MINUTES OF A REGULAR MEETING OF THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE COOK COUNTY, ILLINOIS, HELD AT THE RICHARD T. FLICKINGER MUNICIPAL CENTER AUGUST 27, 2018 CALL TO ORDER I — Village President Dan DiMaria convened the Regular Meeting of the Village Board at 7:00 p.m. V. in the Council Chambers of Village Hall and led the assemblage in the Pledge of Allegiance. Mayor DiMaria then asked for a moment of silence to honor the passing of Senator John McCain this past Saturday. Senator McCain will be remembered as a true patriot who served his country faithfully for sixty years. He was a naval officer and Vietnam War POW who would not abandon his colleagues. Upon his return home, he served with distinction for two terms in the US House of Representatives, was elected to the US Senate in 1987, and served there until his death. He was the Republican nominee for President of the United States in the 2008 election. He was a great American, and will be missed. VI. Village Clerk Eileen Harford called the roll. Present were: Trustees Bill Grear, Rita Minx, Ed Ramos, John Thill, and Connie Travis. Trustee Janine Witko was absent with notice. VII. APPROVAL OF MINUTES VIII. IX. Trustee Minx moved to accept the Minutes of the Board Meeting of August 13, 2018 as submitted, seconded by Trustee Ramos. Motion passed unanimously via voice vote. SPECIAL REPORTS NONE PUBLIC HEARINGS NONE Minutes of August 27, 2018 Board Meeting X. XI. RESIDENTS' COMMENTS (Agenda Items Only) NONE PRESIDENT'S REPORT 1. Mayor DiMaria proclaimed the week of September 17-23, 2018 as "Constitution Week" in the Village, noting that September 17 marks the 2315' anniversary of the drafting of the US Constitution by the Constitutional Convention. He asked all residents of the Village to reaffirm the ideals that the framers of the Constitution had in 1787 by attentively protecting the freedoms guaranteed to us through this guardian of our liberties. 2. Mayor DiMaria thanked the Assyrian community for holding its "Food Fest" in Morton Grove this year. He and several of the trustees attended the event, which was quite successful. The mayor said the Village was presented with an award which will be displayed at Village Hall. XII. CLERK'S REPORT Clerk Harford had no report. XIII. STAFF REPORTS A. Village Administrator: 1. Mr. Czerwinski presented for the Board's consideration Resolution 18-46, Providing an Inducement to IM Kensington MG LLC and the Village of Morton Grove For a Redevelopment Project in the Village of Morton Grove, Cook County, Illinois. a. He explained that there is a potential developer for Prairie View Shopping Center, but inducement will be needed to support the developer, IM Kensington MG LLC, in their efforts to purchase and develop the 26+ acre commercial site. b. Prairie View Shopping Center, located within the Dempster/Waukegan TIF District, suffers from blighting factors including obsolescence, deterioration, structures below minimum code standards, excessive vacancies, inadequate utilities, lack of community planning, and stagnating or declining property values. The economic and physical development of the Village may be hampered if blighting factors continue at Prairie View SIC. To correct this status, public subsidies, incentives, assistance, approvals, and entitlements will likely be necessary for this development in order to alleviate adverse conditions, encourage private investment, and restore and enhance the tax base of the Village and the taxing districts. c. Mr. Czerwinski said that approval of this Resolution is intended to induce the developer to begin incurring those costs now, by stating that, if the Village determines it is appropriate to provide public assistance to the developer to redevelop this shopping center, the Village will take the appropriate actions as allowed by law and/or as authorized by the TIF Act, and will bargain in good faith with the developer to negotiate a redevelopment agreement to provide public assistance for an appropriate portion of the land acquisition costs, demolition costs, site preparation costs, and other approved redevelopment costs incurred by the developer before the developer and the Village may enter into redevelopment agreements. 2 XIII. 4V1inutes of August 27, 2018 Board Meeting` STAFF REPORTS (continued) A. Trustee Minx presented Ordinance 18-08, An Ordinance Approving a Special use Permit Request for Antenna and Antenna Support Structures at 6042 Oakton Street, Morton Grove, IL. a. b. This is the second reading of this Ordinance. Trustee Minx explained Insite, Inc., on behalf of Verizon Wireless, has filed an application for a Special Use Permit for antenna and antenna support structures at the site of the Village's south water tower, 6042 Oakton. The Village's Unified Development Code requires a Special Use Permit for antenna and antenna support structures above 65' high in the M2 General Manufacturing District. Verizon would be installing nine 7' high antennas on top of the existing 123 ft. high water tower. Once installed, the highest point of the antennas will be approximately 130 feet. The Village and Verizon have agreed to a lease agreement to allow for the installation of these antennas and support structures. Trustee Minx said that, because the overall site is already surrounded by a 6 ft. high fence, and because the ground-based equipment will be located over 200 feet from the public right-of-way, Insite had requested, and the Village's Public Works Department was supportive of, a waiver for any additional on-site fencing. 3 XIV. Further, as the facility will be unmanned, and given that Verizon expects no more than one maintenance -related vehicular trip per month to and from the site, Insite had also requested a complete waiver from the parking requirements and is proposing to add no parking spaces to the site. Trustee Minx said that this has been reviewed by the Village departments and had gone through a public hearing before the Appearance Commission and the Plan Commission. The Plan Commission has unanimously (with 1 absent) recommended approval of the application, with conditions. Trustee Minx moved to adopt Ordinance 18-8, seconded by Trustee Thill. Witko absent Next, Trustee Minx presented Resolution 18-37, Approving and Authorizing a Lease Agree- ment Between the Village of Morton Grove and Chicago SMSA Limited Partnership, d/b/a Verizon Wireless, Concerning Real Property Owned by the Village and Located at 6042 Oakton Street, Morton Grove, IL. She explained that this will approve the lease agreement she mentioned during discussion of Ordinance 18-08, leasing land and space on the Village -owned water tower and an approximately 20' x 36' parcel of land for ground-based communication equipment. Trustee Minx said the Village Administrator and Verizon have negotiated a five-year lease agree- ment, commencing when Verizon commences installation of its equipment on the leased premises or March 1, 2019, whichever comes first. The Lease includes four additional five-year extensions. The annual rent will initially be $35,000 per year with 3% annual increases. The lease is contingent on the adoption of Ordinance 18-08, which has just occurred. Trustee Minx moved, seconded by Trustee Grear, to approve Resolution 18-37. Trustee Thill: Trustee Thill had no formal report, but congratulated the Muslim Education Center (MEC) because when this institution first opened its doors in August 1990, it had a total enrollment of 25 students and only offered kindergarten, first and second grades. As a testimony to its tremendous growth, MCC Academy now has an enrollment of approximately 620 students, over 90 staff members, and offers preschool to eighth grades to the community it serves. E. Trustee Travis: Trustee Travis no report. F. Trustee Witko: Trustee Witko was absent—no report. XV. OTHER BUSINESS NONE XVI. Witko absent Trustee Thill commented that he'd like to frame this Warrant Register, as it's the lowest one he's seen in 14 years! XVII. RESIDENTS' COMMENTS 1. Mayor DiMaria reminded Mr. Vilk he will have 3 minutes in which to speak. a. Rudolph Vilk said that Mayor DiMaria needs to make a decision as to whether he will answer questions which Mr. Vilk has asked him—questions that don't concern any legal issues occurring currently. Mr. Vilk also asked why the Village would only issue one senior discount per household on the Village vehicle sticker, even when there are two car -driving seniors living there. He noted that he faithfully pays his property taxes every year, and felt that this was one example of what's wrong with the Village today. He ended stating his opinion that the mayor "should be fired." XVIII. The Illinois Raffles and Poker Runs Act (230 ILCS 15/0.01 et. seq.) requires organizations to obtain a Village license in order to conduct raffles or poker runs. This ordinance will provide for the licensing and regulation of three classes of raffle licenses and two classes of poker runs licenses: o Class A Raffle License for raffles conducted by law enforcement agencies and qualified organizations with a maximum single prize of $2,000 or total prizes of $10,000. Only four Class A Raffle Licenses may be granted to a qualified organization during a calendar year; o CIass B Raffle License for raffles conducted by qualified organizations. A fidelity bond is required if a single prize is over $2,000 or the aggregate of all prizes are over $10,000. The maximum prize cannot exceed the amount of the fidelity bond; o Class C Raffle License for weekly raffles conducted by qualified organizations. A fidelity bond is required if a single prize is over $2,000 or the aggregate of all prizes are over $10,000. The maximum prize cannot exceed the amount of the fidelity bond; o Class A Poker Runs license for games conducted by qualified organizations where the maximum prize of any winning hand or high score does not exceed $2,000 and total prizes do not exceed $10,000, with only four (4) conducted per calendar year; o Class B Poker Runs license for weekly games conducted by qualified organizations where the maximum prize of any winning hand or high score does exceed $2,000 and total prizes do not exceed $10,000, unless a fidelity bond is obtained; No Fee or formal application is required for Class A raffle licenses. The fee for Class B Raffle and Class A Poker Run licenses is $50.00. The fee for Class C Raffle and Class B Poker Run licenses is $100.00. Licenses may not be issued to professional gamblers, convicted felons, or persons of poor moral character. (the "Act") has established minimum standards which municipalities must impose in connection with an ordinance regulating raffles and poker runs; and WHEREAS, a municipality may regulate raffles and poker runs within its corporate boundaries pursuant to the Act; and WHEREAS, adoption of this ordinance to regulate raffles and poker runs within the Village will promote the health, safety, and welfare of the residents of the Village. NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS: SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses into this Ordinance as though fully set forth therein thereby making the findings as hereinabove set forth. SECTION 2: Title 4 (entitled "Business Regulations"), Chapter 6 (entitled "Regulations Pertaining to Specific Businesses") of the Village of Morton Grove Municipal Code is hereby amended to add a new Article K to be entitled "Charitable Raffles and Poker Runs" to read as follows: 1 SECTION: 4-6K-1: 4-6K-2: 4-6K-3: 4-6K-4: 4-6K-5: 4-6K-6: 4-6K-7: 4-6K-8: 4-6K-9: 4-6K-10: TITLE 4 ARTICLE K. CHARITABLE RAFFLES AND POKER RUNS Definitions License Required Classification of Licenses License Ineligibility Raffle and Poker Runs Applications License Issuance Licensing Fee Conduct of Raffles and Poker Runs Raffle Manager; Bond Records to be Kept 4-6K-1: DEFINITIONS: The following words, terms, and phrases, when used in this Code shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning: THE ACT The Illinois Raffles and Poker Runs Act (230 ILCS 15/0.01 et. seq.). BUSINESS ORGANIZATION CHARITABLE ORGANIZATION EDUCATIONAL ORGANIZATION FRATERNAL ORGANIZATION LABOR A voluntary organization composed of individuals and businesses who have joined together to advance the commercial, financial, industrial, and civic interests of a community. An organization or institution organized and operated to benefit an indefinite number of the public. The service rendered to those eligible for benefits must also confer some benefit on the public. An organization or institution organized and operated to provide systematic instruction in useful branches of learning by methods common to schools and institutions of learning which compare favorably in their scope and intensity with the course of study presented in tax - supported schools. An organization of persons having a common interest, the primary interest of which is to both promote the welfare of its members and to provide assistance to the general public in such a way as to lessen the burdens of government by caring for those that otherwise would be cared for by the government. An organization composed of workers organized with the objective of betterment of the conditions of those engaged in such pursuit and the 2 LAW ENFORCEMENT AGENCY development of a higher degree of efficiency in their respective occupations. An agency of Illinois or unit of local government which is vested by law or ordinance with the duty to maintain public order and to enforce criminal Iaws or ordinances. LICENSEE An organization which has been issued a Village of Morton Grove raffle and poker runs license. NET PROCEEDS The gross receipts from the conduct of any raffle or poker runs, less reasonable sums expended for prizes, local license fees, and other reasonable operating expenses incurred as a result of operating a raffle. NONPROFIT An organization or institution organized and conducted on a not -for - ORGANIZATION profit basis with no personal profit inuring to any one as a result of the operation. PERSON POKER RUNS An individual, firm, organization, public or private corporation, government, partnership, or unincorporated association A prize -awarding event organized by an organization licensed pursuant to the requirements of this Code in which participants travel to multiple predetermined locations, including a key location, to play a randomized game based on an element of chance. "Poker runs" includes dice runs, marble runs, or other events where the objective is to build the best hand or highest score by obtaining an item or playing a randomized game at each location. QUALIFIED A bona fide religious, charitable, labor, business, fraternal, educational ORGANIZATION or veteran organization operating without profit to their members and which have been in existence continuously for a period of five (5) years immediately before making application for a raffle license and which has had during that entire 5 -year period a bona fide membership engaged in carrying out their objectives, or a nonprofit organization the Raffle and Poker Runs Administrator (as defined below) determines is organized for the sole purpose of providing financial assistance to an identified individual or group of individuals suffering extreme financial hardship as the result of an illness, disability, accident, or disaster. RAFFLE A form of lottery, as defined in Section 28-2(b) of the Criminal Code of 2012(720 ILCS 5128-2(b), conducted by an organization licensed pursuant to the requirements of this Code, in which the player pays or agrees to pay something of value for a chance represented and differentiated by a number or by a combination of numbers or by some 3 RAFFLE AND POKER RUNS ADMINISTRATORS) RAFFLE EVENT RELIGIOUS ORGANIZATION VETERANS ORGANIZATION other means, one or more of which chances is to be designated as a winning chance; and the winning chance is to be determined through a drawing or by some other method based on an element of chance by an act or set of acts on the part of the persons conducting or connected with the lottery, except the winning chance shall not be determined by the outcome of the publicly exhibited sporting contest, but does not include a savings promotion raffle authorized under Section 5g of the Illinois Banking Act (205 ILCS 5/5g), Section 7008 of the Savings Bank Act (205 ILCS 205/7008), Section 42.7 of the Illinois Credit Union Act (205 ILCS 305/42.7), Section 5136B of the National Bank Act (12 U.S.C. 25a), or Section 4 of the Home Owners' Loan Act (12 U.S.C. 1463). The Village President of Morton Grove and/or his/her designee. An event at which at least one (1) raffle is conducted by any person. Any church, congregation, society, or organization founded for the purpose of religious worship. An organization or association comprised of members of whom substantially all are individuals who are veterans or spouses, widows, or widowers of veterans, the primary purpose of which is to promote the welfare of its members and to aid the general public in such a way as to confer a public benefit. 4-6K-2: LICENSE REQUIRED: A. Except as provided herein, it shall be unlawful for any person to conduct or operate a raffle, a raffle event, or a poker run in the Village of Morton Grove, or to sell, offer for sale, convey, issue, or otherwise transfer for value, a chance on a raffle or poker runs unless conducted pursuant to a license issued pursuant to and in accordance with the provisions of this Code. B. Raffles conducted by Political Committees licensed by the State Board of Elections pursuant to 230 ILCS 15/8.1 are exempt from the requirements of this Article. 4-6K-3: CLASSIFICATION OF LICENSES: A. Class A Raffle License: A Class A raffle license shall permit 1. a law enforcement agency or a statewide association that represents law enforcement officials to conduct raffles in the Village; or 4 2. a qualified organization to conduct a raffle event which may include multiple drawings to award prizes, but all drawings must occur on the same day and at the same location and within the confines of the same raffle event. The maximum retail value of any single raffle prize cannot exceed $2,000 and the maximum aggregate retail value of all raffle prizes for the raffle event cannot exceed $10,000. Raffle chances may only be sold within the corporate limits of Morton Grove and the price charged for each raffle chance issued or sold shall not exceed $100.00. Chances may not be issued or sold for any period longer than 365 days. Only four (4) Class A raffle licenses may be granted to a qualified organization during a calendar year. B. Class B Raffle License: A Class B raffle license shall permit a qualified organization to conduct a single raffle event which may include multiple drawings to award prizes, but all drawings must occur on the same day and at the same location and within the confines of the same raffle event. The maximum retail value of a single raffle prize and the aggregate retail value of all prizes or merchandise awarded in a raffle event shall not exceed the amount of the fidelity bond submitted with the application for a raffle license pursuant to 4-6K-9. If the fidelity bond is waived, the maximum retail value of a single raffle prize may not exceed $2,000 and the aggregate retail value of all prizes or merchandise awarded in a raffle event shall not exceed $10,000. Raffle chances may only be sold within the corporate limits of Morton Grove and the price charged for each raffle chance issued or sold shall not exceed $100.00. Chances may not be issued or sold for any period longer than 365 days. C. Class C Raffle License: A Class C raffle license shall permit a qualified organization to conduct up to fifty-two (52) raffle events during a calendar year. Raffle events shall occur not more frequently than weekly and shall occur at specified locations within the Village of Morton Grove. The maximum retail value of a single raffle prize and the aggregate retail value of all prizes or merchandise awarded in a raffle event shall not exceed the amount of the fidelity bond submitted with the application for a raffle license pursuant to 4-6K-9. If the fidelity bond is waived, the maximum retail value of a single raffle prize may not exceed $2,000 and the aggregate retail value of all prizes or merchandise awarded in a raffle event shall not exceed $10,000. Raffle chances may only be sold within the corporate limits of Morton Grove and the price charged for each raffle chance issued or sold shall not exceed $100.00. Chances may not be issued or sold for any period longer than 365 days. D. Class A Poker Runs License: A Class A poker runs license shall permit a qualified organization to conduct a poker runs which may include multiple winning hands or high scores, but all winning hands or high scores must occur on the same day and at the same location and within the confines of the same poker runs at specified locations within the Village of Morton Grove. The maximum retail value of a prize of any winning hand or high score cannot exceed $2,000 and the maximum aggregate retail value of all poker runs prizes for the poker runs cannot exceed $10,000. Only four (4) Class A poker runs licenses may be granted to a qualified organization during a calendar year. E. Class B Poker Runs License: A Class B poker runs license shall permit a qualified organization to conduct up to fifty- two (52) poker runs during a calendar year. Poker runs shall occur not more frequently than weekly and at specified locations within the Village of 5 Morton Grove. The maximum retail value of a prize of any winning hand or high score cannot exceed $2,000 and the maximum aggregate retail value of all poker runs prizes for each poker runs cannot exceed $10,000. 4-6K-4: LICENSE INELIGIBILITY: A. The following persons and organizations are ineligible and shall not be issued a raffle or poker runs license: 1. Any person who has been convicted of a felony, subject to Paragraph C below; 2. Any person who is or has been a professional gambler or gambling promoter; 3. Any person who is not of good moral character; 4. Any person who has been found to have violated the Act or any provision of this Chapter within the past five (5) years. 5. Any organization in which a person defined in subsection (1), (2), (3) or (4) of this section has a proprietary, equitable, or credit interest or in which such person is active or employed; 6. Any organization in which a person defined in subsection (1), (2), (3) or (4) of this section is an officer, director, or employee, whether compensated or not; and 7. Any organization in which a person defined in subsection (1), (2), (3) or (4) of this section is to participate in the management or operation of a raffle as defined in this section. B. If a person was convicted of a felony, the applicant shall provide a list of such person's complete criminal history except for: 1. Juvenile adjudications of delinquent minors as defined in Section 5-105 of the Juvenile Court Act of 1987, subject to the restrictions set forth in Section 5-130 of the Juvenile Court Act of 1987. 2. Law enforcement records, court records, and conviction records of an individual who was seventeen (17) years old at the time of the offense and before January 1, 2014, unless the nature of the offense required the individual to be tried as an adult. 3. Records of arrest not followed by a conviction. 4. Convictions overturned by a higher court. 5. Convictions or arrests that have been sealed or expunged. C. The Raffle and Poker Runs Administrator may grant the license based on evidence of rehabilitation and mitigating factors submitted by the applicant, including any of the following factors and evidence to determine if the conviction will impair the ability of the applicant to engage in the position for which a license is sought: 1. The lack of direct relation of the offense for which the applicant was previously convicted to the duties, functions, and responsibilities of the position for which a license is sought; 6 2. Whether five (5) years since a felony conviction or three (3) years since release from confinement for the conviction, whichever is later, have passed without a subsequent conviction; 3. If the applicant was previously licensed or employed in the state of Illinois or other states or jurisdictions, then the lack of prior misconduct arising from or related to the licensed position or position of employment; 4. The age of the person at the time of the criminal offense; 5. Successful completion of sentence and, for applicants serving a term of parole or probation, a progress report provided by the applicant's probation or parole officer that documents the applicant's compliance with conditions of supervision; 6. Evidence of the applicant's present fitness and professional character; 7. Evidence of rehabilitation or rehabilitative effort during or after incarceration, or during or after a term of supervision, including, but not limited to, a certificate of good conduct under Section 5-5.5-25 of the Unified Code of Corrections or a certificate of relief from disabilities under Section 5-5.5-10 of the Unified Code of Corrections; and 8. Any other mitigating factors contributing to the person's potential and current ability to perform the duties and responsibilities of the position for which a license or employment is sought. 4-6K-5: RAFFLE AND POKER RUNS APPLICATIONS: A. Any qualified organization seeking to obtain a Class A raffle license, or a Class A poker runs license need not file an application with the Village, and such license shall be deemed automatically granted provided the qualified organization is not deemed ineligible for a license pursuant to 4-6K-4. However, a Class A raffle license or Class A poker runs license holder shall comply with all other regulations and requirements of the Act and this Chapter, and shall, upon request of the Raffle and Poker Runs Administrator, provide all records and information to verify it is a qualified organization and has and will conduct all raffles or poker runs in the Village in full compliance with the Act and this Chapter. B. Any person seeking to obtain a Class B or Class C raffle license, or a Class A or Class B poker runs license shall file and obtain an application with the Village's Raffle and Poker Runs Administrator on forms provided by the Village. The application shall be signed by the presiding officer, secretary, and raffle manager of the applicant and shall include the following documents and information: 1. The name, address, and type of organization; 2. The length of existence of the organization and, if incorporated, the date and state of incorporation; 3. The name, address, telephone number, and date of birth of the organization's presiding officer, secretary, raffles or poker runs manager, and any other members responsible for the conduct and operation of the raffle or poker runs; 4. The aggregate retail value of all prizes to be awarded in the raffle or poker runs; 5. A list of prizes and the retail of each prize to be awarded in the raffle(s) or poker run(s); 7 6. The maximum price charged for each raffle chance or poker runs chance issued or sold; 7. The maximum number of raffle chances or poker runs chances to be issued; 8. The area in which raffle chances will be sold or issued or a poker runs will be conducted; 9. The time period during which raffle chances will be issued or sold or a poker runs will be conducted; 10. The date, time, and location at which winning chances will be determined; 11. A sworn statement attesting to the eligibility of the applicant organization, which shall be signed by its presiding officer and secretary; 12. A certificate signed by the presiding officer of the applicant organization attesting to the fact the information contained in the application is true and correct; and 13. Unless waived by the Raffle and Poker Runs Administrator pursuant to 4-6K-9, a fidelity bond in an amount equal to the aggregate retail value of all prizes to be awarded shall accompany such application for raffle licenses. 4-6K-6: LICENSE ISSUANCE: A. The Raffle and Poker Runs Administrator shall issue or refuse to issue a raffle or poker runs license within thirty (30) days after a complete license application has been submitted which shall include all required information, documentation, and when applicable bond documentation; and all required fees to be paid. B. No raffle or poker runs license shall be issued to: 1. An ineligible person or organization; 2. Any person or organization that has an outstanding debt due and owing to the Village of Morton Grove; 3. Any person or organization who has submitted false or misleading information to the Raffle and Poker Runs Administrator or on its license application. C. If the Raffle and Poker Runs Administrator refuses to issue a raffle or poker runs license to an applicant, then the applicant shall be notified of the denial in writing with the following included in the notice of denial: 1. A statement about the decision to refuse to issue a license; 2. A list of the convictions the licensing authority determined will impair the applicant's ability to engage in the position for which a license is sought; 3. A list of convictions that formed the sole or partial basis for the refusal to issue a license; and 4. A summary of the appeal process or the earliest the applicant may reapply for a license, whichever is applicable. D. No later than May 1 of each year, the Raffle and Poker Runs Administrator shall prepare, publicly announce, and publish a report of summary statistical information relating to new and renewal license applications during the preceding calendar year. Each report shall show, 8 at a minimum: 1. The number of applicants for a new or renewal license under this Code within the previous calendar year; 2. The number of applicants for a new or renewal license under this Code within the previous calendar year who had any criminal conviction(s); 3. The number of applicants for a new or renewal license under this Code in the previous calendar year who were granted a license; 4. The number of applicants for a new or renewal license with a criminal conviction who were granted a license under this Code within the previous calendar year; 5. The number of applicants for a new or renewal license under this Code within the previous calendar year who were denied a license; and 6. The number of applicants for a new or renewal license with a criminal conviction who were denied a license under this Code in the previous calendar year in whole or in part because of a prior conviction. E. A Class B raffle license and a Class A poker runs license shall be valid for a single event which shall occur within sixty (60) days from and after its issuance. A Class C raffle license and a Class B poker runs license shall be valid for the calendar year for which it is issued. F. Class B and C raffle licenses and Class A and B poker runs licenses shall be prominently displayed at the raffle event. G. A license may be suspended or revoked by the Raffle and Poker Runs Administrator for any violation of this Code. 4-6K-7: LICENSING FEE: A. No license fee is required for a Class A raffle license. B. A license fee of $50.00 payable to the "Village of Morton Grove" shall be paid upon submission of a Class B raffle license or a Class A poker runs license application. C. A license fee of $100.00 payable to the "Village of Morton Grove" shall be paid upon submission of a Class C raffle license or a Class B poker runs license application. D. When application for a raffle or poker runs license is filed, such application fee is nonrefundable, even if the application is denied or in the event the raffle is cancelled for any reason. 4-6K-8: CONDUCT OF RAFFLES AND POKER RUNS: A. The operation and conduct of raffles and poker runs are subject to the following restrictions: 9 1. The entire net proceeds of any raffle or poker runs must be exclusively devoted to the lawful purpose of the licensee. 2. No person, except a bona fide member of the licensee, may participate in the management or operation of the raffle or poker runs. 3. No person may receive remuneration or profit for participating in the management or operation of the raffle or poker runs. 4. Raffle chances may only be sold, offered for sale, conveyed, issued, or otherwise transferred for value, during the time period, at the price specified and within the area specified on the license; 5. Raffle and poker runs winners shall be determined and announced at the date, time, and location designated in the application and on the permit. 6. No person under the age of 18 years may participate in the conducting of raffles or chances or poker runs without the permission of a parent or guardian. A person under the age of 18 years may be within the area where winning chances are being determined only when accompanied by his or her parent or guardian. 4-6K-9: RAFFLE MANAGER; BOND: All operation and the conduct of raffles shall be under the supervision of a single manager designated by the organization. The manager shall give a fidelity bond in an amount determined by the Raffle and Poker Runs Administrator in favor of the organization conditioned upon his honesty in the performance of his duties. Terms of the bond shall provide that notice shall be given in writing to the Village not less than thirty (30) days prior to its cancellation. The Raffle and Poker Runs Administrator may waive this bond requirement by including a waiver provision in the license issued to an organization under this Code, provided a license containing such waiver provision shall be granted only by a unanimous vote of the members of the licensed organization. Nothing in this Section shall be deemed to apply to poker runs. 4-6K-10: RECORDS TO BE KEPT: Each licensee shall keep records of its gross receipts, expenses, and net proceeds for each single gathering or occasion at which winning chances in a raffle or winning hands or scores in a poker runs are determined. A. All deductions from gross receipts for each single gathering or occasion shall be documented with receipts or other records indicating the amount, a description of the purchased item or service, or other reason for the deduction, to the recipient. B. The distribution of net proceeds shall be itemized as to payee, purpose, amount, and date of payment. C. Gross receipts from the operation of raffles and poker runs shall be segregated from other revenues of the organization and placed in a separate account. The person who accounts for gross receipts, expenses, and net proceeds from the operation of raffles or poker runs shall not be the same person who accounts for other revenues of the organization. D. Each licensee shall report promptly after the conclusion of each raffle or poker runs to its membership. Each organization licensed to conduct raffles or poker runs shall report 10 promptly to the licensing local unit of government its gross receipts, expenses, and net proceeds from the raffle or poker runs, and the distribution of net proceeds itemized as required in this Section. E. Records required by this Section shall be preserved for three (3) years, and organizations shall make available their records relating to the operation of raffles or poker runs for public inspection at reasonable times and places.
