.m. and 3:00 p.m. on weekdays when school is in
session except for vehicles displaying a Zone 1 special parking permit, which more accurately
achieves the stated objectives and goals of the Traffic Safety Commission; and
WHEREAS, the existing parking restriction on the north side of Crain Street between
Marmora Avenue and Menard Avenue is designated per existing Municipal Code, Section 5- 1317-4:
RESTRICTED PARKING STREETS, Subsection B: PARKING RESTRICTED TO VILLAGE
RESIDENTS ONLY and would not require repeal of any previous ordinances; and
WHEREAS, the Village Board of Trustees believe the best interest of the Village of Morton
Grove will be served by enacting new parking restrictions on the 5800 block of Crain Street between
Marmora Avenue and Menard Avenue.
NOW, THEREFORE, BE
IT
ORDAINED BY THE PRESIDENT AND BOARD
OF
TRUSTEES OF THE VILLAGE
OF
MORTON GROVE, COOK COUNTY, ILLINOIS
AS
FOLLOWS:
SECTION 1. The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance as though fully set forth therein thereby making the findings as
hereinabove set forth.
SECTION 2.
The following provisions be added to

SECTION 3. The Village Administrator shall also furnish 20 special parking permits to the
Executive Director of Julia Molloy School for use by school staff to be limited to use only for the
periodic staff meeting on the third Monday of certain months.
SECTION 4. The Director of Public Works is hereby authorized and directed to remove
any conflicting signs and erect such signs as detailed in this Ordinance.
SECTION 5. This ordinance shall be communicated to residents adjacent to the parking
restrictions via a letter, which shall be received as evidence of the passage and legal publication of
this Ordinance.
SECTION 6. This ordinance shall be in full force and effect upon its approval and
publication.
