MINUTES OF A REGULAR MEETING OF THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE COOK COUNTY, ILLINOIS, HELD AT THE RICHARD T. FLICKINGER MUNICIPAL CENTER APRIL 8, 2019 CALL TO ORDER I — Village President Dan DiMaria convened the Regular Meeting of the Village Board at V. 7:00 p.m. in the Council Chambers of Village Hall and led the assemblage in the Pledge of Allegiance. VI. Village Clerk Eileen Harford called the roll. Present were: Trustees Bill Grear, Rita Minx, Ed Ramos, John Thill, Connie Travis, and Janine Witko. VII. APPROVAL OF MINUTES Trustee Thill moved to accept the Minutes of the Regular Board Meeting of March 25, 2019 as presented, seconded by Trustee Minx. Motion passed unanimously via voice vote. VIII. SPECIAL REPORTS 1. Announcement of the Winter Photo Contest Winners Mayor DiMaria introduced Gina Schultz of the Community Relations Commission to announce the Winter Photo Contest winners. a. Commissioner Schultz said that the Community Relations Commission's purpose is to foster, encourage, and stimulate the improvement of relations among and between citizens of all races, creeds, national origins and economic and educational levels; and to provide all individuals with an equal opportunity to grow and participate to the best of their ability, in the economic, educational, social and cultural activities available in our community. The Commission sponsors the Adopt -A -Planter program and the community -wide garage sale, as well as quarterly photo contests. The Commission also assists the Village by distributing information at the Farmers' Market and acting as greeters for Village events, including the quarterly Neighborhood Outreach gatherings. b. Commissioner Schultz thanked all those who participated in the Winter Photo Contest, which had the theme "Doors of Morton Grove." She noted there were a number of entries from participants under age 18, which was refreshing to see. Vivian Gonzalez submitted the winning photo in the "under age 18" category. The photos needed to be of doors or entryways that depicted the "Doors of Morton Grove" theme. The adult winners of the Winter Photo Contest included: Laima Puzzo (with two winning photos), and Brian Kabat, whose photo was also selected as "Overall Winner." VIII. SPECIAL REPORTS (continued) {Minutes'of ApriCB, 2619 'Board Meeting c. Commissioner Schultz said the winning photos will be displayed at Village Hall and posted on the Village's Facebook page. d. Upcoming Photo Contest themes include "Working in Morton Grove" and "Playing in Morton Grove." These can include historical photos or current. Commissioner Schultz said that the Commission encourages creativity and new perspectives on its themes. Commissioner Downing invited the assemblage to come to the next Community Relations Commission meeting, which is tomorrow night at 6:30 p.m. in the second floor of Village Hall. She added that the Commission currently has 10 members, but is always looking for more! f. Mayor DiMaria thanked Commissioner Schultz for an excellent report, and said that the revamped Community Relations Commission is doing an excellent job! 2. Presentation Regarding Residential and Commercial Electric Supply by the Northern Illinois Municipal Electric Collaborative (NIMEC) e. Mayor DiMaria introduced David Hoover of NIMEC to make this presentation. a. Mr. Hoover said that NIMEC is basically a purchasing group working with 126 municipalities. Because they do about $20M of annual purchasing, they are usually able to get more aggressive pricing. Currently, they bid out the Village's street lighting program. NIMEC also works on Municipal Aggregation, negotiating power rates. They served the Village in this regard from 2012 through 2016, saving the average resident an annual amount of $235 in their electric bills. The program was very successful. Then ComEd changed its rate program, thus becoming less expensive, so many people switched back to ComEd. The company releases its residential rates every year—they're due to release them in the next few weeks. Mr. Hoover said that NIMEC will then test the market to see if they could negotiate a lower rate for its municipalities. They have a couple of new programs, he said. One program's primary driver is to help residents save money. Another program that municipalities may possible want to get into is 100% green power. People would pay the same rates and they do with ComEd, but with a guarantee of 100% green power. NIMEC will discuss these programs more fully with the Village Board once ComEd releases its annual residential electric rates and NIMEC has a chance to test the market in search of lower rates for electricity. b. Trustee Thill asked why ComEd was lowering its rates. Mr. Hoover explained that ComEd is no longer interested in purchasing and generating power. ComEd is strictly a delivery agent now. He said that there is actual a State agency which negotiates ComEd's price. About half of the municipalities NIMEC services have found an electrical rate lower than ComEd's. c. Trustee Thill asked if ComEd's "smart grid" had an impact on pricing. Mr. Hoover said, yes, that is part of its delivery system. ComEd is a monopoly for electricity delivery and the smart grid has, in fact, made the delivery system more stable. Mayor DiMaria thanked Mr. Hoover for his time. IX. PUBLIC HEARINGS NONE 2 X. XI. Minute;of fitit 8 2019 !Board;Meetirig RESIDENTS' COMMENTS (Agenda Items Only) NONE PRESIDENT'S REPORT 1. Mayor DiMaria proclaimed April 26, 2019, as "Arbor Day" in the Village. This is a day originally intended to be set aside specifically for the planting of trees. Mayor DiMaria noted that Morton Grove has the distinction of being a "Tree City USA," and pointed out the many benefits of trees and the many ways in which trees serve as a resource. He urged all citizens to support efforts to protect our trees and woodlands and to support the Village's urban forestry program. a. Trustee Thill asked Public Works Director Joe Dahm about the current tree program operating in conjunction with area schools. Mr. Dahm responded that Village Arborist David Hoffman has about 300 saplings that will be distributed to the participating schools for children to take home and plant. 2. Mayor DiMaria reminded the assemblage to sign up for "Smart 911." By doing so, residents are able to proactively provide information to facilitate a fast and accurate response. With Smart911, residents choose what information to include and what details are important to share with first responders. Interested residents can learn more and/or sign up at www.smart911.com. Mayor DiMaria said the Smart911 app is available on the Apple App Store or Google Play. He said that anyone with questions should call the MG Police Department at 847-470-5200. 3. Lastly, Mayor DiMaria noted that the Village will be holding an Electronics and Document Destruction Recycling Event on Saturday, May 18, 2019, from 9:00 a.m. to noon at the Morton Grove Civic Center, 6140 Dempster. More information, such as what will or will not be accepted at this event, can be found on the Village's website. XII. CLERK'S REPORT Clerk Harford had no report. XIII. STAFF REPORTS A. Village Administrator 1. Mr. Czerwinski presented fora first reading Resolution 19-02, Authorizing the Establishment of Interested Parties Registries and Adopting Rules For Such Registries for Redevelop- ment Project Areas in the Village of Morton Grove. He said that, in order to comply with the Tax Increment Allocation Redevelopment Act, an "Interested Parties" Registry needs to be established and Registry Rules need to be adopted for such a registry. This Ordinance creates the Village of Morton Grove's Interested Parties Registry for each individual redevelopment project created under the Act, whether now existing or created after the date of the adoption of this Ordinance. Mr. Czerwinski further explained that this will provide an opportunity for an individual or group of individuals to get involved. He noted that there was one correction on the Ordinance (an incorrect address for the Village) that will be fixed in time for the second reading. a. 3 XIII. STAFF REPORTS (continued) 'Minutes of Aprit 8, 2019 Board Meeting A. Village Administrator: (continued) b. Trustee Minx asked if "interested parties" who want to attend the annual TIF Meeting have to register, Mr. Czerwinski said they would, but taxing bodies would automatically be invited to the annual TIF Meeting; there is no need for taxing bodies to register. 2. Next, Mr. Czerwinski provided an update on the Morton Grove -Niles Water Commission Project. He said that River Drive reconstruction is on the way, along with other pavement repairs on the route of the transmission main. The South pumping station on Oakton has a new intake valve, while the North pumping station on National Avenue is having its intake valve refurbished. Construction on the Church Street Intermediate pumping station is progressing, with the pump scheduled to be delivered and installed in June. 3. Mr. Czerwinski announced that there would be a Special Meeting of the village Board on May 6, 2019, at 7:00 p.m. to provide an update on existing TIF redevelopment areas. The Board will also consider setting the date for a Public Hearing on the Sawmill Station redevelopment area. B. Corporation Counsel: Corporation Counsel Liston had no report. XIV. TRUSTEES' REPORTS A. Trustee Grear: Trustee Grear had no report this evening. B. Trustee Minx: 1. Trustee Minx presented Resolution 19-20, Authorizing the Execution of a Contract With Bill's Complete Landscape Service, Inc. For the 2019 Landscape Maintenance Program. She explained that this will authorize the execution of a contract for the annual landscape maintenance program, which is necessary to maintain landscaping on Village -owned properties and rights-of-way throughout the village. Trustee Minx said this contract was bid through a public process in accordance with the Village Code. Three sealed bids were received. Bill's Complete Landscape Service, Inc. submitted the second -lowest bid, but the Village's Municipal code specifies that the purchasing agent shall determine the lowest responsible bidder to be a local business whose price is within 5 percent or $15,000 (which is lower) of the lowest responsible bidder. The purchasing agent has determined that the lowest responsible local bidder is Bill's Complete Landscape Service, Inc. Their proposal amount is $5,452 Tess than the Engineer's Estimate of Cost. a. b. 4 XIV. B. Trustee Minx: (continued) c. Trustee Minx said the contract value is $30,000, but, since this is a unit price contract, the final contract amount will be based on the actual quantity of work performed. Mr. Czerwinski said it only covers specified areas. 2. Next, Trustee Minx presented Resolution 1921, Authorizing the Execution of a Contract With Precision Pavement Markings, Inc. For the 2019 Pavement Marking Program. She explained that the annual pavement marking program is necessary to maintain the visibility of the centerlines, stop bars, lane fines, and crosswalks on Village streets. Trustee Minx said that the Village's Public Works Department participated in a municipal partner- ing initiative in 2012 through 2018 to procure pavement marking services. The program has been administered once by the City of Highland Park and once by the Village of Morton Grove. The Illinois Governmental Joint Purchasing Act and Morton Grove's Municipal Code allows this cooperative procurement program. The renewable periods of the pavement marking contract have expired and the work for pavement marking services needs to be bid again. This year, the Village of Wilmette agreed to lead the administration of the bidding process for a group of municipalities consisting of Bannockburn, Evanston, Glencoe, Glenview, Highland Park, Lake Zurich, Lincolnshire, Morton Grove, North Chicago, Palatine, and Wheeling. The contract was advertised and sealed bids received. The low bidder is Precision Pavement Markings, Inc. The contract is for one year but can be renewed twice. Morton Grove's portion of the cost for the jointly bid work is estimated to be $30,152. The budgeted amount is $30,000. Trustee Minx pointed out that, since this is a unit price contract, the final contract amount will be based on the actual quantity of work performed. Witko Trustee Minx then presented Resolution 19-23, Authorizing Alternate No. 6 to Relocate and Install a New Reservoir Control Valve at the South Pumping Station as Part of Contract No. 12 of the Morton Grove -Niles Water Transmission Main and Facility improvement Project. 5 XIV. She explained that the Morton Grove -Niles Water Commission (MGNWC) opened bids under Contract No. 12 for the Reservoir Control Valve Replacement at both the Village of Morton Grove and the Village of Niles Pumping Station Reservoirs. The firm of Gaskill and Walton Construction was awarded the contract based upon their low base bid and alternate bid amounts. Six alternate bids exist for work on the reservoirs in both Morton Grove and Niles. The Morton Grove Pumping Station Operations found it necessary to move forward with Alternate No. 6 for installation and lowering of the new control valve to the basement floor of the MG South Pumping Station for safer installation and improved access for future maintenance. b. Mr. Czerwinski said it was being paid for by the Village via an Enterprise Fund, because it's after the meter, so it is the Village's responsibility. He noted that the current valve is in a precarious position on a gangway. This was bid as part of other work for the MGNWC, which helped control the pricing. Lastly, Trustee Minx brought forward for a first reading Ordinance 19-01, Approving an Amendment to a Special Use Permit for a School -Commercial Tutoring/Learning Center (For Children From Pre -School Through High School) at 8145 River Drive, Morton Grove. She explained that, in May of 2017, the Board had approved a special use for a school - commercial tutoring/ learning center for By Your Side Autism Therapy Service, LLC (the Applicant). The existing space occupies 8,191 square feet of the 73,897 square foot building. The Applicant is seeking approval of an amendment to their special use permit to expand and modify the approved floor plan to relocate and expand their administrative space and reconfigure and expand the area dedicated to therapy. The proposed expansion would increase their tenant space 3,660 square feet, for a total of 11,851 square feet. The approved special use permit allowed a maximum of 25 students and 30 staff members at any one time. The learning center currently operates with 10-12 children and 13-18 staff on site. The Applicant is proposing to expand the floor area while maintaining the caps on students and staffing as specified in the approved special use permit. The Applicant is aware that if they wish to exceed those student and staffing levels, they would need to file the proper application and supporting documents to seek approval of another amendment to their special use prior to scheduling or implementing such increases. Trustee Minx said the application was reviewed by the Chairperson of the Traffic Safety Commission, who determined the proposal would have an insignificant negative impact and waived a full TSC review. No changes to the exterior of the building are proposed, so review by the Appearance Commission was not required. The Plan Commission held a public hearing on the proposal on March 18, and ultimately voted 7-0 to recommend approval of the application, with conditions. 6 XIV, TRUSTEES' REPORTS (continued) Minutes of April 8, 2019 Board Meeting B. Trustee Travis noted that Commissioner Schultz had done a wonderful job of presenting the Community Relations Commission's Winter Photo Contest winners earlier this evening. 2. Trustee Travis encouraged everyone to attend the next Community Artists Performance, which will be held on Saturday, April 13, from 4:00 p.m. to 5:00 p.m. at the Civic Center. This is free to the public. 7 XIV. TRUSTEES' REPORTS (continued) F. Trustee Witko: 1. a. b. Minutes' of April 8, 2019 Board Meeting. Trustee Witko presented Resolution 19-22, Authorizing the Purchase of Police Pursuit Vehicles Through the Suburban Purchasing Cooperative Bid Program. She explained that, every three years, high mileage squad vehicles are replaced to insure key equipment being utilized by MG police officers does not fail during their duties as public safety first responders. The squad vehicles are utilized 24 -hours -a -day and need to be in excellent condition at all times. Trustee Witko said the cost for three police vehicles (one 2020 Ford Utility Police interceptor and two 2019 Dodge Chargers) is $84,082. (the "Act"), and is now considering designating an additional redevelopment project area (or areas) pursuant to the provisions of the Act; and WHEREAS, pursuant to Section 11-74.4-4.2 of the Act, the Village is required to establish certain interested parties' registries (individually, a "Registry" and collectively, the "Registries") and adopt registration rules for such Registries; and WHEREAS, the Village President (the "President") and Board of Trustees of the Village (the "Village Board" and together with the President, the "Corporate Authorities") desire to adopt this Ordinance in order to comply with such requirements of the Act; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE, COUNTY OF COOK, STATE OF ILLINOIS, AS FOLLOWS: SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses into this Ordinance as though fully set forth therein thereby making the findings as hereinabove set forth. SECTION 5: All ordinances, resolutions, motions or orders in conflict with this Ordinance are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be in full force and effect from and after its passage and approval, as provided by law. If any provision of this Ordinance is held to be invalid by a court of competent jurisdiction that provision shall be stricken from this Ordinance and the remainder of this Ordinance shall continue in full force and effect to the extent possible. As used in these Registration Rules, the following terms shall have the definitions set forth below. "Act" shall mean the Tax Increment Allocation Redevelopment Act, 65 ILCS 5111-74.4-1 et seq., as amended from time -to -time. "Clerk" shall mean the Clerk of the Village. "Interested Party(ies)" shall mean any individual or organization or entity registered in a specific Registry who has registered in such Registry and whose registration has not been terminated in accordance with these Registration Rules. "Redevelopment Project Area" shall mean a Redevelopment Project Area that (a) is intended to qualify (or has subsequently qualified) as a "Redevelopment Project Area" under the Act and (b) is subject to the "Interested Parties" Registry requirements of the Act. "Registration Form" shall mean the form appended to these Registration Rules or such revised form as may be approved by the Village consistent with the requirements of the Act. "Registry" or "Registries" shall mean each Interested Parties Registry, and all such Registries, collectively, established by the Village pursuant to Section 11-74.4-4.2 of the Act for any and all Redevelopment Project Areas in the Village. "Village" shall mean Village of Morton Grove, Cook County, Illinois. B. Establishment of Registry. The Village shall establish a separate Interested Parties Registry for each Redevelopment Project Area, whether existing as of the date of the adoption of these Rules or hereafter established. The Village shall establish a new Registry whenever it has identified an area for study and possible designation as a Redevelopment Project Area. In any event the process of establishing the new Registry must be completed prior to the deadline for sending any of the notices required by Section (J) of these Rules or any other notices required by the Act with respect to the proposed Redevelopment Project Area. C. Maintenance of Registry. The Registries shall be maintained by the Clerk or his or her designee. In the event the Village determines an individual other than the Clerk should maintain the Registries, the Village may transfer the responsibility for maintaining the Registries to such other Department provided the Village (i) gives prior written notice to all Interested Parties not less than thirty (30) days prior to such transfer and (ii) published notice of such transfer in a newspaper of general circulation in the Village. D. Registration by Residents. An individual seeking to register as an Interested Person with respect to a Redevelopment Project Area must complete and submit a Registration Form to the Clerk. E. Registration by Organizations. An organization seeking to register as an Interested Person with respect to a Redevelopment Project Area must complete and submit a Registration Form to the Clerk. F. Determination of Eligibility. All individuals and organizations whose Registration Forms and supporting documentation complies with these Registration Rules shall be registered in the applicable Registry within ten (10) business days after the Clerk's receipt of all such documents. The Clerk shall provide written notice to the registrant confirming such registration. Upon registration Interested Parties shall be entitled to receive all notices and documents required to be delivered under these Rules or as otherwise required under the Act with respect to the applicable Redevelopment Project Area. If the Clerk determines a registrant's Registration Form and/or supporting documentation is incomplete or does not comply with these Registration Rules, the Clerk shall give written notice to the registrant specifying the defect(s) and the registrant shall be entitled to correct any defects and resubmit a new Registration Form and supporting documentation. G. Renewal and Termination. An Interested Person's registration shall remain effective for a period of three (3) years. At any time after such three-year period the Clerk may provide written notice by regular mail to the Interested Person stating that such registration shall terminate unless the Interested Person renews such registration with thirty (30) days after the Clerk's mailing of written notice. To renew such registration, the Interested Person shall, within such thirty (30) day period, complete and submit the same Registration Form then required of initial registrants operations in the Village. The registration of all individuals and organizations whose Registration Form is submitted in a timely manner and complies with these Regulation Rules shall be renewed for an additional, consecutive three (3) year period. If the Clerk determines that a registrant's renewal Registration Form is incomplete or does not comply with these Registration Rules, the Clerk shall give written notice to the registrant at the address specified in the renewal Registration Form submitted by such registrant, specifying the defect(s). The registrant shall be entitled to correct any defects and resubmit a new Registration Form within thirty (30) days after receipt of the Clerk's notice. If all defects are not corrected within thirty (30) days after the Interested Person's receipt of the Clerk's notice, the Interested Person's registration shall be terminated. Any Interested Person whose registration is terminated shall be entitled to register again as if a first-time registrant. H. Amendment to Registration. An Interested Party may amend its registration by giving written notice to the Clerk by certified mail of any of the following: (i) change in address for notice purposes: (ii) in the case of organizations, a change in the name of the contact person; and (iii) a termination of registration. Upon receipt of such notice, the Clerk shall revise the applicable Registry accordingly. Registries Available for Public Inspection. Each Registry shall be available for public inspection during normal business hours. The Registry shall include the name, address and telephone number of each Interested Person and for organizations, the name and phone number of a designated contact person. ]. Interested Parties shall be sent the following notices and any other notices required under the Act with respect to the applicable Redevelopment Project Area: (i) Pursuant to subsection 11-74.4-5(a) of the Act, notice of the availability of a proposed redevelopment plan and eligibility report, including how to obtain this information; such notice shall be sent by mail within a reasonable period of time after the adoption of the ordinance fixing the public hearing for the proposed redevelopment plan; (ii) Pursuant to subsection 11-74.4-5(a) of the Act, notice of changes to proposed redevelopment plans that do not (1) add additional parcels of property to the proposed Redevelopment Project Area, (2) substantially affect the general land uses proposed in the redevelopment plan, (3) substantially change the nature of or extend the life of the redevelopment project, or (4) increase the number of inhabited residential units to be displaced from the Redevelopment Project Area, as measured from the time of creation of the Redevelopment Project Area, to a total of more than 10; shall be sent by mail not later than ten (10) days following the Village's adoption by ordinance of such changes; (iii) Pursuant to Section 11-74.4-5(c) of the Act, notice of amendments to previously approved redevelopment plans that do not (1) add additional parcels of property to the redevelopment project area, (2) substantially affect the general land uses in the redevelopment plan, (3) substantially change the nature of the redevelopment project, (4) increase the total estimated redevelopment project costs set out in the redevelopment plan by more than five percent (5%) after adjustment for inflation from the date the plan was adopted, (5) add additional redevelopment project costs to the itemized list of redevelopment project costs set out in the redevelopment plan, or (6) increase the number of inhabited residential units to be displaced from the redevelopment project area, as measured from the time of creation of the redevelopment project, to a total of more than ten (10); will be sent by mail not later than ten (10) days following the Village's adoption by ordinance of such amendment; (iv) Pursuant to subsection 11-74.4-5(d)(9) of the Act, for redevelopment plans or projects that would result in the displacement of residents from ten (10) or more inhabited residential units or that contain seventy-five (75) or more inhabited residential units, notice of the availability of the annual report described by subsection 74.4-5(d) of the Act, including how to obtain the annual report; shall be sent by mail within a reasonable period of time after completion of the certified audit report; and (v) Pursuant to subsection 11-74.4-6(e) of the Act, notice of the preliminary public meeting required under the Act for a proposed Redevelopment Project Area that will result in the displacement of residents from ten (10) or more inhabited residential units or which will contain seventy-five (75) or more inhabited residential units; shall be sent by certified mail not less than fifteen (15) days before the date of such preliminary public meeting. K. Non -Interference.
