MINUTES OF A REGULAR MEETING OF THE PRESIDENT ` s AND THE BOARD; OF TRUSTEES OF THE VILLAGE OF MORTONGROVE COOK COUNTY,' ILLINOIS, HELD AT THE (CHARD T. FLICKINGER MUNICIPAL CENTER APRIL 9, 2018 CALL TO ORDER I — Village President Dan DiMaria convened the Regular Meeting of the Village Board at 6:58 pm. V. in the Council Chambers of Village Hall and led the assemblage in the Pledge of Allegiance. VI. Village Clerk Eileen Harford called the roll. Present were: Trustees Bill Grear, Rita Minx, Ed Ramos, John Thill, Connie Travis, and Janine Witko. VII. APPROVAL OF MINUTES Regarding the Minutes of the Regular Meeting of March 26, 2018, Trustee Minx moved to accept the Minutes as presented, seconded by Trustee Thill. Motion passed unanimously via voice vote. VIII. IX. X. SPECIAL REPORTS NONE PUBLIC HEARINGS NONE RESIDENTS' COMMENTS (Agenda Items Only) NONE XI. PRESIDENT'S REPORT 1. Mayor DiMaria proclaimed April 27, 2018, as "Arbor Day" in the Village, and encouraged residents to plant trees to promote the well-being of present and future generations, and to support efforts to protect our trees and woodlands, as well as the Village's urban forestry program. He commented that Trustee Thill had reported at the March 26th Board Meeting that Morton Grove has been recognized as a 2017 "Tree City USA" by the National Arbor Day Foundation. This honor is brought to the Village as it meets several criteria of the XI. PRESIDENT'S REPORT (continued) Arbor Foundation for the distinction, including having a tree department, a tree care ordinance, a tree budget of at least $2.00 per capita, and Arbor Day observed and proclaimed. This is the 1thth consecutive year the Village has attained this status. 2. Mayor DiMaria complimented Village staff for doing a phenomenal job of getting funding for the Alternative Water Supply joint project with the Village of Niles. Staff was able to get a low interest loan from the Illinois Environmental Protective Agency. The loan is for $75 million at an interest rate of 1.76%. Mayor DiMaria was also pleased that Standard & Poor's has issued an 3. "AA" bond rating for the Village, which is considered "high grade." In addition, the mayor pointed out that per Redfin.com's article about "Urban Suburbs" on the rise, Morton Grove is rated in the Top 5. XII. XIII. Mayor DiMaria announced that the next Neighborhood Outreach would take place on Thursday, May 17, 2018 from 6:00 p.m. to 7:30 p.m. at the Civic Center, 6140 Dempster. He said this is a great opportunity to learn more about what's happening in the Village, to meet the elected officials and department heads, and to discuss issues and concerns one-on-one with the appropriate individuals. CLERK'S REPORT Clerk Harford had no report this evening. STAFF REPORTS A. Village Administrator: Mr. Czerwinski had no report. B. Corporation Counsel: Corporation Counsel Liston had no report. XIV. A. Trustee Grear: TRUSTEES' REPORTS Trustee Grear presented Resolution 18-21, Authorizing the Annual Memorial Day Parade and Closure of Dempster Street. He said that the Memorial Day Parade is a Morton Grove tradition. Annually a resolution (required by the Illinois Department of Transportation) is developed authorizing the parade and assuming full responsibility for the direction, protection, and regulation of traffic during the time the detour is in effect, and all liabilities for damages of any kind occasioned by the closing of said state route. This year the Parade is scheduled to be held at 1:30 p.m. on Sunday, May 27. 2 XIV. TRUSTEES' REPORTS (continued) A. Trustee Minx presented Resolution 18-22, Authorizing a Highway Authority Agreement and an Illinois Environmental Protection Agency (IEPA) Tiered Approach to Corrective Action Objectives and Supplemental Agreement Between Mr. Richard Fontagneres and the Village of Morton Grove Relating to the Property Located at 6238 Lincoln Avenue. She explained that Mr. Fontagneres owns the property at 6238 Lincoln Avenue. This property, at one time, had underground storage tanks on the site and contaminants were released from them into the ground. As the property owner, Mr. Fontagneres has the responsibility of removing these contaminants to IEPA standards. In order for him to receive a "No Further Remediation" letter from the IEPA, the agency requires Mr. Fontagneres and the Village to enter into a Highway Authority Agreement, which will limit access to the soil on an alley abutting 6238 Lincoln Avenue. c. The Agreement does not prohibit the Village from constructing, reconstructing, improving, repairing or maintaining the alley. The Agreement will be effective until the alley is proven to be suitable for unrestricted use and the IEPA issues a "No Further Remediation" letter. d. Trustee Minx said this resolution will also approve a supplemental agreement between the Village and Mr. Fontagneres, whereby Mr. Fontagneres will reimburse the Village for reasonable costs incurred in performing site investigations and to remove any contaminants. It further indemnifies the Village and holds it harmless for any loss associated with the release of contaminants or the existence of contaminants in the alley. TRUSTEES' REPORTS (continued) B. Trustee Minx: 2. Next, Trustee Minx presented Resolution 18-23, Authorizing the Purchase of One (1) 4X4 2019 Ford F350 XL Dump Truck with Snow Plow Through the Suburban Purchasing Cooperative Procurement Program. She explained that Public Works routinely review vehicles and equipment for fuel economy, safety, dependability, age, and excessive repair cost. This Resolution will authorize the purchase of a 2019 4x4 Ford F350 XL dump truck with snow plow from Landmark Ford of Springfield, IL. This purchase will replace a 2001 Ford F350 used by the Public Works Street Department, and will be done through the Suburban Purchasing Cooperative Procurement Program, an agency representing 143 municipalities. a. b. Trustee Thill announced that the Village and the Solid Waste Agency of Northern Cook County (SWANCC) are teaming up for a document destruction and electronics recycling event which will take place on Saturday, May 19, at the Civic Center from 9:00 a.m. to noon. People can drive up 2. and stay in their vehicles while a volunteer removes their documents or small electronics. For more details, visit SWANCC's website at www.swancc.orq or call 847-724-9205. E. Trustee Travis: 1. Trustee Travis reminded the assemblage to attend the upcoming Morton Grove Community Artist Performance, "Beyond Variety," sponsored by the Community Relations Commission. This event will be held on Saturday, April 14, at the Civic Center at 6140 Dempster. Doors open at 3:45 p.m. and the program begins at 4:00 p.m. Admission is free. Featured artists include the St. Martha Parish Choir, Morton Grove Women Who Drink Tea, Glenview Squares, Chicago Mask Ensemble, Ruben Zapata, Nicholas Barron, Emily Whitmore, Wandiann, Ginny Ching -Yin Lo, and others. 4 XIV. TRUSTEES' REPORTS (continued) E. Trustee Travis: 2. Trustee Travis reminded the assemblage that the Community Relations Commission's Spring Photo contest began April 1 and runs through June 1. More information can be found on the Village's website. 3. Trustee Travis noted that the Community Relations Commission is once again sponsoring the Adopt a Planter Program, which is open to individuals, families, businesses, and other groups. Anyone interested in adopting a planter needs to sign up by May 11; forms are available on the Village's website or at Village Hall. The Village provides each participant with a starter kit of approved plants, a name card, and instructions. The initial plantings will take place on June 9. Participants may incorporate additional plants at their expense. Participants will take care of their planter until October, although the Village will water the planters weekly. Photos of planters will appear on the Village website and Facebook page. F. Trustee Witko: 1. Trustee Witko reminded everyone that the Farmers' Market will be open on Saturday, May 12, for a Pre -Mother's Day Market at the Civic Center from 8:00 a.m. to 1:00 p.m. The regular season for the Market starts on Saturday, June 9, and continues through October 20. a. Trustee Witko encouraged residents to become a "Friend of the Market." She said people can learn more about supporting the Morton Grove Farmers Market on their website: http://mgfarmersmarket.com/markeffriends. XV. OTHER BUSINESS Mayor DiMaria announced that Poppy Days this year are May 17, 18, and 19 from 7:00 a.m. to 6:00 p.m. American Legion members will be on corners in the community collecting to support veterans. He asked that everyone consider giving generously to this worthy cause. XVI. WARRANTS Trustee Travis presented the Warrant Register for April 9, 2018 in the amount of $354,654.11. RESIDENTS' COMMENTS 1. a. b. XVIII. Rudy Vilk appeared before the Board, stating that, starting in November 2017, he had written several letters to Mayor DiMaria without receiving a response. However, Corporation Counsel Liston had called him and told him that the Village does not have an "obligation" to reply to let- ters. He felt that better communication is needed between residents and the Board, adding that he was writing about a Village problem, and wanted to receive answers by mail. Mr. Vilk felt that, if someone doesn't respond to a letter for three weeks or longer, that person should be dis- missed. Mayor DiMaria responded to Mr. Vilk, saying "You and I sat down together in my office and talked about this." He added that Village staff and Ms. Liston have all spoken with Mr. Vilk. Corporation Counsel Liston explained the issue. Mr. Vilk had received citations from Code Enforcement for property issues. He had a hearing, as was his right. The hearing officer ruled in favor of the Village. Mr. Vilk appealed to the Circuit Court of Cook County, which also ruled in favor of the Village. He has now appealed the matter to the Illinois Appellate Court. Because this is pending litigation, Ms. Liston said she counseled staff and Mayor DiMaria to offer no further response. SWANCC is a unit of local government and a non-profit corporation which was formed by 23 municipalities in northern Cook County in 1988. In 1999, SWANCC developed a long term plan to manage the region's garbage that is directed by the SWANCC Board of Directors. Each year, the Village appoints a Director and Alternate Director(s) to SWANCC to represent the Village's interest. The Village Board has selected Trustee John Thill as the Village's Director and Trustee Janine Witko and Village Administrator Ralph E. Czerwinski as its Alternate Directors. Czerwins Prepared by: !C Teresa Hoffman Liz on, Corporation Counsel Village Administrator RESOLUTION 18-24 APPOINTING A DIRECTOR AND ALTERNATE DIRECTOR TO THE SOLID WASTE AGENCY OF NORTHERN COOK COUNTY WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois, can exercise any power and perform any function pertaining to its government affairs, including but not limited to the power to tax and incur debt; and WHEREAS, the Solid Waste Agency of Northern Cook County (SWANCC) is a unit of local government and a non-profit corporation which was formed by 23 municipalities in northern Cook County in 1988; and WHEREAS, in 1999 SWANCC developed a long term plan to manage the region's garbage that is overseen by the SWANCC Board of Directors; and WHEREAS, the SWANCC Board of Directors is comprised of representatives of member communities including Morton Grove which are appointed by each community on a yearly basis; and WHEREAS, the President and Board of Trustees of the Village of Morton Grove wish to appoint Trustee John Thill as the Village's Director on the SWANCC Board of Directors; and appoint Trustee Janine Witko and Village Administrator Ralph E. Czerwinski as its Alternate Directors. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS: SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses into this Resolution as though fully set forth therein thereby making the findings as hereinabove set forth. and WHEREAS, 6301 Oakton Street is a 23.38 acre site, which is within a Cl General Commercial District and includes an existing home improvement center with associated parking areas and an outlot along Lehigh Avenue ("Subject Property"); and WHEREAS, on August 12, 2013 the Property Owner filed for and was granted a special use to allow for an Automobile Service Station Use to allow for a propane fueling station (Ord. 13-14); and WHEREAS, the 5.7 acre outlot on the eastem portion of the Subject Project is bordered by Oakton Street to the north, Lehigh Avenue to the East, the improved Menards home improvement facility to the west, and Kirk Street to the south, and, in accordance with the approved Special Use Permits, this outlot does not include any uses, structures, or site improvements, other than a stormwater detention area at the northeast portion of the property which is associated with the day-to-day operations of the outdoor sales and storage area of the home improvement center, the associated required parking facilities, or the propane fueling station; and WHEREAS, Section 12-4-3:D of the Village of Morton Grove Unified Development Code allows a Public Utility and Public Service Use to be located in the Cl General Commercial District pursuant to a special use permit; and WHEREAS, the DiMeo Brothers, a contractor hired by the Morton Grove Niles Water Commission ("Water Utility Contractor"), and the Property Owner (the "Applicants"), pursuant to Plan Commission Case PC18-06, has made proper application to the Village of Morton Grove for a minor amendment to the approved special use permits (Ord. 01-06, 05-08, and 13-14) to allow for a Public 1 Utility and Public Service use for a short-term storage yard to facilitate the construction of a new water supply system from Evanston to service the Villages of Morton Grove and Niles; and WHEREAS, the proposed use will be short-term in nature, from April 1, 2018 to March 31, 2019, in accordance with the lease agreement between the Applicants; and WHEREAS, as part of this short-term Public Utility and Public Service Use, the Applicant will be utilizing up to 1 acre of the outlot for the storage of pipe and stone and a limited number of vehicles as well as a construction trailer to facilitate the installation of the new public utility water lines; and WHEREAS, the Applicant will maintain a construction fence and all necessary erosion control measures to ensure construction debris does not encroach onto the adjacent public ways or into the required on-site stormwater detention area; and WHEREAS, upon completion of the lease term, the Applicant site will restore the outlot to previously approved conditions, in accordance with the controlling Site Plans and other conditions specified in the existing Special Use Permits (Ord. 01-06, 05-08, and 13-14); and WHEREAS, approval of this amendment and the operation of a Public Utility and Public Service Use will not change the intent of the approved Special Use Permits as the proposed short term use of a portion of the unimproved outlot will have its own dedicated vehicular ingress/egress and all improvements associated with this Public Utility and Public Service use will be removed within 12 months; and WHEREAS, pursuant to Ordinance 07-07 the Village adopted a Unified Development Code which set forth an abbreviated procedure for minor revisions to special use permits which allows for the granting of such amendments without a formal public hearing process subject to the recommendation for approval by the Village Administrator, Corporation Counsel, Building Commissioner, and the Acting Plan Commission Chairperson, and subsequent approval by the Village Board; Prior to commencing installation of any short-term site improvements, structures, trailers, utility services, etc., the Applicants shall have filed all necessary building and site engineering plans for review and approval by the Village, and shall have received all necessary building permits. 4. The Water Utility Contractor shall maintain all required construction and silt fencing and any other required erosion control measure, deemed necessary by the Village Engineer, throughout their use of the outlot. 5. The Water Utility Contractor shall improve and utilize no more than I acre of the outlot. If this area is expanded, Applicants will be required to comply with all additional local, state and federal environmental and engineering codes and regulations. 6. The Water Utility Contractor must locate the materials, trailers and vehicles on the site in a manner consistent with the submitted plan and must ensure clear access for all construction and emergency vehicles. Construction vehicles must not be queued onto adjacent public streets. 7. Material storage shall be limited to pipes, stones, and other similar material utilized for the installation of the new water line. No combustible materials or fueling station shall be located on site, without prior approval from the Village. 3 8.
