SEPTEMBER 10, 2018
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Village President Daniel P. DiMaria called the meeting to order at 7:OOpm in the Richard T.
Flickinger Municipal Center Council Chambers. After leading the assemblage in the Pledge of
Allegiance, he directed the Clerk to call the roll.
ROLL CALL
Village Clerk Scanlon Harford called the roll. Present were: Trustees Bill Grear, Rita Minx, Ed
Ramos, John Thill, Connie Travis, and Janine Witko.
III. APPROVAL OF MINUTES
Regarding the Minutes of the August 27, 2018, Regular Board Meeting, Trustee Thill moved,
seconded by Trustee Witko, to accept the minutes as presented. There being no questions or
concerns, a motion to approve the minutes passed unanimously via a voice vote.
IV. SPECIAL REPORTS
The Announcement of the Summer Photo Contest Winners was made by Community Rela-
tions Commissioner Jenna Downing. She stated, the Community Relations Commission's
purpose is to foster, encourage, and stimulate relations among and between all citizens which
includes race, creed, national origin. This in turn gives individuals an equal opportunity to grow
and participate in the economic, educational, social and cultural activities available within Mor-
ton Grove. The Community Relations Commission promotes a number of programs including
the Adopt -A -Planter Program, the Community Wide Garage Sale, the Community Artists Per-
formances, and these quarterly Photo Contests. The Commission also participates in the Mor-
ton Grove Farmers' Market each Saturday by distributing various pieces of relevant infor-
mation about the Village, as well as acts as greeters for the Village's quarterly Neighborhood
Outreach Events. The Commission also recently sponsored the installation of a Free Little Li-
brary which is in front of Village Hall.
Commissioner Jenna Downing went on to state the winning photos each represent the Vil-
lage's tag line of Incredibly Close. Amazingly Open. She thanked those residents who submit-
ted entries and announced the winners. The five winning photos were submitted by: Zainab
Ahmed, Solomiya Plugator, Young Sam Park, and Megan Keating. The overall winner was
submitted by Boyle Wong. All present stood up and had their picture taken with Mayor Di -
Maria and Trustee Travis (the Community Relations Commission Liaison).
As has been done in the past, the winning photos will be displayed at Village Hall and will be
posted on the Village's Facebook page. Commissioner Downing encouraged all residents to
submit photos for the fall contest which will run through December 1. She reminded everyone
up to five photos may be submitted to the Commission at crc(c�mortongroveil.orq, dropped off,
or mailed to Village Hall. Those winning photos will be announced at the December 10 Village

Ms. Downing then stated the Community Relations Commission currently has 11 members;
however they are always looking for new members. Their next meeting will be held on Tues-
day, September 11 at 6:30pm right here at Village Hall. She stated this is a great time to at-
tend a meeting since discussions will be taking place for the 2019 program year.
Mayor DiMaria then thanked all the Photo Contest Winners who participated and attended this
evening's meeting.

PRESIDENT'S REPORT
a. Mayor DiMaria announced he had great news this evening. The Prairie View Plaza has
been acquired by Kensington Development PartnersllM Properties. This Oak Brook
based development group has completed their acquisition of the Prairie View Shopping
Center with plans to work with the Village toward a complete and comprehensive rede-
velopment of the 26 -acre property. He went on to state this is a well-positioned site in a
demographically rich market that has a great potential for success. The Village's goal,
with the support of this new development group, is to create a vibrant and sustainable
development which can be the center of activity for our fine community. He will keep
everyone apprised as more details develop and plans are refined for this exciting devel-
opment. Mayor DiMaria then thanked the Village Board and staff for their professional-
ism and a job well done.
b. The Mayor announced the Morton Grove Library's upcoming 80th Anniversary Celebra-
tion on the Front Porch Concert which will be held this coming Saturday, September 15
from 1:30pm to 3:30pm. The concert will feature the Tinker Boys who will bring their
unique style of folk, bluegrass, and country to the stage, Games and free ice cream will
also be available.

1X. STAFF REPORTS
a. Village Administrator
1) Mr. Czerwinski presented for a first reading Ordinance 18-14 Amending Title
4, Chapter 6 of the Municipal Code to Add a New Article K Entitled Charita-
ble Raffles and Poker Runs. The Illinois Raffles and Poker Runs Act requires
civic and charitable organizations to obtain a Village license in order to conduct
raffles or poker runs. This ordinance, if approved, will provide for the licensing
and regulation of three classes of raffle licenses and two classes of poker runs

licenses. It should be noted, no fee or formal application will be required for a
Class A raffle license. All other licenses will require a formai application. A fidel-
ity bond will also be required for certain licenses. The fee for a Class B Raffle
and Class A Poker runs license will be $50.00. The fee for Class C Raffle and
Class B Poker Runs license will be $100.00. Restrictions regarding the licenses
will also be set. Since this is a first reading, no action was taken this evening.
2) Mr. Czerwinski stated September is Emergency Preparedness Month and as
part of this year's activities FEMA will be running wireless testing alerts on Sep-
tember 20 at 1:18pm. Additional information regarding this testing will be forth-
coming on the Village's website.
3) Mr. Czerwinski then went on to update everyone on the Water Main Project. He
stated the first panels are starting to go onto the 7 million gallon water tower. He
showed a brief video photographed by a drone showing several panels being
lifted into place. It will take some time to complete this water tower; however it
should last, once completed, for at least 100 years.
4) Mr. Czerwinski introduced the Village's new Management Analyst, Jake Law-
rence and welcomed his talents to the Village.

Corporation Counsel had no formal report.

Trustee Grear had no formal report but wanted to thank the MEC for again hosting their
annual golf outing yesterday. Both he and Mayor DiMaria had a great time.

1) Trustee Travis presented Resolution 18-47 Authorizing the Village to Update
Authorized Signatures on a Village Bank Account. With the transfer of own-
ership of the Prairie View Shopping Center an escrow account needed to be
opened relative to this sale. This resolution will authorize specific signatures on
this account.

Resident Nancy Lanning stated there had been a minor accident on Beckwith Road at Austin
Avenue. She called the police for assistance and had helped to direct traffic. She remarked
all was well.
Resident Rudolph Vilk wished everyone a Happy Jewish New Year. He then complained it
took, in his opinion, ten months to receive a written response from the Village to his questions
and concerns. He believes rules should be easy to follow and understand and not be so com-
plicated, it is only common sense. He is upset that he not only has to purchase a vehicle
sticker but pay for water he believes he does not use.
ADJOURNMENT/EXECUTIVE SESSION
There being no further business to come before the Board, Trustee Minx moved to adjourn the
meeting at 7:23pm. Trustee Thill seconded the motion which was unanimously approved via
voice vote.

To authorize and license raffles and poker runs games offered by civic and charitable organizations
within the Village.
The Illinois Raffles and Poker Runs Act (230 ILCS 15/0.01 et. seq.) requires organizations to obtain a
Village license in order to conduct raffles or poker runs. This ordinance will provide for the licensing
and regulation of three classes of raffle licenses and two classes of poker runs licenses:
o Class A Raffle License for raffles conducted by law enforcement agencies and qualified
organizations with a maximum single prize of $2,000 or total prizes of $10,000. Only four Class
A Raffle Licenses may be granted to a qualified organization during a calendar year;
a Class B Raffle License for raffles conducted by qualified organizations. A fidelity bond is
required if a single prize is over $2,000 or the aggregate of all prizes are over $10,000. The
maximum prize cannot exceed the amount of the fidelity bond;
o Class C Raffle License for weekly raffles conducted by qualified organizations. A fidelity bond is
required if a single prize is over $2,000 or the aggregate of all prizes are over $10,000. The
maximum prize cannot exceed the amount of the fidelity bond;
a Class A Poker Runs license for games conducted by qualified organizations where the maximum
prize of any winning hand or high score does not exceed $2,000 and total prizes do not exceed
$10,000, with only four (4) conducted per calendar year;
o Class B Poker Runs license for weekly games conducted by qualified organizations where the
maximum prize of any winning hand or high score does exceed $2,000 and total prizes do not
exceed $10,000, unless a fidelity bond is obtained;
No Fee or formal application is required for Class A raffle licenses. The fee for Class 13 Raffle and
Class A Poker Run licenses is $50.00. The fee for Class C Raffle and Class B Poker Run licenses is
$100.00. Licenses may not be issued to professional gamblers, convicted felons, or persons of poor
moral character.

AMENDING TITLE 4 CHAPTER 6 OF THE MUNICIPAL CODE
TO ADD A NEW ARTICLE K ENTITLED
CHARITABLE RAFFLES AND POKER RUNS
WHEREAS, the Village of Morton Grove (the "Village"), located in Cook County, Illinois
is a home rule unit of government under the provisions of Article 7 of the Constitution of the State
of Illinois, and can exercise any power and perform any function pertaining to its government
affairs, including but not limited to the power to tax and incur debt; and
WHEREAS, the Illinois Raffles and Poker Runs Act (230 ILCS 15/0.01 et. seq.) (the "Act")
has established minimum standards which municipalities must impose in connection with an
ordinance regulating raffles and poker runs; and
WHEREAS, a municipality may regulate raffles and poker runs within its corporate
boundaries pursuant to the Act; and
WHEREAS, adoption of this ordinance to regulate raffles and poker runs within the Village
will promote the health, safety, and welfare of the residents of the Village.
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance as though fully set forth therein thereby making the findings as
hereinabove set forth.
SECTION 2: Title 4 (entitled "Business Regulations"), Chapter 6 (entitled "Regulations
Pertaining to Specific Businesses") of the Village of Morton Grove Municipal Code is hereby
amended to add a new Article K to be entitled "Charitable Raffles and Poker Runs" to read as

4-6K-1: DEFINITIONS: The following words, terms, and phrases, when used in this
Code shall have the meanings ascribed to them in this Section, except where the
context clearly indicates a different meaning:
THE ACT The Illinois Raffles and Poker Runs Act (230 ILCS 15/0.01 et. seq.).
A voluntary organization composed of individuals and businesses who
have joined together to advance the commercial, financial, industrial,
and civic interests of a community.
An organization or institution organized and operated to benefit an
indefinite number of the public. The service rendered to those eligible
for benefits must also confer some benefit on the public.
An organization or institution organized and operated to provide
systematic instruction in useful branches of learning by methods
common to schools and institutions of learning which compare favorably
in their scope and intensity with the course of study presented in tax -
supported schools.

The gross receipts from the conduct of any raffle or poker runs, less
reasonable sums expended for prizes, local license fees, and other
reasonable operating expenses incurred as a result of operating a raffle.

profit basis with no personal profit inuring to any one as a result of the
operati on.
An individual, firm, organization, public or private corporation,

A prize -awarding event organized by an organization licensed pursuant
to the requirements of this Code in which participants travel to multiple
predetermined locations, including a key location, to play a randomized
game based on an element of chance. "Poker runs" includes dice runs,
marble runs, or other events where the objective is to build the best hand
or highest score by obtaining an item or playing a randomized game at
each location.
A bona fide religious, charitable, labor, business, fraternal, educational
or veteran organization operating without profit to their members and
which have been in existence continuously for a period of five (5) years
immediately before making application for a raffle license and which has
had during that entire 5 -year period a bona fide membership engaged in
carrying out their objectives, or a nonprofit organization the Raffle and
Poker Runs Administrator (as defined below) determines is organized
for the sole purpose of providing financial assistance to an identified
individual or group of individuals suffering extreme financial hardship
as the result of an illness, disability, accident, or disaster,
A form of lottery, as defined in Section 28-2(b) of the Criminal Code of
2012(720 ILCS 5/28-2(b), conducted by an organization licensed
pursuant to the requirements of this Code, in which the player pays or
agrees to pay something of value for a chance represented and
differentiated by a number or by a combination of numbers or by some

other means, one or more of which chances is to be designated as a
winning chance; and the winning chance is to be determined through a
drawing or by some other method based on an element of chance by an
act or set of acts on the part of the persons conducting or connected with
the lottery, except the winning chance shall not be determined by the
outcome of the publicly exhibited sporting contest, but does not include
a savings promotion raffle authorized under Section 5g of the Illinois
Banking Act (205 ILCS 5/5g), Section 7008 of the Savings Bank Act
(205 ILCS 205/7008), Section 42.7 of the Illinois Credit Union Act (205
ILCS 305/42.7), Section 5136B of the National Bank Act (12 U.S.C.
25a), or Section 4 of the Home Owners' Loan Act (12 U.S.C. 1463).
The Village President of Morton Grove and/or his/her designee.
An event at which at least one (1) raffle is conducted by any person.
Any church, congregation, society, or organization founded for the
purpose of religious worship.
An organization or association comprised of members of whom
substantially all are individuals who are veterans or spouses, widows,
or widowers of veterans, the primary purpose of which is to promote
the welfare of its members and to aid the general public in such a way
as to confer a public benefit.
4-6K-2: LICENSE REQUIRED:
A. Except as provided herein, it shall be unlawful for any person to conduct or operate a raffle,
a raffle event, or a poker run in the Village of Morton Grove, or to sell, offer for sale,
convey, issue, or otherwise transfer for value, a chance on a raffle or poker runs unless
conducted pursuant to a license issued pursuant to and in accordance with the provisions of
this Code.
B. Raffles conducted by Political Committees licensed by the State Board of Elections pursuant
to 230 ILCS 15/8.1 are exempt from the requirements of this Article.

A. Class A Raffle License: A Class A raffle license shall permit
1. a law enforcement agency or a statewide association that represents law enforcement
officials to conduct raffles in the Village; or

2. a qualified organization to conduct a raffle event which may include multiple drawings
to award prizes, but all drawings must occur on the same day and at the same location
and within the confines of the same raffle event. The maximum retail value of any
single raffle prize cannot exceed $2,000 and the maximum aggregate retail value of all
raffle prizes for the raffle event cannot exceed $10,000. Raffle chances may only be
sold within the corporate limits of Morton Grove and the price charged for each raffle
chance issued or sold shall not exceed $100.00. Chances may not be issued or sold for
any period longer than 365 days. Only four (4) Class A raffle licenses may be granted to
a qualified organization during a calendar year.
B. Class B Raffle License: A Class B raffle license shall permit a qualified organization to
conduct a single raffle event which may include multiple drawings to award prizes, but all
drawings must occur on the same day and at the same location and within the confines of the
same raffle event. The maximum retail value of a single raffle prize and the aggregate retail
value of all prizes or merchandise awarded in a raffle event shall not exceed the amount of

C. Class C Raffle License: A Class C raffle license shall permit a qualified organization to
conduct up to fifty-two (52) raffle events during a calendar year. Raffle events shall occur
not more frequently than weekly and shall occur at specified Iocations within the Village of
Morton Grove. The maximum retail value of a single raffle prize and the aggregate retail
value of all prizes or merchandise awarded in a raffle event shall not exceed the amount of
the fidelity bond submitted with the application for a raffle license pursuant to 4-6K-9. if the
fidelity bond is waived, the maximum retail value of a single raffle prize may not exceed
$2,000 and the aggregate retail value of all prizes or merchandise awarded in a raffle event
shall not exceed $10,000. Raffle chances may only be sold within the corporate limits of
Morton Grove and the price charged for each raffle chance issued or sold shall not exceed
$100.00. Chances may not be issued or sold for any period longer than 365 days.
D. Class A Poker Runs License: A Class A poker runs license shall permit a qualified
organization to conduct a poker runs which may include multiple winning hands or high
scores, but all winning hands or high scores must occur on the same day and at the same
location and within the confines of the same poker runs at specified locations within the
Village of Morton Grove. The maximum retail value of a prize of any winning hand or high
score cannot exceed $2,000 and the maximum aggregate retail value of all poker runs prizes
for the poker runs cannot exceed $10,000. Only four (4) Class A poker runs licenses may be
granted to a qualified organization during a calendar year.
E. Class B Poker Runs License: A Class B poker runs license shall permit a qualified
organization to conduct up to fifty- two (52) poker runs during a calendar year. Poker runs
shall occur not more frequently than weekly and at specified locations within the Village of

Morton Grove. The maximum retail value of a prize of any winning hand or high score
cannot exceed $2,000 and the maximum aggregate retail value of all poker runs prizes for

4-6K-4: LICENSE INELIGIBILITY:
A. The following persons and organizations are ineligible and shall not be issued a raffle or
poker runs license:
1. Any person who has been convicted of a felony, subject to Paragraph C below;
2. Any person who is or has been a professional gambler or gambling promoter;
3. Any person who is not of good moral character;
4. Any person who has been found to have violated the Act or any provision of this
Chapter within the past five (5) years.
5. Any organization in which a person defined in subsection (1), (2), (3) or (4) of this
section has a proprietary, equitable, or credit interest or in which such person is
active or employed;
6. Any organization in which a person defined in subsection (1), (2), (3) or (4) of this
section is an officer, director, or employee, whether compensated or not; and
7. Any organization in which a person defined in subsection (1), (2), (3) or (4) of this
section is to participate in the management or operation of a raffle as defined in this
section,
B. If a person was convicted of a felony, the applicant shall provide a list of such person's
complete criminal history except for:
1. Juvenile adjudications of delinquent minors as defined in Section 5-105 of the
Juvenile Court Act of 1987, subject to the restrictions set forth in Section 5-130 of
the Juvenile Court Act of 1987.
2. Law enforcement records, court records, and conviction records of an individual who
was seventeen (17) years old at the time of the offense and before January 1, 2014,
unless the nature of the offense required the individual to be tried as an adult.
3. Records of arrest not followed by a conviction.
4. Convictions overturned by a higher court.
5. Convictions or arrests that have been sealed or expunged.
C. The Raffle and Poker Runs Administrator may grant the license based on evidence of
rehabilitation and mitigating factors submitted by the applicant, including any of the
following factors and evidence to determine if the conviction will impair the ability of the
applicant to engage in the position for which a license is sought:
1. The lack of direct relation of the offense for which the applicant was previously
convicted to the duties, functions, and responsibilities of the position for which a
license is sought;

2. Whether five (5) years since a felony conviction or three (3) years since release from
confinement for the conviction, whichever is later, have passed without a subsequent
conviction;
3, If the applicant was previously licensed or employed in the state of Illinois or other
states or jurisdictions, then the lack of prior misconduct arising from or related to the
licensed position or position of employment;
4. The age of the person at the time of the criminal offense;
5. Successful completion of sentence and, for applicants serving a term of parole or
probation, a progress report provided by the applicant's probation or parole officer
that documents the applicant's compliance with conditions of supervision;
6. Evidence of the applicant's present fitness and professional character;
7. Evidence of rehabilitation or rehabilitative effort during or after incarceration, or
during or after a term of supervision, including, but not limited to, a certificate of
good conduct under Section 5-5.5-25 of the Unified Code of Corrections or a
certificate of relief from disabilities under Section 5-5.5-10 of the Unified Code of
Corrections; and
8. Any other mitigating factors contributing to the person's potential and current ability
to perform the duties and responsibilities of the position for which a license or
employment is sought.
4-6K-5: RAFFLE AND POKER RUNS APPLICATIONS:
A. Any qualified organization seeking to obtain a Class A raffle license, or a Class A poker
runs license need not file an application with the Village, and such license shall be deemed.
automatically granted provided the qualified organization is not deemed ineligible for a
license pursuant to 4-6K-4. However, a Class A raffle license or Class A poker runs license
holder shall comply with all other regulations and requirements of the Act and this Chapter,
and shall, upon request of the Raffle and Poker Runs Administrator, provide all records and
information to verify it is a qualified organization and has and will conduct al] raffles or
poker runs in the Village in full compliance with the Act and this Chapter.
B. Any person seeking to obtain a Class B or Class C raffle license, or a Class A or Class B
poker runs license shall file and obtain an application with the Village's Raffle and Poker
Runs Administrator on forms provided by the Village. The application shall be signed by the
presiding officer, secretary, and raffle manager of the applicant and shall include the
following documents and information:
1. The name, address, and type of organization;
2. The length of existence of the organization and, if incorporated, the date and state of
incorporation;
3. The name, address, telephone number, and date of birth of the organization's
presiding officer, secretary, raffles or poker runs manager, and any other members
responsible for the conduct and operation of the raffle or poker runs;
4. The aggregate retail value of all prizes to be awarded in the raffle or poker runs;
5. A list of prizes and the retail of each prize to be awarded in the raffle(s) or poker
run(s);

at a minimum:
1. The number of applicants for a new or renewal license under this Code within the
previous calendar year;
2. The number of applicants for a new or renewal license under this Code within the
previous calendar year who had any criminal conviction(s);
3. The number of applicants for a new or renewal license under this Code in the
previous calendar year who were granted a license;
4. The number of applicants for a new or renewal license with a criminal conviction
who were granted a license under this Code within the previous calendar year;
5. The number of applicants for a new or renewal license under this Code within the
previous calendar year who were denied a license; and
6. The number of applicants for a new or renewal license with a criminal conviction
who were denied a license under this Code in the previous calendar year in whole or
in part because of a prior conviction.
E. A Class B raffle license and a Class A poker runs license shall be valid for a single event
which shall occur within sixty (60) days from and after its issuance. A Class C raffle license
and a Class B poker runs license shall be valid for the calendar year for which it is issued.
F Class B and C raffle licenses and Class A and B poker runs licenses shall be prominently
displayed at the raffle event.
G. A license may be suspended or revoked by the Raffle and Poker Runs Administrator for any
violation of this Code.
4-6K-7: LICENSING FEE:
A. No license fee is required for a Class A raffle license.
B. A license fee of $50.00 payable to the "Village of Morton Grove" shall be paid upon
submission of a Class B raffle license or a Class A poker runs license application.
C. A license fee of $100.00 payable to the "Village of Morton Grove" shall be paid upon
submission of a Class C raffle license or a Class 13 poker runs license application.
D. When application for a raffle or poker runs license is filed, such application fee is
nonrefundable, even if the application is denied or in the event the raffle is cancelled for any
reason.
4-6K-8: CONDUCT OF RAFFLES AND POKER RUNS:
A. The operation and conduct of raffles and poker runs are subject to the following restrictions:

1. The entire net proceeds of any raffle or poker runs must be exclusively devoted to the
lawful purpose of the licensee.
2. No person, except a bona fide member ofthe licensee, may participate in the
management or operation of the raffle or poker runs.
3. No person may receive remuneration or profit for participating in the management or
operation of the raffle or poker runs.
4. Raffle chances may only be sold, offered for sale, conveyed, issued, or otherwise
transferred for value, during the time period, at the price specified and within the
area specified on the license;
5. Raffle and poker runs winners shall be determined and announced at the date, time,
and location designated in the application and on the permit.
6. No person under the age of 18 years may participate in the conducting of raffles or
chances or poker runs without the permission of a parent or guardian. A person under
the age of 18 years may be within the area where winning chances are being
determined only when accompanied by his or her parent or guardian.
4-6K-9: RAFFLE MANAGER; BOND: All operation and the conduct of raffles shall
be under the supervision of a single manager designated by the organization. The
manager shall give a fidelity bond in an amount determined by the Raffle and Poker Runs
Administrator in favor of the organization conditioned upon his honesty in the performance of his
duties. Terms of the bond shall provide that notice shall be given in writing to the Village not less
than thirty (30) days prior to its cancellation. The Raffle and Poker Runs Administrator may waive
this bond requirement by including a waiver provision in the license issued to an organization under
this Code, provided a license containing such waiver provision shall be granted only by a
unanimous vote of the members of the licensed organization. Nothing in this Section shall be
deemed to apply to poker runs.
4-6K-10: RECORDS TO BE KEPT: Each licensee shall keep records of its gross
receipts, expenses, and net proceeds for each single gathering or occasion at which
winning chances in a raffle or winning hands or scores in a poker runs are determined.
A. All deductions from gross receipts for each single gathering or occasion shall be documented
with receipts or other records indicating the amount, a description of the purchased item or
service, or other reason for the deduction, to the recipient.
B. The distribution of net proceeds shall be itemized as to payee, purpose, amount, and date of
payment.
C. Gross receipts from the operation of raffles and poker runs shall be segregated from other
revenues of the organization and placed in a separate account. The person who accounts for
gross receipts, expenses, and net proceeds from the operation of raffles or poker runs shall
not be the same person who accounts for other revenues of the organization.
D. Each licensee shall report promptly after the conclusion of each raffle or poker runs to its
membership. Each organization Licensed to conduct raffles or poker runs shall report

promptly to the licensing local unit of government its gross receipts, expenses, and net
proceeds from the raffle or poker runs, and the distribution of net proceeds itemized as
required in this Section.
E. Records required by this Section shall be preserved for three (3) years, and organizations
shall make available their records relating to the operation of raffles or poker runs for public
inspection at reasonable times and places.
SECTION 3: This Ordinance shall be in full force and effect from and upon its passage and
approval as provided by law.

To update the Intergovernmental Cooperative Agreement with the Morton
Grove Park District wherein resources are shared and program and services
are jointly provided to the residents of the Village of Morton Grove.
The Village of Morton Grove and the Morton Grove Park District both serve
the interests of the residents of Morton Grove. A Cooperative Agreement
such as this helps ensure the provision of excellent quality services to the
residents of the community while holding costs to a minimum and eliminating
duplication. This Agreement underscores and updates the long standing
tradition of the Village and Park District sharing equipment and services, and
formalizes service changes relating to landscape maintenance service
provided by each agency. All other provisions of the 2001 amended
intergovernmental agreement remain in effect..

WHEREAS, the Village of Morton Grove (VILLAGE), located in Cook County, Illinois, is a home rule
unit of government under the provisions of Article 7 of the 1970 constitution of the State of Illinois, can
exercise any power and perform any function pertaining to its government affairs, including but not limited to
the power to tax and incur debt; and
WHEREAS, the Village of Morton Grove and the Morton Grove Park District have historically
cooperated in sharing resources and jointly providing programs and services to the residents of Morton Grove;
and
WHEREAS, this relationship has resulted in the provision of excellent quality services to the residents
of the community while holding costs to a minimum and eliminating duplication; and
WHEREAS, both the Village and the Park District formalized this cooperative relationship through the
execution of a Cooperative Agreement Among and Between the Village of Morton Grove and the Morton Grove
Park District, both in Cook County Illinois Relating to the Borrowing of Equipment and Utilization of Services
which was dated September 10, 1990, as authorized by Ordinance 90-53, and updated by Ordinance 01-33 and
Resolution 13-49; and
WHEREAS, since that time, numerous changes have occurred with regard to many of the terms and
conditions included in the Intergovernmental Agreement; and
WHEREAS, the Village Board of Trustees is desirous of maintaining and continuing the cooperative
agreement between the Village and the Park District which promotes the health, safety and welfare of
community residents and has generated substantial savings to the direct benefit of taxpayers.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS, clauses into
this Resolution hereby making the findings as hereinabove set forth.
SECTION 2: The Village President is hereby authorized to execute and the Village Clerk to attest the
attached agreement entitled a Cooperative Agreement Among and Between the Village of Morton Grove and the
Morton Grove Park District, both in Cook County Illinois Relating to Borrowing of Equipment and Utilization
of Services as amended and which is hereby incorporated herein as part of this Resolution.
SECTION 3: The Village Administrator is hereby authorized to implement all provisions of the
agreement and to take action as necessary to support existing assistance and cooperative programs with the Park
District.
SECTION 4: This Resolution shall be in full force and effect upon its adoption and approval.

AMENDMENT TO THE COOPERATIVE AGREEMENT AMONG AND BETWEEN
THE VILLAGE OF MORTON GROVE AND THE MORTON GROVE PARK
DISTRICT, BOTH OF COOK COUNTY, ILLINOIS, RELATING TO BORROWING OF
EQUIPMENT AND UTILIZATION OF SERVICES
This Amendment is made this day of , 2018 (the "Effective
Date"), between the Village of Morton Grove (the "Village") and the Morton Grove Park District
(the "Park District") amends, supplements and modifies the "Cooperative Agreement Among and
Between the Village of Morton Grove and the Morton Grove Park District, Both of Cook
County, Illinois, Relating to Borrowing of Equipment and Utilization of Services dated August
14, 2001" (the "2001 Agreement") The Village and the Park District are hereinafter sometimes
individually referred to a "Party" or collectively referred to as the "Parties". Capitalized terms
used but not otherwise defined in this Amendment shall have the meanings assigned to such
terms in the 2001 Agreement.
RECITALS
WHEREAS, the Village and the Park District are units of local government and public
agencies within the meaning of the Illinois Intergovernmental Cooperation Act (5 ILCS 220/I et
seq.) (the "Act") and are authorized by the Act and by Article VII, Section 10 of the 1970
Constitution of the State of Illinois to enter into intergovernmental agreements of cooperation;
and
WHEREAS, the Parties now wish to amend the terms of the 2001 Agreement to re-
allocate certain municipal rights-of-way mowing responsibilities between them to enhance
efficiencies.
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual
covenants and agreements contained herein and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, the Parties agree as follows:
1. Incorporation of Recitals. The Recitals set forth above are hereby incorporated by
reference into this Amendment as though fully set forth herein, and all covenants, terms,
conditions, and provisions of this Amendment shall be construed, interpreted, and
enforced in accordance therewith.
2. Section III of the Agreement shall be amended to read as follows:
III. MORTON GROVE PARK DISTRICT SERVICES TO VILLAGE
Morton Grove Park District services provided for the Village of Morton Grove will
include, but are not limited to:
A Allow all fines and forfeitures which result from enforcement actions ofthe
Park District Police to be retained by the Village with the exception of
monies recovered as restitution for actual damages to Park District
property.

B. Provide staffexpertise in assisting the Village of Morton Grove in
developing an annual block ofsenior citizen programming, entitled
"Leisure Services for Seniors."
G Continue to provide senior citizen physical fitness programming at Park
District facilities.
D. Provide the Village of Morton Grove with senior
programming advertisement in Park District marketing
materials to the extent possible as determined by the Park
District.
E Provide programming space for senior citizen programming at the
Park District facilities when needed and requested by the Village
and to the extent possible as determined by the Park District. In
those instances, when the request is honored by the Park District, the
Village and the Park will negotiate a "shared" revenue agreement
for the use of the Park District facility.
F. Provide photo I.D's for Village Employees.
G. Mow the grassed areas of the following parcels of the municipal right-of-way
at its sole cost and expense:
a. The north side of Dempster Street, from Lehigh Avenue to western edge of the
Cook County Forest Preserve property, parkway and just north of public
sidewalk.
b. The south side of Dempster Street at Lehigh Avenue, from the Metra tracks
west to the bike path.
c. The northeast corner of Beckwith Avenue and Neenah Avenue, both parkways
along Beckwith and Neenah.
d. The north and south sides of Eldorado Terrace between Narragansett Avenue
and Overlook Drive.
e. The south side corners of Golf Road and Narragansett Avenue.
f. The dead end area of McVicker Avenue north of Davis Avenue. Around the
Lift Station.
g. The northwest corner of Meade Avenue and Davis Avenue both parkways
h. Beckwith Road both sides of the North Branch Chicago River Bridge around
guard rails.
3. Remaining Agreement Provisions. All other provisions, terms and conditions of the
2001 Agreement not amended by this Amendment, including but not by limitation,
Section IV thereof, titled "VILLAGE OF MORTON GROVE SERVICES TO PARK
DISTRICT," subsections A -D, shall remain in full force and effect without revision. In
the event of any conflict between the provisions of this Amendment and the provisions of
the Agreement, the provisions of this Amendment will control.

To authorize the Village Administrator to direct Morton Grove -Niles Water
Commission to construct the on -street parking facility improvements on the east
west side of Marmora Avenue just north and south of Dempster Street which will
increase the number of public on -street parking spaces in that area.
The Village desires to provide additional on -street parking facilities along Dempster
Street as opportunities or needs arise. There is a timely opportunity to construct a
new on -street parking facility on the west side of Marmora Avenue just north and
south of Dempster Street. Additionally, the sidewalk on the east side of Marmora
just north of Dempster is severely deteriorated and needs to be replaced. The
Morton Grove -Niles Water Commission needs to reconstruct the concrete pavement
on Marmora Avenue adjacent to the proposed location of the on -street parking
facility and has expressed a willingness to include this work in their improvernents.
It is practical and prudent for the Village to pay the Morton Grove -Niles Water
Commission to construct the desired improvements.

The estirnated contract value is $60,000.00. Since this is a unit price contract, the
final contract amount will be based on the actual quantity of work performed.

WHEREAS, the Adopted 2018 Budget includes funding in the amount of $1,007,500 for street
improvements and Dempster Street on -street parking construction in the Capital Projects Account 305060-
553300, of which $956,140 is unobligated.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1. The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Resolution as though fully set forth therein thereby making the findings as hereinabove
set forth.
SECTION 2. The Corporate Authorities ratify the Village's intention to build new on -street parking
facilities along Dempster Street.
SECTION 3. The Corporate Authorities authorize the Village Administrator to direct the Morton
Grove -Niles Water Commission to construct the on -street parking facility improvements included in the
plans and estimate prepared by Ciorba Group, Inc.
SECTION 4. The sum of sixty thousand dollars ($60,000.00) is hereby appropriated, or so much as
may be necessary from any monies now or hereinafter allotted to the Village to pay its share of the cost of
this improvement.
SECTION 5. The Village Administrator, Director of Public Works, and the Village Engineer and/or
their designees are hereby authorized to take all steps necessary to oversee, and implement this agreement.
SECTION 6. This Resolution shall be in full force and effect upon its passage and approval.

To authorize the Village Administrator to direct the Morton Grove -Niles Water
Commission to reconstruct a 140-segement of asphalt pavement on Marmora
Avenue just south of Dempster Street with concrete pavement in order to provide a
suitable, consistent pavement section on Marmora Avenue.
The Village made an emergency repair to a segment of pavement on Marmora
Avenue in 2014. It was cost-effective at the time to replace the concrete pavement
with asphalt pavement. The Morton Grove -Niles Water Commission must restore
the concrete pavement on Marmora Avenue from South Park Avenue to Greenwood
Avenue. Their work will omit the newer asphalt segment. The Village recently
installed a segment of water main within the asphalt pavement segment that
disturbed the newer asphalt pavement. The result is that the newer asphalt pavement
needs some restoration and it is practical to reconstruct this segment with concrete
pavement. The Morton Grove -Niles Water Commission has expressed a
willingness to include this work in their improvements.

WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home rule
unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois, can
exercise any power and perform any function pertaining to its government affairs, including but not Limited
to the power to tax and incur debt; and
WHEREAS, the Village reconstructed a 140 -foot segment of pavement on Marmora Avenue just
south of Dempster Street in 2014; and
WHEREAS, the work was an emergency repair of severely deteriorated concrete pavement and at the
time the most economical pavement was asphalt; and
WHEREAS, the Morton Grove -Niles Water Commission must reconstruct concrete pavement on

restoration, but their work did not significantly disturb the newer asphalt pavement; and

To authorize the execution of an agreement with the Illinois Department of
Transportation (IDOT) to share in the cost of constructing improvements to the
Village's south approach at Harms Road at Golf Road,
IDOT plans to widen the intersection, modernize the traffic signals, and add
emergency vehicle preemption at the intersection of Golf Road and Harms Road.
IDOT is therefore the lead agency for the development and completion of this
project. The south approach of Harms Road at this intersection is the Village's
jurisdiction. The Village is responsible for one-quarter of the State's cost of
replacing the traffic signals. Federal funding is provided for 80 percent of the
project costs. Of the remaining 20 percent, the Village is responsible for one-
quarter, or 5 percent, of the cost. The emergency vehicle preemption (EVP) allows
emergency vehicles to interrupt the traffic signal cycle to provide a green signal for
approaching fire department vehicles responding to an emergency. EVP continues
to be a valuable safety enhancement and remains the sole financial responsibility of
the Village. The agreement requires the Village to approve the plans before the
letting; appropriate sufficient funds for the Village's cost -share; pay 80 percent of
the Village cost -share at contract execution; maintain the Village's parking
restriction within the limits of the improvement; and continue to maintain Harms
Road.

The estimated Village share of the contract is $25,300.00. Since this is a unit price
contract, the final contract amount will be based on the actual quantity of work
performed.

SECTION 2. The Village President is authorized to execute and the Village Clerk to attest the
agreement included in Exhibit "A" between the Village of Morton Grove and the state of Illinois acting by
and through its Department of Transportation for the improvement of Golf Road at Harms Road.
SECTION 3. The sum of twenty-five thousand three hundred dollars ($25,300.00) is hereby
appropriated or so much as may be necessary from any monies now or hereinafter allotted to the Village to
pay its share of the cost of this improvement as provided for in the Agreement.
SECTION 3. Upon award of the contract for this improvement, the Village will pay a lump sum to
the state of Illinois from funds allotted to the Village which shall be an amount equal to 80% of its obligation
incurred under this Agreement and will pay to the state of Illinois the remainder of the obligation in a lump
sum upon completion of the project based on final costs.
SECTION 4. The Village agrees to pass a supplemental resolution to provide any necessary funds for
its share of the cost of this improvement if the amount appropriated proves to be insufficient to cover the
said costs.
SECTION 5. The Village Administrator, Director of Public Works, and the Village Engineer and/or
their designees are hereby authorized to take all steps necessary to oversee, and implement this agreement.
SECTION 6. This Resolution shall be in full force and effect upon its passage and approval.

AGREEMENT
This Agreement entered into this 13th day of August, 2018, A.D, by and between the STATE OF
ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter called the
STATE, and the VILLAGE OF MORTON GROVE of the State of Illinois, hereinafter called the
VILLAGE.
WITNESSETH:
WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the
motoring public, is desirous of improving Golf Road at Harms Road, known as STATE Job No.: C-91-
012-15, STATE Contract No. 60Y74, STATE Section: 584N(14), by widening the intersection,
modernizing the traffic signals, adding Emergency Vehicle Pre-Emption equipment and by performing
all other work necessary to complete the improvement in accordance with the approved plans and
specifications, hereinafter called the IMPROVEMENT; and
WHEREAS, the VILLAGE is desirous of said IMPROVEMENT in that same will be of
immediate benefit to the VILLAGE residents and permanent in nature;
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree as follows:
EXHIBIT "A"
1, The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and
specifications, receive bids and award the contract, furnish engineering inspection during
construction and cause the Improvement to be built in accordance with the approved plans,
specifications and contract.
2. The STATE agrees to pay for all right of way, construction and engineering costs subject to
reimbursement by the VILLAGE, as hereinafter stipulated.
3. It is mutually agreed by and bet -ween the parties hereto that the estimated cost and cost proration
for this Improvement is as shown on Exhibit A attached hereto and made a part hereof
4. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost
for this Improvement, a copy of which is attached hereto as Exhibit B and made a part hereof.
5. The VILLAGE agrees that upon award of the contract for this Improvement, the VILLAGE will
pay to the STATE, in a lump sum from any funds allotted to the VILLAGE, an amount equal to
8O% of its obligation incurred under this AGREEMENT, and will pay to said STATE the
remainder of the obligation (including any non -participating costs on FA Projects) in a lump
sum, upon completion of the project, based upon final costs.
6. The VILLAGE further agrees to pass a supplemental resolution to provide necessary funds for its
share of the cost of this Improvement if the amount appropriated in Exhibit B proves to be
insufficient to cover said cost.
7. The VILLAGE has adopted and will put into effect an appropriate ordinance, prior to the
STATE's advertising for the proposed work to be performed hereunder, or shall continue to
enforce an existing ordinance, requiring that parking be prohibited within the limits of this
improvement, a copy of which is attached hereto as Exhibit C, and will, in the future, prohibit
parking at such Iocations on or immediately adjacent to this improvement as may be determined
necessary by the STATE from traffic capacity studies.
EXHIBIT "A"
8. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb, as
constructed, or the construction of additional entrances, private or commercial, along Golf Road
without the consent of the STATE.
9, Upon final field inspection of the improvement and so long as Golf Road is used as a STATE
Highway, the STATE agrees to maintain or cause to be maintained the median, the through
traffic lanes, the left -turn lanes and right turn lanes, and the curb and gutter, stabilized shoulders
and ditches adjacent to those traffic lanes and turn lanes.
10. Upon final field inspection of the improvement, the VILLAGE agrees to maintain or cause to be
maintained those portions of the improvement which are not maintained by the STATE,
including new and existing sidewalks, parkways, crosswalk and stop -line markings, VILLAGE
owned utilities including appurtenances thereto, highway lighting including furnishing the
electrical energy thereof and shall maintain the storm sewers and appurtenances by performing
those functions necessary to keep the sewer in a serviceable condition including cleaning sewer
lines, inlets, manholes, and catch basins along with the repair or replacement of inlet, manhole
and catch basins' frames, grates or lids. The maintenance, repair and/or reconstruction of storm
sewers constructed as part of this improvement beyond the afore described responsibilities shall
be that of the STATE.
11. The VILLAGE further agrees to continue its existing maintenance responsibilities on Harms
Road and all side road approaches under its jurisdiction, including all left and right turn lanes on
said side road approaches, up to the through edge of pavement of Golf Road. Drainage facilities,
if any, at the aforementioned side roads located within the STATE right-of-way shall be the joint
maintenance responsibility of the STATE and the VILLAGE unless there is an agreement
specifying different responsibilities.

12. Upon acceptance by the STATE of the traffic signal work included herein the responsibility for
maintenance and energy shall continue to be as outlined in the current. Master Agreement
executed between the STATE and the VILLAGE on February 13, 2013.
13. It is mutually agreed that the actual traffic signal maintenance will be performed by the STATE,
either with its own forces or through an ongoing contractual agreement.
14. The STATE's Electrical Maintenance Contractor shall maintain the Emergency Vehicle Pre-
emption System equipment and directly invoice the VILLAGE for costs related to such
maintenance services.
15. The VILLAGE shall maintain the emitters and associated appurtenances at its own expense. The
emitters shall be maintained and tested in accordance with the recommendations of the
manufacturer.
16. It is mutually agreed, if, in the future, the STATE adopts a roadway or traffic signal improvement
passing through the traffic signals included herein which requires modernization or
reconstruction to said traffic signals then the VILLAGE agrees to be financially responsible for
its share of the cost and all costs to relocate or reconstruct the emergency vehicle pre-emption
equipment in conjunction with the STATE's proposed improvement,
17. The VILLAGE has adopted a resolution, will send a letter, or sign the Plan Approval page which
is part of this document, prior to the STATE advertising for the work to be performed hereunder,
approving the plans and specifications as prepared.
18. Under penalties of perjury, the VILLAGE certifies that its correct Federal Tax Identification
number is 36-6006007 and it is doing business as a GOVERNMENTAL ENTITY, whose
mailing address is: Village of Morton Grove, 6101 Capulina Avenue, Morton Grove, Illinois
60053.
Obligations of the STATE and the VILLAGE will cease immediately without penalty or further

payment being required if, in any fiscal year, the Illinois General Assembly or Federal funding source
fails to appropriate or otherwise make available funds for this contract.
This AGREEMENT and the covenants contained herein shall be null and void in the event the
contract covering the construction work contemplated herein is not awarded within the three years
subsequent to execution of the agreement.
This Agreement shall be binding upon and to the benefit of the parties hereto, their successors
and assigns.

To authorize the purchase of a new 2018 HAMM HD 10C VV Dual. Drum
Vibratory Compactor.
The Public Works Vehicle Maintenance Division routinely reviews vehicles
and equipment for fuel economy, safety, dependability, age, and excessive
repair cost, replacing or eliminating equipment which no longer meets the
department's needs. During the review process it was deemed the existing
2001 Ingersol Rand Compactor needed to be replaced and a new HAMM HD
10C VV Dual Drum Vibratory Compactor has been chosen for that
replacement. The existing 2001 Ingersol Rand Compactor will be retained as
a reserve in case of an emergency. The Vehicle Maintenance Division
drafted specifications and solicited bids for a New HAMM HD 10C VV Dual
Drum Vibratory Compactor based on research of various makes and models
and the Village's success with a demonstration of the compactor listed. Bid
packets were obtained by two (2) vendors for this specific compactor. The
two bids obtained met specification requirements for the new 2018 HAMM
HD 10C VV Dual Drum Vibratory Compactor with the lowest bid being
from Roland Machinery Company for $32,860.

WHEREAS, the Village of Morton Grove (VILLAGE), located in Cook County, Illinois, is a

but not limited to the power to tax and incur debt; and
WHEREAS, the Public Works Department routinely reviews vehicles and equipment for fuel
economy, safety, dependability, age, and excessive repair cost and recommends replacing or eliminating
equipment that no longer meets the requirements of the Department; and
WHERAS, the Public Works Department has determined the existing 17 year old 2001 Ingersol
Rand Compactor is no longer a dependable piece of equipment; and
WHEREAS, the Vehicle Maintenance Division researched dual drum vibratory compactors and
solicited demonstrations from various compactor manufacturers such as: Caterpillar, Bomag and
HAMM; and
WHEREAS, the only successful demonstration was a HAMM HD 10C VV Dual Drum
Vibratory Compactor, therefore staff decided a new HAMM HD 10C VV Dual Drum Vibratory
Compactor would best suit the needs of the Department and drafted specifications accordingly; and
WHEREAS, the Village of Morton Grove's Public Works Department advertised on the
Village's web site as well as in newspapers inviting bids for the purchase of a new HAMM HD 100C
VV dual drum vibratory compactor; and
WHEREAS, two (2) vendors of identical models obtained specifications; and
WHEREAS, the Public Works Department received two (2) bids that were publicly opened and
read on Friday September 14, 2018, at 10:OOam in the Public Works facility located at 7840 Nagle
Avenue Morton Grove, Illinois with the following results:
Roland Machinery Co., 2018 HAMM HD IOC VV Compactor: 532,860,00
The McLean Co., HAMM HD 10C VV Compactor: 533,800.00
; and
WHEREAS, the Village Board approved the 2018 Budget pursuant to Ordinance 17-28 on

the amount of $35,000 to replace this piece of equipment; and
WHEREAS, the Village Administrator and staff recommends the Village Board approve and
authorize the purchase of a new HAMM HD 10C VV dual drum vibratory compactor from Roland
Machinery Company, 220E Frontage Road, Bolingbrook, Illinois 60440 for the purchase price of

FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Resolution as though fully set forth therein thereby making the findings as hereinabove set
forth.
SECTION 2: The Village Administrator is hereby authorized to execute a contract for the
purchase of a new 2018 HAMM HD 10C VV dual drum vibratory compactor for $32,860.00.
SECTION 3: The Public Works Director and/ or his designee is/are authorized to take all steps
necessary to implement this purchase.
SECTION 4: This Resolution shall be in full force and effect from and upon its passage and
approval.
