HomeMy WebLinkAbout2018-10-08 MinutesMINUTES OF A REGULAR MEETING OF THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE COOK COUNTY, ILLINOIS, HELD AT THE RICHARD T. FLICKINGER MUNICIPAL CENTER OCTOBER 8, 2018 CALL TO ORDER I — Village President Dan DiMaria convened the Regular Meeting of the Village Board at V. 7:00 p.m. in the Council Chambers of Village Hall and led the assemblage in the Pledge of Allegiance. VI. Deputy Clerk Susan Lattanzi called the roll. Present were: Trustees Bill Grear, Rita Minx, Ed Ramos, John Thill, Connie Travis, and Janine Witko. Clerk Eileen Harford was absent with notice. VII. APPROVAL OF MINUTES Trustee Minx moved to accept the Minutes of the Board Meeting of September 24, 2018 as submitted, seconded by Trustee Ramos. Motion passed unanimously via voice vote. VIII. SPECIAL REPORTS 1. Plan Commission Case PC18-11, Requesting a Text Amendment to Modify Certain use Classifications in the Commercial Districts of the Village. a. Community and Economic Development Director Nancy Radzevich presented this report to the Board. She said the Village Board had amended the Unified Development Code in 2017 to modify the "Medical and dental office/clinics" use in the commercial districts. Previously, all "Medical and dental offices/clinics" had required a special use permit in all commercial districts. The 2017 amendment provided for an administrative review process for lower intensity medical/ dental uses, while higher intensity medical/dental uses and/or situated in commercial areas with limited parking capacity would still require a special use permit. Since the adoption of the amendment, Village staff has determined that the process provides flexibility to approve appropriate proposals administratively, while not violating the intent or the spirit of the Unified Development Code, by ensuring that higher -intensity uses continue to be directed through the special use process. b. Ms. Radzevich said that, based on the success of the 2017 text amendment, and in response to inquiries from specific businesses seeking to locate in the Village, staff is now proposing to expand this administrative review option to similar types of allowed uses in the commercial districts that could have varying intensities, based on their particular business model and/or based on the characteristics of the specific locations where they may want to locate (i.e., parking, size, access, setbacks, etc.). Minutes of October 8, 2018 Board Meeting VIII. c. SPECIAL REPORTS (continued) Staff is also proposing to modify the language of the administrative review footnote. This language was developed in consultation with the Village's Corporation Counsel to provide the Village Administrator more discretion in the types of information and supporting documents (beyond just a parking and traffic analysis) which might be requested to evaluate the potential impacts of the specific proposed business use. Staff is also proposing to clean up some of the notations for consistency purposes (i.e., uses that are listed as "P/S" versus "P" or "S") and cleaning up a simple outlier of "Bridal Shops," which is currently listed as requiring a special use permit, when it is essentially a specialized retail clothing use. d. Ms. Radzevich said the Plan Commission's Public Hearing on this case was held on September 17. At the hearing, several commissioners asked questions, which were satisfactorily answered by the Village's Zoning Administrator/Land use Planner, Dominick Argumedo. No members of the public were present wishing to be heard. The Plan Commission voted unanimously, with one member absent, to recommend approval of PC 18-11. IX. PUBLIC HEARINGS NONE X. RESIDENTS' COMMENTS (Agenda Items Only) NONE XI. PRESIDENT'S REPORT 1. Mayor DiMaria proclaimed the week of October 7-13, 2018 as "Fire Prevention Week" in the Village. He noted that 4 out of 5 U.S. fire deaths occur at home each year; and urged the people of Morton Grove to be aware of their surroundings, to have required working smoke alarms, to immediately exit when the smoke alarm sounds, and to support the many public safety activities and efforts of Morton Grove's fire and emergency services during Fire Prevention Week. Mayor DiMaria reminded the assemblage that the next Neighborhood Outreach is scheduled for Thursday, October 18, at National Park, 9325 Marion. Everyone should have received a reminder postcard mailed to their home. He said the Neighborhood Outreach events are a great place to gather valuable information about what's going on in town, to get questions answered, and to meet neighbors, Village staff, and elected officials. It's also an opportunity for residents to let the Board know what's not working. He urged everyone to attend. Mayor DiMaria said he was delighted to announce that, on October 1, 2018, Golf School District 67 announced that Hynes Elementary School has been designated as a 2018 National Blue Ribbon School by the U.S. Department of Education. The recognition is based on a school's overall academic performance or progress in closing achievement gaps among student subgroups. Only 11 schools in the Chicago suburban area received this distinction. The Mayor congratulated District 67 on this wonderful achievement. 2 Minutes of October 8, 2018 Board Meeting XII. XIII. CLERK'S REPORT In the absence of Clerk Harford, Deputy Clerk Lattanzi had no report. STAFF REPORTS A. Village Administrator: 1. Mr. Czerwinski brought up a concern occurring around Oakton and Austin regarding Lin -Mar. He said the Village is aware of the interactions between the residential and commercial neighborhoods, and the business has been made aware. He said the Village reminded Lin -Mar that they neighbor a residential area. The Village is monitoring the situation and will issue citations if necessary, but Lin -Mar has always been in a good neighbor in the past, and the Village is hopeful that they'll address the situation. 2. Mr. Czerwinski said the Morton Grove Exchange has gone out with a new look, and he thanked Jake, the newest member of the administration department. 3. Regarding the water project, Mr. Czerwinski said it's progressing well, and there are aerial pictures of the new water tank on the project's website. He reminded everyone that no property tax revenue is being used for this $100M project. The goal is to see savings starting the very first year and every year thereafter. Rates will be more stable than they were when the City of Chicago was the Village's water supplier. The savings will be put back into the Village's aging infrastructure. B. Corporation Counsel: Corporation Counsel Liston had no report this evening. XIV. TRUSTEES' REPORTS A. Trustee Grear: Trustee Grear had no report this evening. B. Trustee Minx: 1. Trustee Minx presented Resolution 18-54, Authorizing the Sale of Surplus Personal Property Owned by the Village of Morton Grove. She explained that the Public Works Department annually reviews vehicles and equipment conditions for all Village departments. After a review by the department, some of the equipment is determined to be no longer useful for a variety of reasons, some being (but not limited to): the cost of maintenance, scheduled for replacement, outdated, or no longer used by Village departments. a. 3 Minutes of October 8, 2018 Board Meeting XIV. TRUSTEES' REPORTS (continued) B. Trustee Minx: b. Trustee Minx said that, by ordinance, the Village is allowed to sell surplus motor vehicles pursuant to a Resolution approved by simple majority of the Village Board. At this time, the Public Works Department is requesting three (3) vehicles be deemed surplus property and sold at auction. Trustee Minx moved to approve Resolution 18-54, seconded by Trustee Grear. Next, Trustee Minx presented Resolution 18-55, Authorizing the Execution of a Contract With Windy City Lighting to Replace the Existing Public Works Lighting with Energy Efficient LED (Light Emitting Diode) Lighting. a. She explained that the Village has an opportunity to take advantage of ComEd's Energy Efficiency Program to make lighting upgrades at the Public Works facility, and as a result, provide energy savings to the Village. Windy City Lighting has performed a small facilities inspection at the Public Works facility and, in conjunction with ComEd, an energy audit. As such, it was determined that the facility qualifies for the ComEd energy efficiency program. b. The initial cost is $26,678.35; however, the Village will only be responsible for paying $1,886.70 of this project. The replacement of the lighting fixtures will be performed by Public Works staff and the installation of the new individual fluorescent bulbs will be performed by the Building Maintenance staff. Trustee Minx moved, seconded by Trustee Witko, to approve Resolution 18-55. c. Lastly, Trustee Minx introduced Ordinance 18-15, Approving a Text Amendment to Modify Certain Use Classifications in the Commercial Districts of the Village of Morton Grove Municipal Code. Trustee Minx said that this Ordinance is pursuant to Plan Commission Case PC18-11, reported on earlier this evening by Community and Economic Development Director Nancy Radzevich. As this is a first reading, no action will be taken this evening. 4 Minutes of October 8, 2018 Board Meeting C. TRUSTEES' REPORTS (continued) Trustee Ramos: Trustee Ramos had no report this evening. D. Trustee Thill: Trustee Thill had no report this evening. E. Trustee Travis: 1. Trustee Travis announced that the 5th Morton Grove Community Artists Performance will take place on Sunday, October 21, at 4:00 p.m. at the Civic Center. Admission is free and doors open at 3:45 p.m. 2. Trustee Travis also encouraged all photographers to enter the Village's Fall photo contest, sponsored by the Community Relations Commission. Photos must showcase the Village's tagline: "Incredibly Close. Amazingly Open." Photos must be submitted by December 1, 2018, and winning photos will be featured on the Village's Facebook page and website, and 5 winning photos will be enlarged, framed, and displayed at Village Hall. F. Trustee Witko: Trustee Witko noted that the Village is seeking qualified and responsible candidates for the position of School Crossing Guard for Parkview School. This is a seasonal part-time position with no benefits. Salary is $13.69 per hour, 10 hours a week, Monday through Friday (except school holidays). Applicants must be at least 18 years old, have a valid driver's license, and pass a background investigation. Applications and job requirements are available online or at the Morton Grove Police Department, located at 6101 Capulina Avenue. Trustee Witko also encouraged everyone to attend and support the final two weeks of the Morton Grove Farmers' Market. October 20 will be the last Market, until the Winter Market on December 1, 2018. Hours are 8:00 a.m, to 1:00 p.m. at the Civic Center. XV. OTHER BUSINESS NONE 5 Minutes of October 8, 2018 Board Meeting XVI. XVII. 1. WARRANTS Trustee Travis presented the Warrant Register for October 8, 2018 in the amount of $52,030.82. She moved that the Warrants be approved as presented. Trustee Thill seconded the motion and announced he was going to frame this Warrant Register because it's so low! Motion passed: 6 ayes, 0 nays. Tr. Grear Tr. Minx Tr. Ramos aye Tr. ThiII Tr. Witko a}L RESIDENTS' COMMENTS Violeta Dibong, a 37 -year resident, said she chose to live in Morton Grove because of the quality of its schools and because it was an area where a person could live and raise their kids in peace. She said that, since Lin -Mar has moved to its current location, there's noise, fumes, and trucks operating at all hours of the day and night. She said she was under the impression that Lin -Mar was required to have high fencing and take noise abatement measures, but that is not the reality. She said that she complained to the Village Administrator in 2017, as well as the MGPD, but nothing has changed. 2. Edward Dichow, a retired professor who moved from Chicago to Morton Grove because of its rep- utation, said there is definitely a problem with noise from Lin -Mar's operations. Pollution is also a health hazard; he can't even take walks anymore. There are traffic jams, especially when big rigs are trying to access Lin -Mar completely block Oakton—all the way down to the highway. Mr. Dichow said the place is an eyesore and the fumes are so bad, he feels that it's a violation of the Illinois Environmental Protection Agency's limits. He said the Board must do something. His next step will be to present these problems at a joint meeting between the IEPA and the Village Board. 3. 4. Mayor DiMaria said, "The Board and I hear you loud and clear." He assured them that the Village Administrator is staying on top of this matter. He thanked the residents for coming out and said "We will get a remedy—this is not falling on deaf ears." Rudolph Vilk said the Mayor hasn't made a decision in ten months about what was a simple prob- lem. He said he received a letter from the Village Administrator, but it had no resolution, and no questions that Mr. Vilk could answer to clarify things. Mr. Vilk said that if a person is caught robbing you, they're supposed to go to jail, but he's had a problem for ten months and there has been no decision and no solution. He said he is still waiting for an answer. XVIII. ADJOURNMENT There being no further business before the Board, Trustee Minx moved to adjourn the meeting, seconded by Trustee Thill.
