CALL TO ORDER
I — Village President Dan DiMaria convened the Regular Meeting of the Village Board at 7:00 pm.
V. in the Council Chambers of Village Hall and led the assemblage in the Pledge of Allegiance.
VI. Deputy Village Clerk Susan Lattanzi called the roll. Present were: Trustees Bill Grear, Rita Minx,
Ed Ramos, John Thill, Connie Travis, and Janine Witko. Mayor DiMaria noted that Clerk Eileen
Harford was absent with notice.
VII. APPROVAL OF MINUTES
Regarding the Minutes of the Regular Meeting of March 12, 2018, Trustee Minx moved to
accept the Minutes as presented, seconded by Trustee Thill. Motion passed unanimously via
voice vote.

XI. PRESIDENT'S REPORT
1. Mayor DiMaria proclaimed the month of April, 2018, as "Fair Housing Month" in the Village, not-
ing that the U.S. Fair Housing Law sets out a nation policy of fair housing without regard to race,
color, religion, sex, familial status, handicap, and national origin, and encourages fair housing
opportunities for all citizens. He added that the Village of Morton Grove welcomes the chance to
reaffirm a commitment to the principal of fair housing, and is committed to all efforts that address

discrimination in communities, support all programs that will educate the public concerning their
rights to equal housing opportunity, and to assure every person their right to live free of the fear
of housing discrimination.
2. Mayor DiMaria said that the Moretti's of Morton Grove held its Grand Opening on Tuesday,
March 27, after a number of "soft" openings. He encouraged everyone to visit Moretti's and
sample some of their excellent food—they're more than just pizza!

Mayor DiMaria announced that the next Neighborhood Outreach would take place on Thursday,
May 17, 2018 from 6:00 p.m. to 7:30 p.m. at the Civic Center, 6140 Dempster. He said this is a
great opportunity to learn more about what's happening in the Village, to meet the elected
officials and department heads, and to discuss issues and concerns one-on-one with the
appropriate individuals.

TRUSTEES' REPORTS
Trustee Grear announced that Mr. Joe Hedrick, representing American Legion Post 134, was
here tonight to present a check to the Morton Grove Days Committee for the upcoming festival.
As it happened, the Morton Grove Days President, Paul Minx, was also in attendance, so he
joined Mayor DiMaria, Trustee Grear, and Mr. Hedrick at the podium.
Mr. Hedrick presented a $4,000 check to President Minx, saying, "If we're (Post 134) not the
largest donor to this event, we're darned close!" Mayor DiMaria told Mr. Hedrick that he and the
members of the Legion Post exemplify giving back to the community.
Mr. Hedrick noted that Mayor DiMaria had attended the Legion's 99th Anniversary party, which,
he said, was a "dry run" for next year's 100th Anniversary party. Unfortunately, there were some
"hiccups" with this year's event, and Mayor DiMaria had to leave before he could make his
remarks. Mr. Hedrick said Post #134 still wants to hear the Mayor's speech!

American Legion Post 134 very much for this very generous donation.
2. Next, Trustee Grear presented Resolution 18-11, Authorizing the Execution of an
Agreement Between the Village of Morton Grove and North American Midway -All Star
Amusements, Inc. to Supply Carnival Rides and Amusements for the 2018 Fourth of
July Festivities.

He explained that the Village's Morton Grove Days festivities have included carnival rides and
related attractions for several decades. North American Midway -All Star Amusements of
Hoffman Estates, IL has provided carnival rides to the satisfaction of the Village in the past.
The contract provides that the Village, on behalf of the Morton Grove Days Commission, will
receive thirty percent (30%) of all receipts up to $224,999, and thirty-five percent (35%) of
receipts in excess of $225,000. These funds will be used to support other Morton Grove Days
expenses, such as fireworks, entertainment, and parade activities.
Trustee Grear said this contract is for a one-year term, with the option of extending it a maximum
of three additional times.

3. Trustee Grear then presented Resolution 18-20, Authorizing the Execution of an Agreement
Between the Village of Morton Grove and Mad Bomber Fireworks Productions to Supply a
Fireworks Display for the 2018 Fourth of July Morton Grove Days Festivities.
a. Trustee Grear said that, for several decades, the Village's Morton Grove Days festivities have
included a fireworks display. Mad Bomber Productions of Elgin, IL has provided fireworks dis-
plays in the past to the satisfaction of the Village. The contract provides a full-scale and safe
display for a fee of $20,000.
b. Trustee Grear said this contract is for a one-year term, with the option of extending it a maximum
of three additional times.
Trustee Grear moved, seconded by Trustee Witko, to approve Resolution 18-20.

1. Trustee Minx presented Ordinance 18-03, Approving a Special Use Permit For a Mixed Use
Development (Professional Office and Residential Uses) at 5711 Dempster Street,
Morton Grove, IL.
a. This is the second reading of this Ordinance.
b. Trustee Minx explained that this Ordinance will grant a Special Use Permit for a Mixed Use
Development at 5711 Dempster Street. This location requires a Special Use Permit per the
Village's Unified Development Code (UDC). The applicants are proposing to convert the former
first floor restaurant into professional office space and storage space, and have two dwelling
units on the second floor (one two-bedroom unit and the other a one -bedroom unit). This mixed
use requires seven (7) parking spaces, but a two -space waiver has been approved. This is the
maximum waiver that can be granted, because the UDC requires mixed use developments to
have at least 75% of their required parking on-site.

Trustee Minx noted that this was recommended for approval by the Plan Commission, adding
that the Traffic Safety Commission heard this proposal originally, before it was modified, and
approved it with conditions. The TSC Chairman has review the updated report and noted the
reduction in density and intensity, which was a positive change, and waived a second review
by the full Commission, subject to the applicants complying with any relevant conditions and
comments.

Next, Trustee Minx presented Resolution 18-17, Authorizing the Purchase of One (1) New
2018 Ford Expedition Through the Suburban Purchasing Cooperative Procurement
Program.
Trustee Minx said that Public Works routinely reviews vehicles and equipment for fuel economy,
safety, dependability, age, and excessive repair cost. Replacing or eliminating equipment that
no longer meets the department's needs with a more reliable, cost-efficient model, just makes
sense, and the Village, as a member of the Northwest Municipal Conference, can take
advantage of the Conference's competitive bidding process (the Suburban Purchasing
Cooperative Procurement Program) to make such purchases.
The new 2018 Ford Expedition will cos $40,338, and the funds will come from the Enterprise
Fund.

3. Trustee Minx then presented Resolution 18-18, Authorizing a Contract By and Between
the Village of Morton Grove and the Automobile Mechanics Union Local No. 701 for the
Period of January 1, 2018 Through December 31, 2020.
a. Trustee Minx said that, in 2004, the Mechanics and Maintenance Supervisor of Mechanics in
the Vehicle Maintenance Division of the Village's Public Works Department opted to join the
Automobile Mechanics Union Local #701. The Village and the Union have entered into additional
agreements to extend said agreement pursuant to Ordinance 06-30, Ordinance 09-09,
Ordinance 13-45, and Resolution 15-31.
b. This Resolution will approve a three-year contract extension with several modifications: 1) salary
and benefits for members of the bargaining unit will be consistent with those provided to non -
represented Public Works employees who do comparable work; 2) longevity pay benefits will be
consistent with the current eligibility requirement and benefit levels of non -represented Public
Works employees who do comparable work; 3) tool insurance coverage limit for employee -
owned tools lost due to a major break-in will be increased from $40,000 to $50,000; and 4) the
Village will create a new pay -band for the position of Crew Leader in accordance with Grade 57
for non -represented employees beginning January 1, 2019. The Village is under no obligation to
fill this position. This contract extension will expire on December 31, 2020.

4. Lastly, Trustee Minx presented Resolution 18-19, Authorizing the Execution of a Contract
With Schroeder & Schroeder, Inc. for the 2018 Concrete Replacement Program.
She explained that the concrete replacement program addresses concrete features disturbed by
utility repairs and deteriorated sections of sidewalk. This work should be completed in May 2018.
Additional work that emerges during Summer 2018 will be repaired in September 2018.
Trustee Minx said this contract was bid through a public process. The proposal amount is $9,000
more than the Engineer's Estimate of Cost.
The total contract amount is $165,000, but since this is a unit price contract, the final contract
amount will be based on the actual quantity of work performed.

Trustee Thill asked if Morton Grove went in on this type of work with any other communities, to
get a better price. Andy DeMonte, Director of Public Works, responded that the Village has tried
that in the past, but did not realize any significant savings from doing so.
C. Trustee Ramos:
Trustee Ramos had no report this evening.
D. Trustee Thill:
1. Trustee Thill announced that the Village had received a letter from the Arbor Day Foundation,
recognizing Morton Grove as a 2017 Tree City USA.
2. Trustee Thill said that the Morton Grove Fire Department received from Advocate Lutheran
General's Emergency Medical System a rating of #1 in return of spontaneous circulation (ROSC)
in their medical system, ahead of the surrounding communities in both 2016 and 2017. With a
45.5% average, the MDGD is significantly better than the 37.3% combined average of the other
departments, and it is almost double the 25% national average (per the National Cardiac Arrest
Registry). Trustee Thill said the Village can certainly be proud of this rating!

E. Trustee Travis:
1. Trustee Travis reminded the assemblage that the Community Relations Commission's Spring
Photo contest will begin April 1 and run through June 1. More information can be found on the
Village's website.
2. Trustee Travis noted that the Community Relations Commission is once again sponsoring the
Adopt a Planter Program. This program is open to individuals, families, businesses, and other
groups. Anyone interested in adopting a planter needs to sign up by May 11; forms are available
on the Village's website or at Village Hall. The Village will provide each participant with a starter
kit of approved plants, a name card, and instructions. The initial plantings will take place on
June 9. Participants may incorporate additional plants at their expense. Participants will take
care of their planter until October, although the Village will water the planters weekly. Photos of
planters will appear on the Village website and Facebook page.

3. Trustee Travis encouraged all to attend the Morton Grove Community Artist Performance,
sponsored by the Community Relations Commission. This event will be held on Saturday,
April 14, at the Civic Center at 6140 Dempster. Doors open at 3:45 p.m. and the program
begins at 4:00 p.m. Admission is free. Featured artists include the St. Martha Parish Choir,
Morton Grove Women Who Drink Tea, Glenview Squares, Chicago Mask Ensemble, Ruben
Zapata, Nicholas Barron, Emily Whitmore, Wandiann, Ginny Ching -Yin Lo, and others.

F. Trustee Witko:
1. Trustee Witko reminded everyone that the Farmers' Market will be open on Saturday, May 12,
for a Pre -Mother's Day Market at the Civic Center from 8:00 a.m. to 1:00 p.m. The regular sea-
son for the Market starts on Saturday, June 9, and continues through October 20.
a. Trustee Witko encouraged residents to become a "Friend of the Market." She said people can
learn more about supporting the Morton Grove Farmers Market on their website:

OTHER BUSINESS
Trustee Grear said that he had attended the ribbon cutting for the grand opening of Moretti's,
and owner Mark Hoffman gave some brief remarks at the ceremony, commending
Mayor DiMaria highly for being the catalyst that brought Moretti's to Morton Grove. Mr. Hoffman
also had glowing comments about Village staff. Trustee Grear said the Village owes many, many
thanks to its staff and to Mayor DiMaria.
Mayor DiMaria thanked Trustee Grear for his comments and noted that the achievement of a
Moretti's opening in Morton Grove was a true team effort. He commended Village staff on doing
an outstanding job.
Mayor DiMaria introduced Carlo Cacioppo and Boyle Wong, who produce the twice -monthly Vil-
lage Board meetings, including taping and editing, on their own time. Boyle is the Village's IT
department, while Carlo is a Niles resident who has volunteered for seven years for the Village of
Morton Grove, first with the Emergency Management Agency, and then assisting with the tech-
nical production of Morton Grove television programming through its public access channel.
Mayor DiMaria said that, many years ago, Mayor Richard Hohs referred to Morton Grove as a
"Village of volunteers," and said that countless Village residents have benefitted from Carlo's
selfless efforts to make the Morton Grove community a better place to live and raise a family.
Sadly, Carlo is relocating to the Rockford area and will no longer be able to assist Boyle with the
Board Meeting production. Mayor DiMaria told him that his positive attitude, consistent reliability,
and valuable technical expertise has truly made a difference to Morton Grove residents and will
not soon be forgotten. On behalf of the Board, Mayor DiMaria wished Carlo and his family good
luck and good health.

Joe Hedrick said that he usually has a conflict with Village Board meetings because of meetings
at the American Legion Post, so he was glad to be here tonight.
Mr. Hedrick said he serves on the Village's Police Pension Board, and noted that actuarial limits
have been changing, but the Village is at 53% in terms of pension funding. He suggested the
Village increase the pension amount to try to get above 53%, and thanked the Village for allow-
ing him to service on the Police Pension Board.

WHEREAS, in 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture that a
special day be set aside for the planting of trees; and
WHEREAS, this holiday, called "Arbor Day", was first observed with the planting of more
than a million trees in Nebraska; and
WHEREAS, Arbor Day is now observed throughout the nation and the world; and
WHEREAS, trees can reduce the erosion of our precious topsoil by wind and water, cut heating
and cooling costs, moderate the temperature, clean the air, produce oxygen, and provide a habitat for
wildlife; and
WHEREAS, trees are a renewable resource, giving us paper, wood for our homes, fuel for fires,
and countless other wood products; and
WHEREAS, trees in our Village increase property values, enhance the economic vitality of
business areas, and beautify our community; and
WHEREAS, trees, wherever they are planted, are a source of joy and spiritual renewal; and
WHEREAS, the Village of Morton Grove has been recognized as a Tree City USA by the
National Arbor Day Foundation and will continue to plant trees and enjoy them as a vital part of the
our community for generations to come.
NOW, THEREFORE, I, Daniel P. DiMaria, Mayor of the Village of Morton Grove, do hereby
proclaim April 27, 2018, as
ARBOR DAY
in the Village, and I urge all citizens to support efforts to protect our trees and woodlands and to
support the Village's urban forestry program, and
FURTHER, I urge all citizens to plant trees to gladden hearts and promote the well being of
present and fixture generations.

The Illinois Department of Transportation requires the Village to adopt a
resolution approving the closing of Dempster Street for the annual Memorial
Day Parade. This resolution will also authorize the Village Engineer to file an
application through the Illinois Department of Transportation for the actual
closing of Dempster Street, Route 58, from 12:30 pm to 4:30 pm on Sunday,
May 27, 2018, for the Parade which is scheduled to be held at 1:30pm on
Sunday, May 27.
The Memorial Day Parade is a Morton Grove tradition, and each year a
resolution is developed authorizing the parade and assuming full responsibility
for the direction, protection, and regulation of traffic during the time the detour
is in effect and all liabilities for damages of any kind occasioned by the closing
of said state route.

MEMORIAL DAY PARADE CLOSURE OF DEMPSTER STREET
WHEREAS, the Morton Grove Post #134 American Legion is planning a parade as part of an
annual celebration on Sunday, May 27, 2018; and

WHEREAS, the State of Illinois requires the Village to assume all responsibility and liability
involved in closing said State Route.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Resolution as though fully set forth therein thereby making the findings as hereinabove set forth.
SECTION 2: The Village Engineer will file an application with the Illinois Department of
Transportation for the closing of Dempster Street on Sunday, May 27, 2016, from 12:30 pm to 4:30 pm.
SECTION 3: The Village will assume full responsibility for the direction, protection and
regulation of traffic during the time the detour is in effect and all liabilities for damages of any kind
occasioned by the closing of said State Route. It is further agreed that efficient, all weather detours will be
maintained, conspicuously marked and judiciously police patrolled for the benefit of traffic deviated from

library on November 11, 2018. The Memorial Day ceremony will be held May 27, 2018 at the

statue. The return route is Georgiana to the post. The time of the Veterans day is leave the post
at 10:30 and return about 11:45. The Memorial Day will leave at1:30 and return about 2:30.

The Highway Authority Agreement to be approved pursuant to this resolution will limit
access to soil on an alley abutting 6238 Lincoln Avenue, which might be contaminated as a
result of underground storage tanks which are or were at 6238 Lincoln Avenue. The
supplemental agreement requires the owner/operator to indemnify and hold the Village
harmless from losses directly or indirectly arising out of or in connection with the release of
contaminants from the site or the existence of contaminants from the site and to reimburse
the Village
Mr. Richard Fontagneres owns the property located at 6238 Lincoln Avenue. At one time,
underground storage tanks were present at the site and contaminants were released from the
underground storage tanks. Mr. Fontagneres has the responsibility of removing these
contaminants to IEPA standards. In order for Mr. Fontagneres to receive a "No Further
Remediation" letter from the IEPA, the agency requires Mr. Fontagneres and the Village to
enter into a Highway Authority Agreement with respect to that part of the alley near Mr.
Fontagneres' site. The Highway Authority Agreement will prohibit potable and domestic
uses of ground water within the alley, limit access to the Village and others to the soil within
the alley with respect to conditions where human health and the environment are protected.
The Agreement does not prohibit the Village from constructing, reconstructing, improving,
repairing, or maintaining the alley. The Agreement shall remain effective until the alley is
demonstrated to be suitable for unrestricted use and the IEPA issues a "No Further
Remediation" letter. This resolution will also approve the supplemental agreement between
Mr. Fontagneres and the Village whereby Mr. Fontagneres will reimburse the Village for
reasonable costs incurred in performing site investigations and for costs incurred by the
Village to remove any contaminants, and will indemnify and hold the Village harmless for
any loss associated with the release of contaminants or the existence of contaminants in the
alley.

WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a
home rule unit of government under the provisions of Article 7 of the 1970 Constitution of the
State of Illinois, can exercise any power and perform any function pertaining to its government
affairs, including but not limited to the power to tax and incur debt; and
WHEREAS, Mr. Richard Fontagneres, also referred to in this Agreement as
owner/operator, is the owner or operator of the property commonly known as 6238 Lincoln
Avenue, Morton Grove, Cook County, Illinois (the site); and
WHEREAS, one or more leaking underground storage tanks presently are or formerly
were located on the site; and
WHEREAS, the owner/operator has completed an evaluation of the site and has
determined there is no risk to human health and the environment with the use of proper
institutional controls; and
WHEREAS, soil and groundwater contamination at the property boundaries may extend
into the right-of-way of the abutting alley north of the site; and
WHEREAS, the alley is under the Village's jurisdiction; and
WHEREAS, as a result of one or more releases of contaminants from the referenced
underground storage tanks, soil and/or ground water contamination at the site, it exceeds the Tier
One Residential Remediation Objectives of 35 Ill. Admin. Code Part 742; and
WHEREAS, the soil and/or ground water concentrations exceeding the Tier One
Residential Remediation Objectives extends or may extend into the Village -owned alley; and
WHEREAS, the owner/operator is conducting corrective action in response to the above
referenced releases; and
WHEREAS, the parties desire to prevent ground water beneath the Village's alley which
could exceed the Tier One Residential Remediation Objectives from use as a supply of potable
or domestic water and to limit access to soil within the alley which exceeds the Tier One
Residential Remediation Objectives; and
WHEREAS, Illinois Environmental Protection Agency has required the owner/operator
to enter into the attached Highway Authority Agreement with the Village of Morton Grove in
order to receive a closure letter; and
WHEREAS, the Highway Authority Agreement will protect human health and the
environment; and
WHEREAS, the Supplemental Agreement will reimburse the Village for any costs which
it incurs regarding the investigation or removal of contaminants, and will indemnify and hold the
Village harmless from any loss associated with the release of contaminants from the site or the
existence of contaminants in the alley; and
WHEREAS, the Corporate Authorities believe it is in the best interest of the health,
safety and welfare of the community to enter into these Agreements.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:

TIERED APPROACH TO CORRECTIVE ACTION
SUPPLEMENTAL RIGHT-OF-WAY AGREEMENT
This Agreement is entered into this day of , 20 by Richard
Fontagneres, referred to herein as "Owner/Operator," and the Village of Morton Grove
("Village"), as follows:
WHEREAS, Owner/Operator is pursuing corrective action at a site and in the right-
of-way adjacent to the site located at 6238 Lincoln Avenue in Morton Grove, Illinois ("Site")
and legally described in Attachment A; and
WHEREAS, attached as Attachment

WHEREAS, under 35 III. Admin. Code 742.1020, the use of risk-based, site-specific
remediation objectives in the right-of-way require entry of the Village into a Highway
Authority Agreement, in lieu of active remediation of the contaminant -impacted soil and/or
groundwater; and
WHEREAS, the Owner/Operator has requested that the Village enter into a Highway
Authority Agreement in the form prescribed by the Illinois Environmental Protection Agency,
set forth in Attachment D; and
WHEREAS, the Village, as a condition of entering into the Highway Authority
Agreement, requires certain covenants on the part of the Owner/Operator in exchange for
its agreement to execute that form;
NOW, THEREFORE, the parties agree as follows:
1. The Village agrees that it will prohibit by ordinance the use of groundwater as
required by Paragraph 7 of the Highway Authority Agreement. The Village further
agrees that it will limit access to soil as required by Paragraph 8 of the Highway
Authority Agreement.
a. Where the pavement in the right-of-way is to be considered an engineered
barrier, the Owner/Operator agrees to reimburse the Village for maintenance
activities requested by Owner/Operator. Except for ordinary maintenance
performed on Village roadways, the Village does not agree to maintain the right-
of -way, nor does it guarantee that the right-of-way will continue as a roadway or
that the right-of-way will always be maintained as an engineered barrier.
b. This agreement does not in any way limit the Village's authority to construct,
reconstruct, repair or maintain and operate a right-of-way upon the property
identified in the Highway Authority Agreement or to allow others to do the same.
To that extent, the Village reserves the right to identify, investigate, and remove
contaminated soil and/or groundwater above Tier 1 residential remediation
objectives from the right-of-way identified in the Highway Authority Agreement
and to dispose of them as it deems appropriate in accordance with applicable
environmental regulations so as to avoid causing a further release of the
contaminants and to protect human health and the environment. The Owner/
Operator shall reimburse the actual costs incurred by the Village or others in so
identifying, investigating, removing, storing, handling or disposing of
contaminated soil and/or groundwater, and it shall not be a defense for Owner/
Operator that those costs were not consistent with or required by Illinois Pollution
Control Board or United States Environmental Protection Agency regulations,
guidelines or policies. Prior to incurring any such costs, and unless there is an
urgent reason otherwise, the Village shall first give Owner/Operator thirty days
notice and an opportunity to remove or dispose of contaminated soil and/or
groundwater, at Owner/Operator's cost, to the extent necessary for the Village's
work. Such removal and disposal shall be in accordance with all applicable laws
and regulations. Failure to give this opportunity to Owner/Operator shall not be a
defense to a claim for reimbursement or that the work should not have been
done. There is a rebuttable presumption that the contamination found in the right-
of-way described in Attachment B arose from the release of contaminants at the
Site. Should Owner/Operator not reimburse the costs identified here, this
Agreement shall be null and void in addition to such other remedies as may be
available to the Village by law, and the Village shall void the Highway Authority
Agreement.
2. The Owner/Operator agrees to indemnify and hold harmless the Village, its agents and
employees, and other entities using the right-of-way by a permit issued by the Village,
for all obligations asserted against or costs incurred by them associated with the release
of contaminants of concern as described in Attachment C.
3. Violation of the terms of this Agreement by Owner/Operator, or its successor(s) in
interest, may be grounds for voidance of this Agreement, and voidance by the Village of
the Highway Authority Agreement.
4. No violation of a permit by a third party shall constitute a breach of this Agreement by
the Village. Owner/Operator also agrees that its personnel, if any, at the Site will
exercise due diligence in notifying those accessing contaminated soil in the right-of-way
of their rights and responsibilities under this Agreement.
5. Should the Village breach this Agreement, Owner/Operator's sole remedy is for an
action for damages in the Circuit Court of Cook County. Any and all claims for damages
against the Village, its agents, contractors, employees or its successors in interest or
others under permit from the Village arising at any time are limited to an aggregate
maximum of $20,000.00. No other breach by the Village, its successors in interest or
others under permit, of a provision of this Agreement is actionable in either law or equity
by Owner/Operator against the Village or them and Owner/Operator hereby releases the
Village, its agents, contractors, employees and its successors in interest, or others
under permit from the Village for any cause of action it may have against them, other
than as allowed in this paragraph, arising under this Agreement or environmental laws,
regulations or common law governing the contaminated soil or groundwater in the right-
of-way. Should the Village convey, vacate or transfer jurisdiction of that right-of-way,
Owner/Operator may pursue an action under this Agreement against the successors in
interest, other than the Village, or any of its departments, or State agency, in a court of
law.
1. This Agreement (including attachments, addendums, and amendments) shall run with
the land and be binding upon all assigns and successors in interest to the Owner/
Operator of the Site. The Owner/Operator shall cause copies of this agreement and the
executed Highway Authority Agreement to be recorded in the office of the Cook County
Recorder of Deeds in the chain of title for the Site within 30 days of execution.
2. This Agreement is not binding on the Village until it is executed by a duly authorized
representative of the Village, and prior to execution, this Agreement constitutes an offer
by Owner/Operator. The duly authorized representatives of Owner and Operator have
signed this Agreement, and this Agreement is binding upon them, their successors and
assigns.
3. Written notice and other communications relating to this agreement directed to the
