CALL TO ORDER
I & Village President Dan DiMaria called the meeting to order at 7:00 p.m. in the Council
II. Chambers of Village Hall. He then led the Board and assemblage in the Pledge of Allegiance.
III. Village Clerk Connie Travis called the roll. Present were: Trustees Bill Grear, Rita Minx,
John Pietron, Ed Ramos, John Thill, and Janine Witko.
IV. APPROVAL OF MINUTES
Regarding the August 8, 2016 Regular Board Meeting, Trustee Thill moved to approve the
Minutes as presented, seconded by Trustee Witko. Motion passed unanimously via voice
vote.

SPECIAL REPORTS
Plan Commission Case PC16-07 Requests a Plat of Vacation for an Approximately 256 Foot
Portion of a Public Alley Located South of Capulina, West of Ferris, and East of the Metra Rail
Line in Accordance with Section 12-9-5 of the Unified Development Code (UDC).
a. Community and Economic Director Nancy Radzevich presented this case to the Board. The
Applicant is the Village itself, requesting a Plat of Vacation for a portion of a public alley. Prop-
erties that immediately abut the proposed vacated alley to the east and west are vacant and are
owned by the Village. These properties were collectively identified as "Site B" in the Lehigh/
Ferris Framework Plan, adopted in January of 2009. The south edge of the proposed vacated
alley aligns with the northern property line of 6330 Lincoln Avenue. The remaining portion of the
alley, which abuts 8548 Ferris to the west and south, would be maintained as a public alley so
as to provide access for 6330 Lincoln and 8548 Ferris.
b. Ms. Radzevich said that the utility companies have been contacted as part of the process of
assessing the redevelopment of the overall site, but there is no immediate plan to relocate
utilities. This application is only for the vacation of this portion of the alley. She added that, since
this site is a municipally owned property, any redevelopment proposal by a private developer
would include a redevelopment agreement, which would likely deal with utility improvements.
The Plan Commission voted unanimously to recommend approval of this case.

PRESIDENT'S REPORT
Mayor DiMaria had two proclamations this evening:
1. The first proclaimed the week of September 17-23 as "Constitution Week" in the Village. He
noted that September 17 marks the two hundred twenty ninth anniversary of the drafting of the
United States Constitution by the Constitutional Convention. Mayor DiMaria asked all residents
of the Village to reaffirm the ideals held by the framers of the constitution in 1787 by attentively
protecting the freedoms guaranteed to us through this guardian of our liberties, remembering
that lost rights may never be regained.
2. The second proclamation sets aside September 21, 2016 as "A Day of Peace in Morton Grove."
Mayor DiMaria said the issue of peace embraces the deepest hopes of everyone in our
community and around the world, and remains humanity's loftiest goal and guiding inspiration.
The mayor said this proclamation is especially appropriate for Morton Grove, as it is one of the
most diverse communities around. He said he loved that so many different races and religions
call Morton Grove "home." Mayor DiMaria urged all residents and businesses to sponsor events
and activities that create a better understanding and appreciation for what peace can offer.
3. Mayoral Update
a. Mayor DiMaria encouraged everyone to attend the next Neighborhood Outreach, which will
take place on Wednesday, September 21, at 6:00 p.m. at Parkview School. He said this is an
opportunity for the neighborhood to come out and ask questions or share concerns with the
Village Board and Village staff. He said the Village has held several outreach sessions and
each one has been successful.
b. Mayor DiMaria commented that it's "back to school" time and said that, if our schools are
strong, our Village is strong. He congratulated Hynes School as being ranked as the #11 top
elementary schools in Cook County; and Niles North Dist. 219 and Niles West Dist. 219 as
being ranked #14 and #17, respectively of the top 20 high schools in Cook County.
c. Mayor DiMaria said that the Board attended a demolition for the redevelopment of
8700 Waukegan Road last week on September 8. He said this is the first step to revitalizing
the neighborhood at Waukegan and Dempster. The mayor said he was pleased that so
many residents and neighbors came to the demolition, even people who had initially been
apprehensive. He said the developer took a lot of time talking to people to answer questions
and address concerns, and it shows.

3. Mayoral Update (continued)
d. Mayor DiMaria congratulated the members of the Community Relations Commission on all their
efforts. The Commission has undertaken two photo contests, an initiative for residents to
"adopt" and maintain all of the 85 Village -owned planters, and this weekend, a community -wide
garage sale. He commended Chairperson Arcelia Pimentel on revitalizing the Commission.

CLERK'S REPORT
Clerk Travis also thanked Chairperson Arcelia Pimentel and noted that soon, the summer photo
contest winners will be posted on Facebook and at Village Hall.
Clerk Travis commented that over 80 households will be participating in the community -wide
garage sale. The sale will be on Friday, September 16; Saturday, September 17, and Sunday,
September 18, from 9:00 a.m. to 5:00 p.m. all three days. Maps are available on the Village's
website.
X. STAFF REPORTS
A. Village Administrator:
1. Village Administrator Czerwinski said that it's construction season and the Village is doing
infrastructure improvements. He said that he's very proud of the Public Works for the work they
are doing in rehabilitating the Meade -Moody sanitary sewer so that it functions properly.
a. When Public Works first took this on, they looked at how this could be accomplished, using
engineering to determine what could happen and to plan how to make this aging and deteriorat-
ing sewer right. Public Works came up with a plan to do this work in-house and brought it to
Mr. Czerwinski. Doing this project in-house will save the Village a tremendous amount of money
and a lot of time, and the end product is going to be fantastic.
b. Mr. Czerwinski said there are two sections to this sewer; the first section will be done this year;
the northern section will be done in the next fiscal year. He asked for a round of applause for
Public Works and Joe Dahm, who is leading this effort.
2. Mr. Czerwinski said that the Village's annual street resurfacing program has begun. All of the
streets are "rated" by Public Works, with the most critical streets being done first. Depending on
funding, the Village often has to make some hard decisions on which streets get done next—
generally the streets that are close to critical. He thanked engineering and Public Works once
again.
3, Next, Mr. Czerwinski stated that another thing that's taking up a considerable amount of admin-
istration and staff time in order to save the Village significant money is the alternative water
supply project. This is a cooperative effort between Niles and Morton Grove, and cooperation is
the only way to get a legacy project such as this accomplished. Both Villages currently get their
water from the City of Chicago, and the news reported recently that water rates are going up
again. Mr. Czerwinski said Chicago's water rates have increased 138% since 2008.

Village Administrator: (continued)
Niles and Morton Grove have decided that now is the right time to look for an alternate supply,
because this trend of rising water rates is only going to continue. They reached out to Skokie
and Evanston and are working collaboratively to reach an agreement to obtain water from the
City of Evanston. This is by no means guaranteed, nor is it even close to being ready for Board
approval at this point. Mr. Czerwinski said he just wanted to keep the Board up to speed on and
let them know that the Village is on the cusp of entering into a water supply agreement with the
City of Evanston, and on the cusp of entering into an agreement with Skokie to move water
through that village—either through a new pipe or a reconfiguration/realignment of existing
infrastructure.
b. What this means for Morton Grove is that, over a 40 year contract, the Village could save
$100 million dollars. That savings will go back into the Village's infrastructure to ensure that it
remains sound, solid, and secure. The Board—and residents—will be seeing more on this topic
in the months ahead. This possible solution is currently under review by all four communities.
4. Mr. Czerwinski said that, if residents were inconvenienced by construction on Beckwith Road, it
was because bridge repairs were being made and enhancements being done to maintain the
safety of the bridge.
5. Mr. Czerwinski reported that the results of the Village -wide emergency alert test that took place
on September 6 were good; only about 4% of the calls were not answered. He said the Village
did receive some calls inquiring about the test, and thanked Boyle Wong and Police Chief Simo
and the Fire Department for coordinating the flow of information. If any resident did NOT
receive the emergency alert test call, they should contact the Village to ensure that the Village
has their appropriate contact information.
6. On a different note, and somewhat different for the community, Mr. Czerwinski announce that
the Village is undertaking a "2016 Morton Grove Community Artist Performance Open Call."
This has been in the Village's e -newsletter and is on its website. He explained that basically the
Village is looking to partner with residents, to bring them into the Civic Center (after an audition)
to perform and present their abilities with artistic performances. There is an audition form on the
Village's website and applicants have until September 22nd to submit their form for an audition.
Once auditions are complete and performers have been selected, they will appear at a
performance at the Civic Center on October 29t.
a. Mr. Czerwinski said this is a whole new program for the community, and the Village has
reached out to local schools, including high schools/performing arts groups, and it'll be
interesting to see what kind of response this will engender. He said he could envision it growing
in the years to come.
7. Mr. Czerwinski said that another thing on peoples' minds is the experimental 90 -day traffic
modification at Beckwith and Shermer. The Village is trying to do something to make that inter-
section as safe as it can possibly be. Mr. Czerwinski said the Village administration realizes that
the intersection is challenging, noting that the intersection has been closed for the last 45 days.
That closure has gotten mixed reviews—some residents love it, others hate it.

The Village's challenge now is determining what the appropriate next steps should be. If the
Village does nothing, there will likely be continuing safety issues with the intersection. Village
staff gets together periodically to discuss issues, and Public Works will take the lead with this
one. But the closure will remain in place, at least through the end of this month, which would
make it a 60 -day trial period. The Board will then receive staff's report and recommendations,
and can then take action.
B. Corporation Counsel:
Corporation Counsel Liston had no report.
XI. TRUSTEES' REPORTS
A. Trustee Grear:
Trustee Grear had no formal report.
B. Trustee Minx:
1. Trustee Minx presented for a second reading Ordinance 16-19, Amending Title 10,
Chapter 5 of the Municipal Code Entitled "Property Maintenance Regulations" and
Deleting Title 10, Chapter 5, Article A Entitled "Vacant Buildings."
Trustee Minx explained that Village staff conducted a review of Title 10, Chapter 5, which sets
forth property maintenance regulations for all properties in the Village, as well as requirements
for the registration and maintenance of vacant properties. Based on this review, staff has
recommended five revisions to Chapter 5, including updating the definitions of vacant,
dangerous, and nuisance buildings; designating all persons or entities who have an ownership
interest in or a right to possess, control, or manage a property as being responsible for its
maintenance and repairs, and prohibiting the Village from issuing transfer stamps and permits
to any person who has unpaid property maintenance fines or obligations owed the Village for
violations or unsatisfactory conditions that have not been corrected.
Trustee Minx moved to adopt Ordinance 16-19, seconded by Trustee Pietron.
Trustee Grear thanked staff for this ordinance and asked if the initial registration fee of $500
noted in Section 10-5-5, C.1. was something new. Corporation Counsel replied that it was
not. Trustee Grear asked if the renewal fee of $100 in 10-5-5,C.2. was new. Mr. Czerwinski
responded that none of that was new; no fees changed; the Article was just streamlined and
clarified.

She said this Ordinance is pursuant to Plan Commission Case PC16-07, reported out earlier
this evening by Community & Economic Development Director Nancy Radzevich. The Plan
Commission unanimously recommended approval of this matter.
As this is a first reading, no action will be taken this evening.
C. Trustee Pietron:
1. Trustee Pietron presented Resolution 16-56, Authorizing the Purchase of a New Pan Tilt
Sewer Camera From Aries Industries, Inc.
a. He said that, under the newly mandated Metropolitan Water Reclamation District's Infiltration
and Inflow Program, the Village is required to have 10% of the total separated sewer area
(33,000 lineal feet) televised by July of 2019.
b. The Village received a quote for a camera purchase in the third quarter of 2015 from Aries
Industries, Inc. of $20,000, which the Village used in the 2016 Budget. However, the current
cost for this camera has increased to $22,560.09. Trustee Pietron said there are additional
funds available to cover this increase.
Aries Industries, Inc. is a Sole Source Vendor for this purchase.
Trustee Pietron moved, seconded by Trustee Minx, to approve Resolution 16-56.

2. Trustee Pietron then presented Resolution 16-57, Authorizing the Execution of a Contract
With Mauro Sewer Construction, Inc. For The Sites I & J Drainage Improvements Project.
a. He explained that the Lehigh/Ferris Framework Plan was adopted in 2008 to define an
implementable long-term vision for redevelopment within the Lehigh/Ferris Subarea.
Sites 1 and J are identified in the Framework Plan as property parcels bounded by the
river/railroad, Dempster Street, Narragansett Avenue, and Hennings Court. The Board
approved Resolution 16-05 in January of 2016, which authorized a task order for Ciorba Group
to complete design engineering for a storm sewer system to serve Sites I and J. This contract
was bid through a public process. The contract must conform to the requirements of the
Prevailing Wage Act. The lowest bidder is Mauro Sewer Construction, Inc. in the amount of
$429,838. These funds will be paid from the Lehigh/Ferris TIF Account.

3. Next, Trustee Pietron presented Resolution 16-58, Authorization to Negotiate and Execute
a Pipeline Easement Agreement With The Commuter Rail Division of the Regional
Transportation Authority (Metra) For Sites I & J Drainage Improvements Project.
He explained parts of the storm sewer construction project for Sites I and J are proposed to be
installed on the Metra right-of-way. Metra requires a pipeline easement agreement to establish
the terms and conditions that will authorize the Village to install, operate, and maintain the
storm sewer on Metra property. Metra charges a fee of $2,500 to prepare the pipeline
easement agreement; however, the agreement does not require the Village to pay Metra
periodic maintenance fees for this pipeline..
Trustee Pietron noted that the $2,500 pipeline preparation fee will be paid from the Lehigh/
Ferris TIF Account. He then moved to approve Resolution 16-58, seconded by Trustee Minx.

4. Trustee Pietron commented, regarding the Meade -Moody sanitary sewer project, that
Public Works is really going "above and beyond" on this project.
5. Trustee Pietron related that there was a business on Dempster Street that wanted to increase
its parking; if it couldn't, it would likely be leaving the Village. Mayor DiMaria visited the business
and the result is that the business has decided to stay in Morton Grove and is increasing the
size of its building. He complimented the Mayor for having a real impact on economic
development in the Village.
D. Trustee Ramos:

E. Trustee Thill:
Trustee Thill said that, at the 8700 Waukegan demolition event, Mr. Houseman commented that
he's been developing all over and he's never had such a wonderful working relationship with a
municipality or its staff as he has had with Morton Grove. Trustee Thill said, "This Board is
standing tall on the Department Heads."

XII. OTHER BUSINESS
Mayor DiMaria asked for a moment of silence for the victims of the 9/11 attack fifteen years
ago. It's become a tradition to remember them.
XIII. WARRANTS
1. Trustee Witko presented the Warrant Register for August 22 2016, in the amount of
$682,195.32. She moved that the Warrants be approved as presented. Trustee Thill, after
noting that this Warrant Register includes a $391,000 payment to the City of Chicago for water
(so what the Village is doing is necessary for the long term), seconded the motion.

WHEREAS, the Village of Morton Grove is committed to ensuring the safety and
security of all those living in and visiting Morton Grove; and
WHEREAS, fire is a serious public safety concern both locally and nationally, and homes
are where people are at greatest risk from fire; and
WHEREAS, U.S. home fires resulted in 2,745 civilian deaths in 2014, representing the
majority (84 percent) of all U.S. fire deaths; and
WHEREAS, three out of five home fire deaths result from fires in properties without
smoke alarms (38 percent) or with no working smoke alarms (21 percent); and
WHEREAS, all smoke alarms should be replaced once every ten years; and
WHEREAS, the age of a smoke alarm can be determined by the date of its manufacture,
which is marked on the back of the smoke alarm; and
WHEREAS, Morton Grove's residents are responsive to public education measures and
are able to take personal steps to increase their safety from fire, especially in their homes;
and
WHEREAS, the 2016 Fire Prevention Week theme, "Don't Wait - Check the Date!
Replace Smoke Alarms Every 10 Years" effectively serves to educate the public about the
vital importance of replacing the smoke alarms in their homes at least every ten years.
THEREFORE, I Daniel DiMaria Mayor of the Village of Morton Grove do hereby
proclaim October 9-15, 2016, as
FIRE PREVENTION WEEK
throughout this Village. I urge all the people of Morton Grove to find out how old the smoke
alarms in their homes are, to replace them if they're more than 10 years old, and to participate
in the many public safety activities and efforts of Morton Grove's fire and emergency services
during Fire Prevention Week 2016.

Morton Grove Police Department.
The Morton Grove Police Department currently requires police officers to furnish their
own duty handgun and related equipment along with extra magazines as a condition of an
officer's employment. There are currently weapons being used which are approaching the
end of their usefulness and reliability due to their age. This practice has also resulted in a
wide variety of makes, calibers, and models being carried by various members of the
department. Officers have also been responsible for the maintenance of their weapons and
to maintain their own maintenance records. The Police Department currently furnishes
practice and duty ammunition and due to the various makes, calibers, and models of
weapons being used the ammunition purchase becomes more expensive. For purposes of
consistency, the department desires to purchase and issue weapons to officers that are of
the same caliber and manufacturer which would mean only one type of ammunition will be
used and the responsibility for the weapon as well as the cleaning and maintenance would
be taken over by trained armorers thereby reducing liability exposure to the Village and its
individual officers in the event of a shooting. A request for proposal has been issued with
Acme Sports, Inc. of Seymour, Indiana being the lowest responsible bidder who will have
the ability to provide not only the requested weapons but the necessary training. The cost
for such purchase (with a trade in from weapons the department currently owns) will be
$48,405.00.

AUTHORIZING THE PURCHASE OF
SIG SAUER DUTY HANDGUNS AND ACCESSORIES
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois,
can exercise any power and perform any function pertaining to its government affairs, including but not
limited to the power to tax, purchase, and incur debt; and
WHEREAS, the Morton Grove Police Department currently requires police officers to furnish
their own duty handgun and related equipment such as holsters, weapon mounted flashlights, and extra
magazines as a condition of their employment, and some of these weapons are of such an age that they
are approaching the end of their usefulness and reliability; and
WHEREAS, this practice has resulted in a wide variety of makes, calibers, and models of
weapons being carried by members of the police department; and
WHEREAS, the individual officers are responsible for the maintenance of their weapons and to
keep their own maintenance records; and
WHEREAS, as the Police Department furnishes practice and duty ammunition, it would be more
efficient to only purchase ammunition in one caliber; and
WHEREAS, for purposes of consistency, the Police Department desires to purchase and issue
weapons (and related equipment) to the officers that are all of the same caliber and manufacturer. This
allows the police department to: (1) stock and use ammunition of only one caliber; (2) assume
responsibility for regular cleaning and maintenance of these weapons by training selected personnel as
armorers, thereby reducing liability exposure to the village and individual officers in the event of a
shooting; (3) full sized weapons would be issued to uniformed patrol personnel and compact models
would also be issued to plainclothes and administrative personnel for concealment purposes, and;
WHEREAS, the Police Department established a Research and Evaluation Committee which has
recommended the purchase of the following equipment for this project:
50 — Sig Sauer P320 9mm Full Size pistols with SIGLITE night sites
15 — Sig Sauer P320 9mm Compact pistols with SIGLITE night sites; weapon rail light equipped
50 — Surefire X300 weapon lights

Request for Proposal process resulting in three responses, and have selected Acme Sports, Incorporated
of 800 E. Tipton St., Seymour, Indiana 47274 as the preferred vendor because they quoted the lowest
price and have the ability to provide the above listed material and necessary training; and
WHEREAS, Acme Sports, Inc. has quoted a price of $48,405.00 for this purchase which
includes the trade in allowance; and
WHEREAS, the Police Department intends to use Seizure Funds to pay for this equipment; and
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS

SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Resolution as though fully set forth therein thereby making the findings as hereinabove set

This ordinance will approve the vacation of a portion of public alley located south of Capulina
Avenue, which is abutted to the east and west by municipally -owned properties in order to
further facilitate redevelopment of the overall site.
The Village of Morton Grove, the applicant and owner, filed an application to vacate an
approximately 256 ft. long portion of a public alley located directly south of Capulina Avenue,
west of Ferris Avenue and east of the Metra rail line. This portion of public alley is abutted to
the east and west by several municipally owned properties, which are collectively known as
"Site B" per the Village of Morton Grove Lehigh Ferris Framework Plan, dated January 27,
2009 (Ord.09-01). The Lehigh Ferris Framework Plan identified "Site B" as a potential
redevelopment site for higher density residential uses, based on its proximity to the Village's
proposed future downtown along Lincoln and Lehigh Avenues and the Morton Grove Metra
train station. The vacation of this portion of the public alley will allow for and better facilitate a
more comprehensive redevelopment plan for "Site B." The vacated alley will extend from
Capulina, to the north, to the northern edge of the adjacent 6330 Lincoln Avenue property. The
remaining portion of the alley will be maintained in order to allow for continued vehicular
access for 6330 Lincoln Avenue and 8548 Ferris Avenue.
The Plan Commission reviewed the application at their August 15, 2016 public hearing meeting.
Based on the application, supporting documents and testimony presented, the Plan Commission
voted unanimously (6-0, Khan absent) to recommend approval of the requested vacation of
public alley, with conditions.

WHEREAS, pursuant to applicable law, the Board of Trustees of the Village of Morton
Grove has the power and authority to vacate streets and alleys or portions thereof within the
jurisdiction of the Village; and
WHEREAS, on April 12, 2004, the Village Board adopted Ordinance 04-10 which
established a procedure to be followed for the vacation of streets and alleys; and
WHEREAS, the Village of Morton Grove has made a proper application to the Plan
Commission in the Village of Morton Grove under Case No. PC 16-07 requesting to vacate an
approximately 256 ft. long portion of a public alley located directly south of Capulina Avenue, west
of Ferris Avenue and east of the Metra rail line, and whereby the south edge of the vacated alley
aligns with the northern property line of 6330 Lincoln Avenue, in accordance with the plat of
vacation and legal description, prepared by Haeger Engineering, dated August 2, 2016, a copy of
which is attached hereto and made a part hereof and marked as "Exhibit A"; and
WHEREAS, the 4,096 sq. ft. subject property is 16 ft. wide and approximately 256 ft. long,
and is bordered to the east and west by vacant municipally -owned properties, with common
addresses of: 8550 Ferris Avenue, 8600 Ferris Avenue, 8602 Ferris Avenue, 8608 Ferris Avenue,
8612 Ferris Avenue, 8614 Ferris Avenue, 8618 Ferris Avenue and 8620 Ferris Avenue and which
are collectively known as "Site B", per the adopted Lehigh Ferris Framework Plan (Ordinance 09-
01); and
WHEREAS, the Lehigh Ferris Framework Plan identified "Site B" as a potential
redevelopment site for higher density residential uses, based on its proximity to the Village's
proposed future downtown along Lincoln and Lehigh Avenues and the Morton Grove Metra train
station; and
WHEREAS, the vacation of this portion of the public alley will allow for and better
facilitate the redevelopment of "Site B" by allowing for a comprehensive redevelopment plan of the
entire site; and
WHEREAS, pursuant to the applicable provisions of the Municipal Code, upon public
notice duly published in the Pioneer Press, a newspaper of general circulation in the Village of
Morton Grove which publication took place on July 28, 2016, and pursuant to the posting of a sign
on the property on August 5, 2016 and written notification sent to property owners within 250 feet
of the subject property on July 29, 2016 as required by ordinance, the Morton Grove Plan
Commission held a public bearing relative to the above referenced case on August 15, 2016, at
which time all concerned parties were given the opportunity to be present and express their views
for the consideration by the Plan Commission. And, as result of said hearing, the Plan Commission
made certain recommendations and conditions through a report dated September 2, 2016, a copy of
which is attached hereto and made a part hereof and marked as Exhibit "B"; and
WHEREAS, the Plan Commission considered all the evidence and testimony presented to it,
discussed the merits of the Application in light of applicable laws, including Section 12-9-5 of the
Unified Development Code, and voted to recommend approval of the vacation, with conditions; and
WHEREAS, pursuant to the provisions of the Village of Morton Grove Unified
Development Code, the Corporate Authorities have considered the report of the Plan Commission
and find the proposed vacation of a portion of this public alley is appropriate, in the public interest,
and in accordance with applicable ordinances of the Village of Morton Grove for a vacation of a
public right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance, as though fully set forth herein, thereby making the findings as
hereinabove set forth.
SECTION 2: The Corporate Authorities do hereby approve the application for PC 16-07,
request for approval of vacation of a public alley subject to the following conditions:
1. The final recorded Plat of Vacation shall be in accordance with the Plat of Vacation,
prepared by Haegar Engineering, dated August 2, 2016; and
2. The applicant or his/her successors shall comply with all applicable provisions of
Title 12, Chapter 9 regarding the content, submission, and recording of the plat of
vacation.
SECTION 3: The applicant or his/her successors shall file the plat of vacation with the
Recorder of Deeds of Cook County Illinois, on or before January 24, 2017, in accordance with
Section 12-9-5 of the Village Code.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law, and the applicant or his/her successors
has recorded the Plat of Vacation, in accordance with Section 12-9-5 of the Village Code, and
recorded this Ordinance with the Recorder of Deeds of Cook County, Illinois, and has provided the
evidence of such to the Village of Morton Grove.

Public Notice
The Village of Morton Grove provided Public Notice for the August 15, 2016 Plan Commission
public hearing for PC 16-07 in accordance with the Unified Development Code. The Pioneer
Press published the public notice on July 28, 2016, and the Village notified surrounding property
owners via mail on July 29, 2016 and placed a public notice sign on the subject property on
August 5, 2016.
Overview of the Application
The Village of Morton Grove is requesting approval of a Plat of Vacation for an approximately
256 ft. long portion of a public alley, located south of Capulina Avenue, west of Ferris Avenue,
and east of the Metra rail line.
The properties that immediately abut the proposed vacated alley to the east and west are
vacant, Village of Morton Grove municipally -owned properties. These properties were
collectively identified as "Site B" in the adopted Lehigh/Ferris Framework Plan, dated January
27, 2009 (Ord. 09-01). The south edge of the proposed vacated alley aligns with the northern
property line of 6330 Lincoln Avenue. The remaining portion of the alley, which abuts 8548
Ferris to the west and south, would be maintained as public alley.
August 15, 2016 Public Hearing
Mr. Dominick Argumedo, Zoning Administrator/Land-Use Planner, introduced the case and
summarized the Plan Commission staff report dated August 10, 2016, which was entered, in its
entirety, into the public record. (Attachment 1)
Commissioner Gabriel asked why the entire alley, from Capulina Avenue all the way to Ferris
Avenue, was not proposed for vacation.
Ms. Radzevich, Community and Economic Development Director, explained that only the portion
of the alley within the boundaries of "Site B" is proposed for vacation because the adjacent
properties at 8548 Ferris Avenue and 6330 Lincoln Avenue still need the remaining portion of
the alley for vehicular access.
Commissioner Shimanski asked if there are any utility improvements being made.
Ms. Radzevich responded the utility companies have been contacted as part of the process of
assessing the redevelopment of the overall site, but there is no immediate plan to relocate
utilities. This application is just for the vacation of this portion of the alley. Since this site is
municipally owned property, any redevelopment proposal by a private developer would include
a redevelopment agreement, which would likely deal with utility improvements.
Commissioner Shimanski moved to approve Case PC 16-07 an application for approval of a Plat
of Vacation for an approximately 256 ft. long portion of a public alley located south of Capulina
Avenue, west of Ferris Avenue and east of the Metra rail line with the south edge of the
proposed vacated alley aligning with the northern property line of 6330 Lincoln Avenue, in
accordance with Section 12- 9-5 of the Morton Grove Unified Development Code (Ordinance 07-
07) with the following conditions:
1. The Plat shall be recorded in accordance with Section 12-9-5:B.5 of the Unified
Development Code.

To prohibit parking adjacent to a commercial driveway at 8338 Austin Avenue.
The Traffic Safety Commission (TSC) received a request to enact parking restrictions
adjacent to a commercial driveway at 8338 Austin Avenue to increase safety of
exiting driveway movements by increasing the line -of -sight to oncoming Austin
Avenue traffic. TSC reviewed this request at their September 2016 meeting. The
Traffic Safety Commission recommends accepting the request in the petitioner's
application as presented. Village staff reviewed existing parking regulations in the
vicinity of Austin Avenue in order to determine the compatibility of the request
with the Village's existing on -street parking plan. Village staff found two parking
regulations in the Municipal Code that restrict parking at the same location on the
same side of the street and recommends the Municipal Code should be amended to
eliminate the redundancy.

AMENDING TITLE 5, CHAPTER 13, ARTICLE F,
SECTION 1 ENTITLED "NO PARKING STREETS"
OF THE MUNICIPAL CODE OF THE VILLAGE OF MORTON GROVE
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois,
can exercise any power and perform any function pertaining to its government affairs, including but not
limited to the power to tax and incur debt; and
WHEREAS, the Village established the Traffic Safety Commission to receive, review, and present
recommendations to the President and Board of Trustees regarding requests or inquiries on matters
involving traffic safety, including requests for installation of traffic control devices; and
WHEREAS, the Traffic Safety Commission received a request to enact parking restrictions
adjacent to a commercial driveway at 8338 Austin Avenue to increase safety of exiting driveway
movements by increasing the line of sight to oncoming Austin Avenue traffic; and
WHEREAS, the Traffic Safety Commission, at its regularly scheduled meeting held at 7:00 pm on
September 1, 2016, at the Richard T. Flickinger Municipal Center, considered the above referenced
request; and
WHEREAS, notifications of the meetings were sent to residents in the area; and
WHEREAS, the Traffic Safety Commission recommends accepting the request in the petitioner's
application as presented; and

price.
The Department of Central Management Services (CMS) administers the
Joint Purchasing Program for the State, and conducted a contract
reprocurement for the purchase of roadway salt from the period of December
1, 2016 to June 30, 2017. The Village has used state bidding process in the
past to secure needed roadway deicing material in sufficient quantities and at
a stable price. The State process allows the Village to purchase 4,000 tons of
rock salt from Compass Minerals America, Inc. at $42.46 per ton delivered.
This resolution will authorize this purchase.
Public Works and Finance Departments
The estimated contract value is $200,000.00. Since this is a unit price
contract, the final contract amount will be based on the actual quantity of salt
purchased (per ton cost $42.46). The Village must purchase a minimum of
80% of its order and can go as high as 120% at this cost.
Motor Fuel Tax fund
The implementation of the program will be done as part of the normal
operations of the Public Works and Finance Departments.

WHEREAS, the Village of Morton Grove (VILLAGE), located in Cook County, Illinois, is a
home rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, the State of Illinois Department of Central Management Services conducted a
contract reprocurement for the purchase of roadway salt for the period of December 1, 2016 to June
30, 2017; and
WHEREAS, the Village of Morton Grove has utilized the State biding process in the past for
the purchase of roadway salt; and
WHEREAS, the purchase price for the rock salt procurement from Compass Minerals America
Inc. is as follows:

was not provided for by this vendor in this season's procurement process.
You are responsible for issuing your own purchase order document to the vendor. Orders
may be placed with the vendor via telephone, with a written or fax confirmation to follow
immediately. You are strongly encouraged to order and store as much salt as possible
in order to help prevent potential salt shortages this winter. Also, you must place orders
in full truckload ( typically 22-25 tons ) delivery quantities or multiples of such.

Your governmental unit is responsible for ensuring that the 80 or 100 percent minimum
guaranteed purchase commitment (as noted on your Requisition) is met before the end
of the winter season, June 30, 2017. The vendor is required to furnish not less than 120
percent (if needed ) of the contract quantity by March 1, 2017. Your governmental unit
is responsible for processing vendor invoices in a timely manner.
Delivery shall be made as soon as possible after vendor receipt of order by phone or mail.
The maximum time from receipt of order to the actual delivery for orders placed between
December 1, 2016 through April 1, 2017 shall not exceed seven working days, unless as
modified in the Order Guidelines herein..
For orders placed between December 1, 2016 and April I, 2017, if a vendor is unable to
make delivery within the order timeline, local governmental units shall have the right to
retain as liquidated damages, not as a penalty, 5.% per working -day on the undelivered
portion of the order, but not to exceed 50.%. For orders placed prior to 9:00 a.m. on a
given day, that day to be considered as the first calendar day of the seven-day delivery
period. For an order placed after 9:00 a.m. on a given day, the following day shall be
considered as the first calendar day of the seven day delivery period.
CMS reserves the right to mitigate application of liquidated damages imposed against a
vendor, in the event of orders exceeding the maximum percentages outlined below:
An agency may order up to 20% of their awarded contract tonnage in any given week
and vendor shall deliver within 7 working -days after receipt of order. Quantity ordered
above the 20.% threshold shall have an extended deliver time of one -working -day for
each one -percentage -point above the 20.% guideline. For example, if an agency orders
25.% of their awarded total 100 ton, delivery of the first 20 ton ( 20.%) shall be within
7 working -days after receipt of order, the remaining 5 ton should be delivered within 12
working -days after receipt of order.
If after seven working -days of liquidated damages assessment, the vendor has still failed
to deliver, local governmental unit shall have the right to terminate an order and purchase
road salt or abrasives from another source, or take action consistent with public safety as
needed to continue daily business. Any and all additional costs incurred may be collected
from the original vendor, in addition to liquidated damages, by participant's legal action.
All deliveries shall be covered with approved weatherproof materials. The vendor shall
ensure that delivery person inspects the inside of the trailer and that all salt is removed
from the trailer before leaving a delivery point. The vendor will ensure all weights and
measures shown on delivery tickets are correct. Local governmental units reserve the
right to require that delivery trucks occasionally be directed to a scale in the vicinity of
the delivery point as a check on delivered truckloads.

Deliveries of rock salt containing any foreign material such as mud, rocks, grader teeth,
wood, tarpaulins, etc., may be rejected at the delivery site. In the event that any foreign
material is discovered in dumped deliveries, the salt and foreign matter may be reloaded
onto the cartage hauler's truck by the local governmental unit and returned for credit, or
the vendor shall immediately ship a specification compliant load of replacement salt, or
issue a refund to the governmental unit consistent with the contract price.
In December 2016, the contract vendor shall have in place stockpile(s) located in or near
Illinois covering the tonnage awarded for the northern regions of the State, and in January
of 2017 the contract vendor shall have in place stockpile(s) in or near to Illinois covering
the total tonnage awarded for all regions of the State. At our discretion, we will inspect
the stockpiles to ensure that these stockpiles are in sufficient quantities, and that vendor
commitments to the stockpiles are with the users of this contract.
Enhanced Rock Salt 2016-2017 season availability:
The Department of Central Management Services surveyed vendors for availability of an
enhanced rock salt option in the invitation for bid, and did receive an offering Compass
Minerals America Inc. Locations interested in this enhanced salt option must call the
vendor for availability information and to facilitate potential ordering arrangements.
Their product is made available to any joint purchasing participant awarded in Compass
Minerals America Inc. Contract as an up -charge per ton option and would be added to
your order as a separate line item. Contact Sean Lierz at 913-344-9330 for the details.
The enhanced salt product features additional pre-treatment of approved road salt with a
product providing enhanced melting performance, with reduced corrosion and clumping.

To vacate three permanent easements granted to the Village for public ingress and egress
within areas identified as focal point features included as part of the Final Plat of
Subdivision for The Crossings of Morton Grove recorded with Cook County on March 16,
2006 and subsequently authorize the Village Board to approve in substantial conformity the
attached Plat of Vacation (Exhibit "A").
The Crossings of Morton Grove is a planned unit development constructed by Toll Brothers,
Inc. between 2004 and 2014. It is located between the Metra tracks, Capulina Avenue,
Ferris Avenue and Hennings Court. Ordinance 05-28 granted a Special Use for the
Planned Unit Development and Ordinance 05-45 approved the final plat of subdivision
associated with the Special Use Permit. The final plat of subdivision grants three permanent
easements to the Village for public ingress and egress within areas identified as focal point
features. Village staff has evaluated the value to the Village of the three permanent
easements granted to the Village for public ingress and egress within areas identified as
focal point features and has recommended they should not be accepted by the Corporate
Authorities. Toll Brothers, Inc. will be responsible for administrative and financial duties
related to recording the plat of vacation by Cook County and returning a recorded original
Plat of Vacation to the Village.

ORDINANCE 16-22
AN ORDINANCE APPROVING THE PLAT OF VACATION FOR
THE CROSSINGS OF MORTON GROVE
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois,
can exercise any power and perform any function pertaining to its government affairs, including but not
limited to the power to tax and incur debt; and
WHEREAS, The Crossings of Morton Grove is a planned unit development located within the
Village of Morton Grove constructed by Toll Brothers, Inc.; and
WHEREAS, Ordinance 05-28 granted a Special Use for a Planned Unit Development of 65
townhomes at the property formerly known as 8710 Ferris Avenue and 8701 Lincoln Avenue; and
WHEREAS, Ordinance 05-45 approved the final plat of subdivision associated with the Special
Use Permit that was recorded with Cook County on March 16, 2006; and
WHEREAS, the final plat of subdivision depicts, reserves, and grants three permanent easements
granted to the Village for public ingress and egress within areas identified as focal point features; and
WHEREAS, Village staff has evaluated the value to the Village of the three permanent easements
granted to the Village for public ingress and egress within areas identified as focal point features shown
on the recorded final plat of subdivision and has recommended they should not be accepted by the
Corporate Authorities; and
WHEREAS, Toll Brothers will be responsible for all administrative and financial duties associated
with recording the plat of vacation with Cook County and returning a recorded original to the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Ordinance as though fully set forth therein thereby making the findings as hereinabove set forth.
SECTION 2: The Village President is hereby authorized to execute the Plat of Vacation in
substantial conformity with Exhibit "A" which is attached hereto and made a part hereof, and to take such
other and further steps as may be necessary to effectuate the intent of this Ordinance.
SECTION 3: This Ordinance shall be in full force and effect following recording of the Plat of
Vacation with Cook County by Toll Brothers, Inc. and receipt by the Village of one recorded original Plat
of Vacation.
