CALL TO ORDER Village President Rick Krier called the meeting to order at 7:30 p. m. and led the assemblage in the Plddge of Allegiance. Village Clerk CaroF Fritzshall called the roll: Present were: Trustees Georgianne Brunner, Shel Marcus, Rita Minx, Dan Staackmann, and John Thill. Mayor Krier stated that he had received a call from Trustee Kogstad explaining that he had a family health matter to attend to and therefore would not be able to be at tonight's meeting. III. APPROVAL OF MINUTES Regarding the Minutes of the July 28, 2008 Regular Meeting, Mayor Krier asked if anyone had any changes or corrections to the Minutes. Seeing none, Trustee Minx moved, seconded by Trustee Thill, to approve the July 28, 2008 Regular Meeting Minutes as submit- ted. Motion passed unanimously via voice vote. Trustee Staadkmann asked if there was going to be a vote on the Minutes of the Special Meeting where the Dempster Street Improvement Project had been discussed. Mayor Krier said that was a good point and that he'd look into it. IV. PUBLIC HEARINGS NONE V. SPECIAL REPORTS a. Plan Commissioner Andrew Shimanski presented this case, which first came before the Commission in May. As stated, the applicant, Black and Veatch, agent for Verizon, is requesting a Special Use Permitfor a commercial wireless installation on the ComEd tower at 9400 Austin Avenue. Bonnie Jacobson, Village'Planner, indicated that the Fire Department was concerned that there might be interference with the Caltron Fire Alarm System. There were concerns expressed by the Commissioners about whether or not the Northwest Water Commission (NWWC) had approved this (their water main is in the right-of-way Yhere) and that the Applicant was planning to use 800 mhz frequency, which is lower than the other carriers. Minutes of August 11; 2008 Boartl Meeting V. SPECIAL REPORTS An interested resident also spoke out about the fact that there is no turnaround for the carriers' trucks there, and the existing carrier's trucks drive on the grass, causing ruts. Because the Applicant's representative was unable to respond immediately to these concerns, and because the original legal notice had been posted with the wrong address, the Plan Commission continued the case to its June 16'" meeting. At the time of the June 16'h meeting, the proper legalities as far as the legal notice and the posted sign had been corrected; however, the Applicant was still unable to provide the requested information, so the case was continued to the Plan Commission's July 21~` meeting. At the July meeting, the Applicant presented a letter from the executive director of the NWWC indicating approval of the project. The Applicant also provided a new site plan expanding the lease area to allow for a truck turnaround. The RF Engineer for the project stated that the 800 mhz frequency will not interfere with other communications systems. Captain Bill Porter of the Fire Department had contacted the Caltron representative, who said that no interference would be caused from commercial wireless antenna systems, thus alleviating Captain Porter's concerns. The Plan Commission unanimously voted to recommend approval of this request, with two Commissioners absent. b. Commissioner Shimanski presented this case as well. He said that Bank of America had bought out LaSalle Bank and is closing some branches and consolidating customers into other locations. The facility at 8745 Waukegan is one of the branches that will be receiving customers from other locations, hence the need to expand the drive-through. The applicant intends to reduce the width of an existing landscaped area to the south and relocate a transformer in order to accommodate the expanded drive-through. The Plan Commission, with two members absent, unanimously recommended approval of this request; subject to several wnditions; including having a stop sign and painted stop bar at the drive-through exit. VI. RESIDENTS' COMMENTS. (Agenda Items Only) Eric Poders. Mr. Poders had a question as to the status of the Bethany Terrace case. Mayor Krier asked him to bring it up again at the later Residents' Comments section of the meeting as that topic is not on tonight's agenda. VII. PRESIDENT'S REPORT Mayor Krier announced that Family Fest would take place again this year at the Village Hall. It will again be an all-day, family-oriented event held on September 20, 2008. He said there was a lot of interest and many people were asking to have it again. There will be a pancake breakfast in the morning, inflatable toys and a climbing wall, a New Resident Reception, recognition of people who've lived in Morton.Grove for 65 years or more, many other family activities, and a beer tent in the evening. He encouraged everyone to attend. Minutes of August 11; 2006 Board Meeting VIII. CLERK'S REPORT Clerk Fritzshall had no formal report, but noted that she is partnering with the Morton Grove Public Library to encourage voter registration. Pedple interested in registering to vote can come to the Library and do soon Wednesday evenings from 7:00 p.m. to 9:00 p.m. during the month of September. Village Hall. is also open on Thursday evenings from 5:00 to 8:00 p.m. and people can come to register there as well. Anyone who will be age 18 by November 4`h (Election Day) can register even if they are not currently age 18. IX. A. Village Administrator STAFF REPORTS Mr. Wade reported that the Austin Avenue resurfacing project will begin on August 18 and will be completed, according to estimates by the contractor, J.A. Johnson Paving, by approximately October 10`h. The work involves street resurfacing, intermittent curb and gutter work, and some sidewalk work as well. B. Corporation Counsel: Ms. Liston had no report. X. A. Trustee Brunner: TRUSTEES'REPORTS Trustee Brunner had no formal report, but noted that, according to the Department of Family and Senior Services, 122 people attended the "members only" senior Pest last weekend. Everyone had-a great time, and Trustee Brunher commended Jackie Walker-O'Keefe and everyone in that department for doing a wonderful job. 2. Trustee Brunner also reported that the Board of Environmental Health was reminding every- one to remain cautious about West Nile Virus. They are urging residents to take precautions, such as, if you're going to be outside, make sure you use insect repellant; try to remain inside at dusk;. and empty any standing water around the outside of your house to prevent mosqui- toes from breeding. B. Trustee Kogstad: Trustee Kogstad was absent-no report. Minutes of August 11..20086oard Meeting TRUSTEES' REPORTS (continued) C. Trustee Marcus: Trustee Marcus had no report. D. Trustee Minx: Trustee Minx presented for a first reading Ordinance 08-30, Granting a Special Use Permit in the Village for Property Located at 9400 Austin for a Commercial Wireless Antenna Installation. This is pursuant to Plan Commission Case PC 08-03 heard earlier this evening. This ordinance would grant the Special Use Permit as recommended by the Plan Commission. There were no questions or comments from the Board. 2. Trustee Minx next presented for a first reading Ordinance 08-31, Granting an Amendment to the Special Use Permit for the Property Located at 8745 Waukegan Road to Expand the Existing Drive-Through Facility. This is pursuant to Plan Commission Case PC 08-05 heard earlier this evening. Trustee Minx noted that the Village had received a letter from Bank of America requesting that the second reading of this ordinance be waived, since it's getting later in the construction season and they'd like to get this work done before the asphalt plants stop work, which is usually in November. Trustee Staackmann: Trustee Staackmann had no formal report, but thanked Building Commissioner Ed Hildebrandt, and the members of the Building Department and Public Works Department for their ongoing clean-up work at several residences that are up for foreclosure. He said the Village is doing whatever it can to help keep neighborhoods looking presentable. Minutes of August'11, 2008 aoatd Meeting X. TRUSTEES' REPORTS (continued) F. Trustee Thill Trustee Thill presented Ordinance 08-28, Revisions to Title 12, Chapter 14 Entitled "Flood Damage Prevention". This is the second reading of this ordinance. He explained this ordinance at the July 28th Board Meeting. In essence, in order to participate in the National Flood Insurance Program, the Village adopted the Flood Damage Prevention ordinance to be compliant with federal regulations. This ordinance seeks to minimize potential losses due to periodic flooding. Within the ordinance, several references are made to flood studies and maps that identify the flood boundaries and floodways within the Village. These studies and maps are periodically updated, and in order to remain compliant, the Village must adopt the most recent version of these maps and studies. This ordinance updates the most recent version of these maps and flood studies to August 19, 2008. Trustee Thill moved, seconded by Trustee Minx, to adopt Ordinance 08-28. Thill a~~e Next, Trustee Thill presented for a first reading Ordinance 08-32, Authorizing the Sale of Surplus Personal Property Owned by the Village of Morton Grove. He explained that this ordinance will authorize the sale of motor vehicles deemed surplus property by the Village. The Public Works Department annually reviews vehicle and equipment conditions for all Village departments. After said review, if the equipment is determined to be no longer useful for a variety. of reasons (including the cost of maintenance, replacementschedule{outdated; etc.), the Village is allowed to seltsaid equipment. There were no comments or questions from the Board on this ordinance. Trustee Thill thanked the MEC for inviting the Village to its barbeque. He said it was a very nice affair and it was great to see everyone there. XL OTHER BUSINESS NONE XI I. WARRANTS Trustee Minx presented the Warrant Register for August 11, 2008., in the amount of $587,163.77. She moved to approve the Warrants, seconded by Trustee Thill. Trustee Minx said she'd like more information aboutreimbursement checks that went out to Metra commuters. Minuted of Auaust 17, 2008 Boats Meeting XII. WARRANTS (continued) Finance Director Partipilo responded that there were several "glitches" when the new meters were installed. Commuters' cards weren't registering. A Police Department employee, Freya Maslov, witnessed some of these glitches. Everything is running smoothly now, but the Village is reimbursing the commuters who were affected by the problems. Trustee Thill asked about a $735 charge for skunk removal (14 reports). Trustee Thill wondered if that was for 14 skunks or 14 incident reports. Chief Tasch responded that it was 14 incident reports. The skunks were either caught or were already road kill. Trustee Thill clarified that, when the Police Department catches skunks, they are not released. Chief Tasch confirmed that caught skunks are euthanized. Mayor Krier called for the vote on the Warrants. Motion passed: 5 ayes, 0 nays, 1 absent. Tr. Brunner aye Tr. Kogstad absent Tr. Marcus a~ Tr. Minx ~ Tr. Staackmann ~e Tr. Thill aye XIII. RESIDENTS' COMMENTS Eric Poders. Mr. Poders gave kudos to Clerk Fritzshall for her deputy registrar class this past Saturday. He also asked what the status is of the Bethany Terrace project. He said that people often speak at various meetings without coming to the podium, and he wondered how that was recorded in the meeting minutes. When people speak from the audience, how do the note-takers hear them and identify them? Are they recorded in the minutes? He wanted to know, procedurally, how to address this. He also noted that the Appearance Commission Agenda was never posted until the day of the actual meeting and he was concerned that that might be a violation of the Open Meetings Act. Mr. Poders was dismayed at what happened at the Traffic Safety Commission last week. He said he didn't like coming to the podium pinpointing Village problems. He felt the Board was doing a good job. Mayor Krier assured Mr. Pdders that the Open Meetings Act was not violated; that Minutes are taken at all the meetings_and are available to the public; that all. the speakers' comments. are capturetl. Many times these meetings aren't well attended and it's up to the indivitlual chair- men'sdiscretion to let people speak from the audience. If someone else doesn't or can't hear someone speaking from the audience, it's up to that individual to come up and let the chair- man. know that the speaker's comments weren't heard. Mr. Poders said he knows there are ordinances stating, for example, that if someone interrupts a meeting, they can be fined. He said he wasn't about to sit in the gallery and shout "I can't hear you" and risk being fined. He said there were about 30 people in attendance at the Traffic Safety Commission meeting and, during the first case, there were 4 or 5 people talking who were never asked to come to the microphone. Later in the meeting, however, the Chairman was asking everyone to come up and use the microphone-and to provide their name and address. Even when people were reluctant to provide it, they were pressed for their exact address. Mr. Poders again alluded to the Bethany Terrace case, stating that he felt what happened to Ryan Gillingham, Village Engineer, at the Traffic Safety meeting was "uncalled for" and was a cause for alarm, Trustee Minx asked what exactly did Mr. Poders see that was a cause for alarm. He responded that the Appearance Commission meeting went quite smoothly, so he thought that the case was going to be pushed through easily. Minutes of August 11, 2008 Board Meeting XIII. RESIDENTS' COMMENTS (continued) Trustee Minx noted that cases do not get "pushed through"; everyone has to go through the same Procedural Control process. There's a schedule posted in the Building Department. It may "appear" to be pushed through when the Appearance Commission meeting occurs before the Traffic Safety Commission (one is the first Monday of the month; one is the first Thursday of the month). Mr. Poders said he was concerned that the Niles Township Supervisor, who is a Traffic Safety Commissioner, was berating Mr. Gillingham unnecessarily. He said he was planning to FOIA the minutes of that meeting and will also listen again to the audio portion. XIV. ADJOURNEMENT TO EXECUTIVE SESSION There being no further business, Trustee Minx moved to adjourn to Executive Session to discuss personnel, labor negotiations, and real estate. Ft~atmmisa ~~~c~~sa®~ August 25, 2008 Village President Members of the Village Board 6101 Capulina Avenue Morton Grove, Illinois 60053 Dear President Krier and Members of the Village Board: On August 18, 2008 a public hearing was conducted by the Morton Grove Plan Commission after a legal notice was published on July 31, 2008, in The Champion newspaper, a sign posted on the property and written notification sent to property owners within 250 feet of the subject property as required by ordinance, regarding: Plan Commission Case PC 08-04, wherein the applicant, Morton Grove DL, LLC, 6300 Lincoln Avenue, Morton Grove, Illinois, 60053, requested a Special Use Permit for a Planned Unit Development at 6415 Dempster Street, 6421-57 W. Dempster Street and 8717 Lincoln Avenue. Ms. Bonnie Jacobson, Planner, introduced the case for the Village. She summarized the history of the case beginning with the approval of the original P.U.D. in 2005, the amendment which shifted the entire development. south to avoid the flood plain. in 200, the_time extension granted in 2007 and then revocation of the original SpecialUse Peiinit by the Board of Trustees iri June 2008: When the Board revolted the Special Ilse in June, they did encourage the applicant to return if financing was obtained. The applicant now has obtained financing, which is why the P.U.D, is now being processed again. Because the P.U.D. is the same P.U.D. that was approved in 2006, the staff review on the site plan was not repeated Village Staff did request additional materials for this case relative to the market analysis and financial commitment for the project, due to weakened market conditions, and previous financial problems with the project that hindered construction of the original P.U.D. A revised construction schedule was also requested. Much of the requested material was provided, however, the market analysis was not. Mr. Steve Kropp, managing member of Morton Grove DL, LLC represented the applicant, along with Mr. Craig Tolan of Tolan Construction, the general contractor for the project. Mr. Kropp noted that he has now obtained financing for the project with a private equity group. He indicated that this group was enthused about the project and had confidence in the project and Morton Grove. Mr. Kropp expounded on his faith in his project and the Morton Grove market, and interest generated He noted that one of the conditions of his loan was receiving the Special Use Permit from the Village. Without it, the project would foreclose and that would be worse. He added that the market study was not included due to time constraints and cost. He noted that although a market study was not completed, an appraisal was submitted that demonstrated the market viability of the project. Mr. Tolan explained that they would begin construction with the Townhomes because they are already permitted, followed by Building B, then Building A. The Plan Commission had several questions for the applicant. Commissioner Shimanski asked if the project included value added engineering and questioned the phasing of the project. Commissioner Gabriel asked for more detail regarding the construction schedule, and management of the subcontractors. Commissioner Roepenack asked if there were any utilities left to develop on the site and Commissioner Gattorna asked what assurances that applicant could give the Plan Commission that the project would get built. Chairman Farkas expressed concern about the lack of a market study and the loan commitment letter. Mr. Ed Hildebrandt responded to Commissioner's Roepenack question regarding the utilities indicating that all of the utilities are installed, but the storm water detention is not yet connected. Corporation Counsel. Liston responded to Chairman Farkas question regarding the loan commitment, noting that a definite loan commitment letter was provided to the Village but it included sensitive and cordidential information, and therefore was not included in the packet for the hearing. Mr. Tolan responded to the remainder of the questions. He reviewed the financing indicating that money will be held in escrow and paid out over time as the project is completed. He believes from his resume and the resumes of others on the team that they have the necessary skills to complete the job in a timely fashion. He has experience managing large complex construction projects and as the general contractor, he is used to managing several subcontractors under him. He noted that while value added engineering, was a possibility on the interiors of the units, it was not really possible for the exterior construction. He commented that the phasing was set up so that they could begin construction as soon as possible. One interested party, Mr. Eric Poders, spoke regarding this case, He questioned who conducted the appraisal and its validity, to which Mr. Tolan responded that it was JSO, and that it was a legal document provided to the lender. One concerned party, Mr. Kyle Sechrist, spoke regazding this case, He lives in the new townhome development adjacent to the site, and he and his neighbors are anxious to see the project move forward and something built on the now vacant site. They were concerned that the necessary setbacks be maintained and that construction not start too early in the morning. Ms. Jacobson and Mr. Hildebrandt responded, informing Mr. Sechrist of the setbacks and Village-wide construction rules. Based on the information and evidence presented, Commissioner Shimanski moved, which Commission Dorgan seconded, to approve a Special Use Permit for a P.U.D. at 6415 Dempster Street, 6421-57 Dempster and 8717 Lincoln Avenue, subject to the following conditions: 1. That the P.U.D. be constructed in accordance with the site plan dated 5/14/08; 2. That the trash enclosure for Building "A" be relocated closer to the building; 3. That the floor plans and elevations be modified to address The Fire Department's concerns prior to obtaining a building permit; 4. Preservation of Health, Safety, Morals and Welfare -The establishment, maintenance and operation of the Special Use will not be detrimental to or endanger the public health, safety, morals or general welfare. The Plan Commission concluded that the establishment, maintenance and operation of the Special Use will not be detrimental to or endanger the public health, safety, morals or general welfare. Based on the information presented, the Plan Commission concluded that the welfare of the community would not be endangered. They concluded that the applicant's team had the ability to complete the .project and that the project could move forward. They believed that the construction of the P.U.D. would be better than the empty site, or face foreclosure. 2. Adjacent Properties -The Special Use should not be injurious to the use and enjoyment of other property in the immediate vicinity for the uses permitted in the zoning district. The Plan Commission concluded that the proposed Special Use should not be injurious to the use and enjoyment of neighboring properties. One adjacent neighbor spoke of his desire to see the project get started and built. There was some concern by the Plan Commission as to what would happen if the project. was not fully completed, but the applicant's general contractor was able to assure the commission that his team had the expertise to complete the project in a timely manner. 3. Orderly Development -The establishment of the Special Use will not impede normal and orderly development or impede the utilization of surrounding property for uses permitted in the zoning district. The Plan Commission concluded that the establishment of the Special Use will not impede the normal and orderly development of the. surrounding. area.. There was some concern-raised by the commissioner regarding the phasing of the project, with a preference for construction of thelarge building facing Dempster Street being constructed first instead of second. The commissioners felt this would be beneficial to the orderly development. However, the applicant's general contractor was able to explain why construction of the townhomes would be more beneficial, by allowing for a faster time frvne for the project; thus enhancing the orderly development of the area. 4. Adequate Facilities -Adequate utilities, access roads, drainage and other necessary facilities are in existence or are being provided. A11 of the utilities for the project have actually already been installed. The storm water detention system still needs to be connected; however, that will be completed as construction prrogresses further. 5. Traffic Control -Adequate measures have been. taken to provide ingress and egress designed to minimize traffic congestion of the public streets. The proposed use of the subject site should not draw substantial amounts of traffic on local residential streets. The access drive and circulation. did not change at all from the previous P.U.D. and, therefore, there were no traffic control concerns. 6. Adequate Buffering -Adequate fencing and(or screening shall be provided to ensure the right of enjoyment of surrounding properties to provide for the public safety or to screen parking areas and other visually incompatible uses. Adequate buffering was provided in the previous approved P.U.D: and since the plan has not changed the buffering is still sufficient. 7. Conformance to Other Regulations -The Special Use shall, in all other respects, conform to applicable provisions of this Ordinance or amendments thereto. Variation from provisions of this Ordinance, as provided for in Section 12-16-3A1, may be considered by the Plan Commission and the Village Board of Trustees as a apart of the special nse permit. The approved P.U.D. still needs to conform to the previous P.U.D. and the plan commission approved it based on the relevant conditions from the original P.U.D. These included setback variances, and conditional approval on various aspects of the project from the Appearance Commission, Pire Department and Village Engineer. Mr. Jack Hickey, Black and Veatch represented the applicant and answered questions from the Commission. __ _. _ _ __ _ __ _ _._. Commissioner Gabriet questioned the impacfbf the installation on the NorthwestWater Commission's (NWWC) water main in the righ`f-of--way. Mr. Hickey responded that he had a letter from the commission noting their approval. Chairman Farkas read the letter but commented that the letter did. not indicate approval, but indicated potential approval based on an engineer's report. Mr. Hickey did not have the engineer's report. Commissioner Roepenack questioned the use of the 800 mhz frequency since that appears lower than the other carriers and he was concerned. about frequency interference. Mr. Hickey could not respond. The Commissioners questioned Mr. Hickey with regard to the Fire. Department's concerns, to which he responded that Verizon was going to hire an independent contractor who would contact the Fire Department directly. One interested party, Mr. Arnold Lamm, spoke regarding this case. He had no objection to the tower. H'is concern was that there is not a turnaround for the tracks, as the trucks for the existing carrier does not back out the driveway, but simply drive on the grass causing ruts. Mr. Lamm also informed staff that the correct address for the site was the 9400 block of Austin Avenue, not the 9600 block which was in the original application. Ms. Jacobson responded that staff resent the letter Co property owners with 250 feet with the corrected address, but the legal notification to the paper was not corrected because the error was discovered after the legal notice was published.. Chairman Farkas was concerned that the legal notice was incorrect. Therefore, the Plan Commission continued"ttte case to the June 16, 2008 hearing date to send a new legal notice, post a new sign with the corrected address and obtain more information from the applicant regarding the NWWC's approval, the use of the 800 mhz Richard T. By the June 16, 2008 hearing, the legal notice had been corrected and the new sign posted, but the applicant did not provide the additional information, so the case was continued to the Juiy 21, 2008 hearing date. At the July 21, 200$ hearing, Mr. Hickey presented a letter from the executive director of the NWWG indicating approval of the project and a new site plan expanding the lease area to allow for a truck turnaround was submitted. Ms. Trisha Bhuayn fhe RF Engineer for the project testified regarding the 800 mhz frequency indicating that Yhis frequency will not interfere with other communication systems and this is a similar design as other installations elsewhere. Regarding potential interference with the fire alarm system, the applicant was not able to provide additional information. However, Captain Bill Porter, Director of Fire Prevention, stated that he contacted the Capron representative who said that no interference is caused from the commercial wireless antenna systems, thus alleviating Captain Porter's concern. No interested or concerned parties appeared at the June or July hearing dates. A motion was made by Commissioner Shimanski, and seconded by Commissioner Gabriel to approve a Special Use Permit for a commercial wireless antenna installation and ancillary ground-mounted equipment at ComEd Tower No. 165638 at 9400 Austin Avenue, subject to the following conditions: 1. That the proposed installation be constructed in accordance with the siteAandscape plan dated 6/26/08; 2. That the proposed. installation be constructed in accordance with the elevations dated 6126/08; 3. That the proposed fence be solid wood without gaps; 4. The letter provided by the NWWC indicates there will be no disruption to their water main, and it was concluded that the proposed installation would not affect the fire alarm system of a nearby church. Flood control systems: Flood control systems shall be installed in an existing building sewer only at least fifteen feet from the building wall. Flood control systems are not allowed in lieu of an overhead sewer for new construction as required in section 10-3-4. B. Check Valve: Two six inch (6") Palmer check valves, or an equivalent approved by the plumbing inspector, are required. C. Sump Pump: An overflow opening before the check valves shall discharge into a minimum 18"x30" basin located inside the manhole. A two inch ejector pump shall be installed in the basin with two inch discharge piping and check valve. The ejector pump discharge piping shall extend-four-feetabove-the sewer line and-discharge into-the Palmer valve closest to the street D. Manhole requirements. The manhole for a flood control systems shall be precast concrete or concrete block at least forty-eight inches (48") in diameter with a minimum twenty-four inch (24") diameter sealed cover flush with grade. Concrete block manholes shall have walls at least four inches thick with the inside parged with brushed cement. Manhole floors shall be concrete. The building sewer and Palmer valves shall be contained within the concrete floor. Manholes over three feet deep shall have ladder steps installed sixteen inches on center vertically begimiing one foot from the top of the manhole. D. Cleanout. A minimum six inch cleanout terminating at grade is required on the street side of the manhole. E. Pipe joints. All building sewer joints and joints between check valves within the manhole floor shall be lead type joints. Joints outside of the manhole shall be no-shear type mission couplings. Water service. All piping used for potable water shall be routed outside the manhole. G. Electric conduit. An underground rigid conduit shall be installed from the manhole to the building for the ejector pump circuit. Conduit and wiring inside the manhole shall be installed to electric code requirements for wet locations. Ord 08- ;date) 10-3-4: OVERHEAD PLUMBING REGULATIONS; A. Overhead Plumbing Required: All new buildings with basements, floors, rooms or occupancy areas below ground level at the building site and served by a public or private sewer system, shall-have overhead plumbing. No building permit application will be accepted nor any permits issued for construction of any structure unless plans and specifications therefore provide for overhead plumbing as called for in this Section. S. Footing Drains: Footing drains shall be connected to sump pumps for further discharge into storm sewer or drainage ditches. No footing drain or drainage the shall be connected to the sanitary sewer system. All sump basins shall be vented. C. Pipe Bedding: Bedding, other than concrete embedment, shall consist of gravel, crushed gravel, pea gravel, crushed stone or crushed slag, one-fourth inch to three-fourths inch (''/a" to 3/4") in size. As a minimum, the material shall conform to the requirements of Article 704.01 of the "Standard Specifications for Road and Bridge Construction", of the State of Illinois or ASTM C- 33. The gradation shall conform to gradation CA 7, CA 8, CA 11 or CA 1.3 of the Illinois Standard Specifications or to ASTM Graduation No. 67. The pipe shall be laid so that it will be uniformly supported and the entire length of the pipe barrel will have full bearing. No blocking of any kind shall be used to adjust the pipe to grade except when used with embedment concrete. Bedding shall be-required for all-sewer construction; except ductile iron pipe, and shall be of a minimum thickness equal to one-fourth ('/4) of the outside diameter of the sewer pipe but shall not be less than four inches (4"). D. Storm Water Discharge: Down spouts and storm water drains shall not be connected to the sanitary sewer but shall be discharged on splash blocks to run into a dry well located not less than ten feet (10') from any building wall. E. Building Permits: No building permit or certificate of occupancy shall be issued for any building, the construction of which is to be commenced after the date hereof, unless the plumbing connections and plans comply with the terms of this Section. The provisions of this paragraph shall. not be retroactive to building permits which have been issued prior to the date thereof. 10-3-5: SEPTIC TANKS: A. It shall hereafter be unlawful, on all new construction, whether residential, commercial or industrial, to use septic tanks, or field drain file sewerage disposal systems within the Village. B. Background: The Village currently has restricted parking on various streets throughout the Village where parking permits are distributed to residents who reside on the affected streets. Recommendation: First Reading: Required-Code Amendment Special Considerations or None Requirements: Administrator Approval h, lAd Jose F. ode, Village Administrator Reviewed by: Teresa Hoffiman Liston, Corporation Counsel Prepared by: Ryan Gillingham, Village Engineer ORDINANCE 08-38 AN ORDINANCE TO AMEND VILLAGE CODE SECTION 5-13F-4 TO PROVIDE FOR THE DISCRETIONARY DISTRIBUTION OF PARKING PERMITS BY THE VILLAGE ADMINISTRATOR WHEREAS, the Village of Morton Grove (Village}, located in Cook County, Illinois, is a home rule unit of government under the provisions of Article 7 of the 1970 Constitution oFthe State of Illinois, can exercise any powerand perform any function pertaining to its government affairs, including but not limited to the power to tax and incur debt; and WHEREAS, the Village has previously established a special permit parking process, codified under Section 5-13F-4: RESTRICTED PARKING STREETS within the Village Code, to alleviate parking congestion for residents near locations of high parking generation; and WHEREAS, Village Code Section 5-13F-4: RESTRICTED PARK[;`IG STREETS, Subsection A, states as follows: "Special Permit Parking: There shall be no parking on the following streets between the hours and on the days as indicated except for vehicles displaying a special permit or a special guest pass so to do. The Village Administrator shall issue one such permit for each vehicle registered to any resident of said streets upon showing proof of payment of the Village license fees as described in Section 5-3-3 of this title. Each such permit shall be fixed ftrmly to the lower Zeft hand portion of the rear window of the vehicle for which it is issued at all times when such vehicle is parked ors said streets. Guest passes shall be limited to two (2) per household and shall be issued only to residents on the restricted parking side of any Village street listed in the following schedule of restricted parking sh^eets to be used for vehicles visiting the residents on a temporary basis. (Ord.. 93-18, 5-10-1993)" ; and WHEREAS, currently parking permits are distributed through the officesof the Village's Finance Department only to those residents who reside on the side of the street affected by the permit parking restriction; and WHEREAS, residents on high traffic volume streets, or streets with other restrictsons or special issues, have expressed a desire to park on streets with permit parking restrictions; and WHEREAS, restricting parking on any street with permit parking may cause the unintended side effect of inconveniencing other local residents within a neighborhood; and WHEREAS, it is not the Village's intent to burden nearby residents when providing parking congestion mitigation to others; and WHEREAS, the Village believes and supports the concept that residents of a neighborhood, whenever possible, should be provided priority and reasonable access to existing parking near their residences, for themselves and their guests, to improve the safety and quality of life within each neighborhood; and WHEREAS, it is recommended the Village Code, Section 5-13F-4: RESTRICTED PARKING STREETS be amended to allow the Village Administrator discretion to distribute parking permits to those residents residing nearby, but not hnmediately adjacent to, permit parking restrictions; and WHEREAS, this discretionary distribution of parking permits may be provided only to those nearby residents residing within 500 feet of existing permit parking restrictions and who petition the Village Administrator and demonstrate, to the satisfaction of the Village Administrator, personal need based on circumstances caused by nearby permit parking restrictions; and WHEREAS, Village staff recommends the Municipal Code be amended to include the aforementioned amendment to the permit parking distribution procedure within the Village in order to accommodate the needs of Village residents; and WHEREAS, the Village Board of Trustees believe the best interest of the Village of Morton Grove will be served by concurring with the preceding recanmendations of the Village Staf£ NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT' AND BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS: Section 1. The Corporate Authorities da hereby incorporate the foregoing WHEREAS clauses into this Ordinance as though fully set forth therein thereby making the findings as hereinabove set forth. Section 2.
