CALL TO ORDER
I & Village President Dan DiMaria called the meeting to order at 7:00 p.m. in the Council
11. Chambers of Village Hall. He then led the Board and assemblage in the Pledge of Allegiance.
III. Village Clerk Connie Travis called the roll. Present were: Trustees Bill Grear, Rita Minx,
John Pietron, Ed Ramos, John Thill, and Janine Witko.

a. Regarding the Minutes of the January 11, 2016 Regular Board Meeting, Trustee Thill
moved to approve the Minutes as presented, seconded by Trustee Witko. Motion passed
unanimously via voice vote.

VIII. PRESIDENT'S REPORT
1. Mayor DiMaria sought concurrence for his appointment of Arcelia Pimentel as a new member
and the new Chairperson of the Community Relations Commission. He said the Board had
copies of her resume and can see that she is well qualified and will bring a fresh perspective.
Trustee Pietron moved to concur with the Mayor's appointment, seconded by Trustee Witko.
Motion passed unanimously via voice vote.
VIII. PRESIDENT'S REPORT (continued)
2. Mayor DiMaria also sought concurrence with his appointment of Hanna Sullivan to the Fire-
fighters' Pension Board. Trustee Thill moved to concur with this appointment, seconded by
Trustee Minx. Motion passed unanimously via voice vote.
3. Mayor DiMaria said that all residents will be receiving a postcard from Village Hall sometime
over the next few weeks. The Village is asking residents to provide a land line or cell phone
number that's best able to reach them, so that, when and if an emergency arises, staff is able to
reach out them to make them aware of it and of any actions they need to take.
4. Another outreach effort is being undertaken by the Morton Grove Police Department, Mayor
DiMaria stated. This is a "satisfaction" survey and he hoped residents would provide feedback.
5. The Village will host a Neighborhood Outreach on March 16, possibly at Oketo Park field -
house, but Mayor DiMaria said that hasn't yet been confirmed. He said he would keep
everyone posted.
IX. CLERK'S REPORT
Clerk Travis, as the Board's liaison to the Community Relations Commission, welcomed Arcelia
and said she looked forward to working with her.
X. STAFF REPORTS
A. Village Administrator:
1. Village Administrator Czerwinski thanked Mayor DiMaria for his announcement about the post-
card Village Hall will be sending to residents. He encouraged residents to let Village Hall know
their home or cell phone number so they can be reached in emergency situations.

Mr. Czerwinski thanked the Police Department for undertaking a satisfaction survey, and also
congratulated Public Works on keeping things going during the recent cold snap. He said that
Public Works personnel handled 15 water main breaks during the cold snap. The assemblage
gave a round of applause to the fantastic members of the Public Works Department.
3. Mr. Czerwinski thanked Hanna Sullivan and said she really hit the ground running. He said the
Board made an excellent choice in hiring Ms. Sullivan.

Trustee Grear echoed the Village Administrator's accolades about Public Works and the Police
Department.

C. Trustee Pietron:
1. Trustee Pietron presented Resolution 16-05, Authorizing the Execution of a Task Order
With Ciorba Group, Inc. For Design Engineering Services for Sites I and J Development
Drainage Engineering Project.
He explained that the Lehigh -Ferris Framework Pian was adopted in 2008 to define an
implementable Tong -term vision for redevelopment within the Lehigh -Ferris Subarea. Sites 1
and J are identified in the Framework Plan as property parcels bounded by the river/railroad,
Dempster Street, Narragansett Avenue, and Hennings Court. The Metropolitan Water Reclama-
tion District (MWRD) requires a separate storm sewer system to service new development in
this area. It is in the Village's best interests, and consistent with its development code, to
construct this separate storm sewer system to service this and other future development in
this area.

Next, Trustee Pietron presented Resolution 16-06, Accepting the Public Improvements
Constructed as Part of the Lexington Station Development.
a. He explained that Lexington Station is a Planned Unit Development located within the Trafalgar
Square Planned Unit Development and within the Village of Morton Grove. Lexington Station
improvements included small areas of sidewalk and grassy parkway, short lengths of curb and
gutter, small asphalt pavement patches and parkway trees within the Village's right-of-way.
Construction work was completed in November 2015. The developer has provided the required
maintenance agreement for the repair or replacement of defective materials and workmanship
for two years from the effective date of the Village's formal acceptance of these improvements.

1. Trustee Ramos presented Ordinance 16-02, Amending and Restating the Village of Morton
Grove Retirement Plan, Effective January 1, 2016.
a. He explained that the Village of Morton Grove General Employees Retirement Plan provides
retirement benefits for employees other than sworn police officers and firefighters hired prior to
January 1, 2005 (employees hired after this date participate in the IMRF Retirement Plan). The
plan was initially established in 1965 and has been periodically amended since then. In order
to comply with changes within the Internal Revenue Code, and to continue to qualify under
Sections 401a and 501a of the Internal Revenue Code, the Village seeks to amend the plan,
and for convenience, has restated the plan to incorporate all previously -approved amendments.
These changes have been recommended by the Village's Special Counsel and must be
approved and submitted to the IRS prior to January 31, 2016. The IRS also requires that all
affected employees receive notice of these changes. The Village has subsequently applied for
and posted notice of these changes to the affected Village employees.

Because of the time constraints to file these changes, staff is requesting the second reading of
this ordinance be waived.

the amendment as an IRS user fee.

Next, Trustee Ramos presented Resolution 16-07, Authorizing the Execution of a Contract
With Lauterbach & Amen, LLP, For Actuarial Services for the Village of Morton Grove
Police, Fire, and Municipal Retirement Funds.
He said that State law and sound public financial accounting practices require the Village to
contract for actuarial services for its Police, Fire, and Municipal Retirement Funds. This allows
the Village to assess the assets, liabilities, and annual funding requirements of each pension
plan—asset values, liability projections, funding requirements for tax levy purposes, and other
information useful in properly managing and reporting the pension funds' financial performance.
Trustee Ramos said that the actuarial services are for a period of three years starting with the
fiscal year ending December 31, 2015 through the fiscal year ending in December 31, 2017.
Lauterbach & Amen's fees will be $9,375 for each year and will encompass all the above-
mentioned retirement funds.

F. Trustee Witko:
1. Trustee Witko presented Resolution 16-08, Authorizing a Contractual Agreement With
CDW-G to Provide for the Renewal of a Microsoft Enterprise Agreement for Microsoft
Software Licensing for Operating and Productivity Software for All Village Desktop
Computers.
a.
Trustee Witko said the Village is required to maintain licensing for the software it uses in daily
operations. The operating system, individual applications, and connectivity to servers all main-
tain their own licensing scheme. The Enterprise Agreement renewal includes an annual mainte-
nance support cost for updates and upgrades (Microsoft Software Assurance), as well as the
license costs. This type of agreement licenses the enterprise as an entire fleet as opposed to
individual purchases, and is advantageous in that it includes lower platform costs, distributed
payments, anniversary period renewals, and software upgrade assurances. The payment of
$39,691.60 for the 2016 licensing and software maintenance expense covers the license and
maintenance period of January 1, 2016 through December 31, 2016.

Trustee Witko announced that the Morton Grove Historical Society is working on a "historic
2. bungalow" initiative that would feature biking and walking tours. There will be a meeting about
this at the Historical Museum on February 11, 2016 at 6:00 p.m. For more information, contact

XIV. RESIDENTS' COMMENTS
1. Georgianne Brunner, representing the Morton Grove Days Commission, appeared before the
Board to announce that the dates of this year's festival are July 1 through July 4, 2016. She
said that, even though it's cold out, the Commission is in the midst of planning for this summer
event.
a. Ms. Brunner invited everyone to participate in the next Eat & Earn, which will be on
February 23 at Dengeos in Skokie, on Main and McCormick, between the hours of 10:00 a.m.
and 10:00 p.m. The restaurant will donate 20% of its dine -in, carry -out, and phone orders if you
mention the Morton Grove Days Fireworks. She encouraged everyone to keep watching the
Commission's website, Facebook page, and Twitter account for more updates about the event
and fundraising opportunities.

This resolution will authorize the 2016 Memorial Day Parade on Dempster
Street, Route 58, at 1:30 pm on Sunday, May 29, 2016, which will require the
closing of Dempster Street, Route 58, either partially or completely between
Austin and Ferris Avenues between 12:30 pm and 4:30 pm.
The Illinois Department of Transportation requires the Village to adopt an
ordinance approving the closing of Dempster Street. The resolution also
authorizes the Village Engineer to file an application through the Illinois
Department of Transportation for the closing of Dempster Street, Route 58, from
12:30 pm to 4:30 pm on Sunday, May 29, 2016, for the Annual Memorial Day
Parade.
The Memorial Day Parade is a Morton Grove tradition, and each year a
resolution is developed authorizing the parade and assuming full responsibility
for the direction, protection, and regulation of traffic during the time the detour
is in effect and all liabilities for damages of any kind occasioned by the closing
of said state route.

RESOLUTION 16-09
MEMORIAL DAY PARADE CLOSURE OF DEMPSTER STREET
WHEREAS, the Morton Grove Post #134 American Legion is planning a parade as part of an
annual celebration on Sunday, May 29, 2016; and
WHEREAS, the parade will commence at 1:30 p.m. and will require the closing of Dempster Street
for approximately two hours, either partially or completely between Austin Avenue and Ferris Avenue
between the hours of 12:30 pm and 4:30 pm; and
WHEREAS, the State of Illinois requires the Village to assume all responsibility and liability
involved in closing said State Route.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Resolution as though fully set forth therein thereby making the findings as hereinabove set forth.
SECTION 2: The Village Engineer will file an application with the Illinois Department of
Transportation for the closing of Dempster Street on Sunday, May 29, 2016, from 12:30 pm to 4:30 pm.
SECTION 3: The Village will assume full responsibility for the direction, protection and
regulation of traffic during the time the detour is in effect and all liabilities for damages of any kind
occasioned by the closing of said State Route. It is further agreed that efficient, all weather detours will be
maintained, conspicuously marked and judiciously police patrolled for the benefit of traffic deviated from
the State Route.

December 1, 2015
The American Legion Morton Grove Post 134 will hold its Veterans Day Parade on November
6, 2016 at the Library Doughboy Statue. The parade will leave the parking lot at the Morton
Grove American Legion Civic Center at 1:30PM. The route will cross Dempster at Georgiana,
go south to Crain, east to School, south to Lincoln, and west to the Library. After the
ceremony, the parade will form on Georgiana and march back to the Civic Center crossing
Dempster at about 2:30PM.
The Memorial Day Parade will be held May 29, 2016 using the same times and route as the
Veterans Day Parade.

As a member of the Northwest Municipal Conference, the Village takes
advantage of the Conference's competitive bidding process known as the
Suburban Purchasing Cooperative Procurement Program. A joint purchasing
program for local government agencies representing 143 municipalities.
To authorize the purchase of two 2016 4x4 Ford F-250 XL pickup trucks from
Currie Motors of Frankfort, Illinois. This purchase will replace a 1995 Chevrolet
van and a 2003 Ford F-250 pickup truck used by the Water/Sewer Department.
The Public Works Department routinely reviews vehicles and equipment for fuel
economy, safety, dependability, age, and excessive repair cost. Replacing or
eliminating equipment that no longer meets the department's needs.
Public Works and Finance Department
The vehicles replaced at this time are in the amount of $66,280.
Enterprise Funds (405033-572030)
The implementation of the program is done as part of the normal operations of
the Public Works and Finance Departments.

AUTHORIZING THE PURCHASE OF TWO 2016 FORD 4X4 F-250 XL TRUCKS
THROUGH THE
NORTH SUBURBAN PURCHASING COOPERATIVE PROCUREMENT PROGRAM
WHEREAS, the Village of Morton Grove (VILLAGE), located in Cook County, Illinois,
is a home rule unit of government under the provisions of Article 7 of the 1970 Constitution of
the State of Illinois, can exercise any power and perform any function pertaining to its
government affairs, including but not limited to the power to tax and incur debt; and
WHEREAS, the Suburban Purchasing Cooperative representing 143 municipalities

SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Resolution as though fully set forth therein thereby making the findings as
hereinabove set forth.
SECTION 2: That only those companies listed and described for the purchase of two
2016 Ford 4X4 F-250 XL be approved in this Resolution.
SECTION 3: The Director of Public Works and Finance Director of the Village of
Morton Grove are hereby authorized to execute the purchase of two 2016 Ford 4X4 F-250 XL
pickup trucks (one with a hydraulic tailgate) for a total amount of $66,280.00 from Currie

To authorize the Village Administrator to execute "Federal Financial Assistance Award of
Domestic Grant 16 -DG -I 14200004-006 between the Village of Morton Grove and the USDA,
Forestry Service Northeastern Area, State and Private Forestry" (Exhibit "A").
To accept a Federal Financial Assistance Grant for planting trees on rights-of-way and Village
properties.
The Village has an annual program to plant trees in the rights-of-way and on Village property
to replace trees lost to disease and development, based on available funding. The Village
applied for and has been awarded a Federal Financial Assistance Grant to purchase and plant
trees in the rights-of-way and oh Village property to replace trees lost to the emerald ash borer
infestation, and to decrease soil erosion, increase the absorption of rainfall, and decrease the
leaching of pollutants. The grant is in the amount of $50,000 and requires the Village to
contribute an additional $13,000 (which is allocated in the 2016 Adopted Budget). This
resolution will approve the Federal Financial Assistance Award Grant No. 16 -DG -114200004-

AUTHORIZATION TO EXECUTE AN AGREEMENT WITH U.S. FORESTRY SERVICE FOR A
FEDERAL FINANCIAL ASSISTANCE GRANT TO PLANT TREES
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home rule
unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois, can
exercise any power and perform any function pertaining to its government affairs, including but not limited
to the power to tax and incur debt; and
WHEREAS, the Village has an annual program to plant trees in the rights-of-way and on Village
property to replace trees lost to disease and development, based on available funding; and
WHEREAS, the Village applied for and was awarded a Federal Financial Assistance Grant in 2015
to purchase and plant urban tolerant trees in the rights-of-way and on Village property to replace trees lost to
the Emerald Ash Borer infestation; and
WHEREAS, these trees will help decrease soil erosion, increase interception of rainfall, improve
soils and decrease the leaching of non -point pollution; and
WHEREAS, the Financial Assistance Grant is made under the authority of the Cooperative Forestry
Assistance Act of 1978 ("Act") as part of the Great Lakes Restoration Initiative and administered through the
U.S. Department of Agriculture, Forestry Service; and
WHEREAS, one stated purpose of the Act is to help protect environmentally important forest lands
near population centers; and
WHEREAS, the financial assistance grant is in the amount of fifty thousand dollars ($50,000) and
requires a cost share of an additional thirteen thousand dollars ($13,000) to be provided by the Village for a
total investment in the Village's 2016 Tree Planting Program of sixty-three thousand ($63,000); and
WHEREAS, the funds will be spent on a contract to be completed by a contractor hired by the
Village who will furnish and install trees; and on a contract to purchase trees directly from a nursery which
will be planted by the Public Works Department; and
WHEREAS, approval of the attached "Federal Financial Assistance Award of Domestic Grant 16 -
DG -114200004-006 between the Village of Morton Grove and the USDA, Forestry Service Northeastern
Area, State and Private Forestry" (Exhibit "A") is required for the project to move forward.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Resolution as though fully set forth therein thereby making the findings as hereinabove set forth.
SECTION 2: The Corporate Authorities desire to accept this Financial Assistance Grant for the
purchase and planting of trees.
SECTION 3: The Village Administrator is hereby authorized to execute "Federal Financial
Assistance Award of Domestic Grant 16 -DG -114200004-006 between the Village of Morton Grove and the
USDA, Forestry Service Northeastern Area, State and Private Forestry" to accept the award.
SECTION 4: The Village Administrator, Director of Public Works and/or their designees are hereby

are 10.675 (Urban and Community Forestry). The Village of Morton Grove accepts this
award for the purpose described in the application narrative. Your application for Federal
financial assistance, dated August 18, 2015, and the attached Forest Service provisions,
`Forest Service Award Provisions,' are incorporated into this letter and made a part of this
award.
This authority requires a match of 50/50; however, a waiver has been granted for this
project. Your organization has agreed to meet a cost share of $13,000, as reflected in your
application, financial plan and narrative.
Based on email correspondence between Lori Gordon and Bill Burns dated December
21, 2015, the start date on the Application for Federal Assistance (SF -424) has been
changed to 09/01/2015.

from the Great Lakes Restoration Initiative. Any project completed in the field that will be
visible to the general public will require signage that gives project information and credit

A. COLLABORATIVE ARRANGEMENTS. Where permitted by terms of the award and
Federal law, The Recipient a may enter into collaborative arrangements with other
organizations to jointly carry out activities with Forest Service funds available under
this award.
B. FOREST SERVICE LIABILITY TO THE RECIPIENT. The United States shall not be
liable to The Recipient for any costs, damages, claims, liabilities, and judgments that
arise in connection with the performance of work under this award, including damage
to any property owned by The Recipient or any third party.
C. NOTICES. Any notice given by the Forest Service or The Recipient will be sufficient

4. Definitions. For purposes of this award term:
a. "Employee" means either:
(1) An individual employed by you or a subrecipient who is engaged in the
performance of the project or program under this award; or
(2) Another person engaged in the performance of the project or program
under this award and not compensated by you including, but not limited to,
a volunteer or individual whose services are contributed by a third party as
an in-kind contribution toward cost sharing or matching requirements.
b. "Forced labor" means labor obtained by any of the following methods: the
recruitment, harboring, transportation, provision, or obtaining of a person for
labor or services, through the use of force, fraud, or coercion for the purpose of
subjection to involuntary servitude, peonage, debt bondage, or slavery.
c. "Private entity":
(1) Means any entity other than a State, local government, Indian tribe, or
foreign public entity, as those terms are defined in 2 CFR 175.25.
(2) Includes:
i. A nonprofit organization, including any nonprofit institution of
higher education, hospital, or tribal organization other than one
included in the definition of Indian tribe at 2 CFR 175.25(b).
ii, A for-profit organization.
d. "Severe forms of trafficking in persons," "commercial sex act," and
"coercion" have the meanings given at section 103 of the TVPA, as amended
(22 U.S.C. 7102).
H. DRUG-FREE WORKPLACE.
1. The Recipient agree(s) that it will publish a drug-free workplace statement and
provide a copy to each employee who will be engaged in the performance of any
project/program that receives federal funding. The statement must
a. Tell the employees that the unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is prohibited in its workplace;
b. Specify the actions The Recipient will take against employees for violating that
prohibition; and
c. Let each employee know that, as a condition of employment under any award,
the employee:
(1) Shall abide by the terms of the statement, and
(2) Shall notify The Recipient in writing if they are convicted for a violation of
a criminal drug statute occurring in the workplace, and shall do so no more
than 5 calendar days after the conviction.
2. The Recipient agree(s) that it will establish an ongoing drug-free awareness
program to inform employ ees about
a. The dangers of drug abuse in the workplace;
b. The established policy of maintaining a drug-free workplace;

c. Any available drug counseling, rehabilitation and employee assistance
programs; and
d. The penalties that you may impose upon them for drug abuse violations

3. Without the Program Manager's expressed written approval, the policy statement
and program must be in place as soon as possible, no later than the 30 days after
the effective date of this instrument, or the completion date of this award,
whichever occurs first
4. The Recipient agrees to immediately notify the Program Manager if an employee is
convicted of a drug violation in the workplace. The notification must be in
writing, identify the employee's position title, the award number of each award on
which the employee worked. The notification must be sent to the Program
Manager within 10 calendar days after The Recipient learns of the conviction.
5. Within 30 calendar days of learning about an employee's conviction, The Recipient
must either
a. Take appropriate personnel action against the employee, up to and including
termination, consistent with the requirements of the Rehabilitation Act of 1973
(29 USC 794), as amended, or
b. Require the employee to participate satisfactorily in a drug abuse assistance or
rehabilitation program approved for these purposes by a Federal, State or local
health, law enforcement, or other appropriate agency.
I. ELIGIBLE WORKERS. The Recipient shall ensure that all employees complete the I-
9 form to certify that they are eligible for lawful employment under the Immigration
and Nationality Act (8 USC 1324a). The Recipient shall comply with regulations
regarding certification and retention of the completed forms. These requirements also
apply to any contract or supplemental instruments awarded under this award.
3. FINANCIAL STATUS REPORTING. A Federal Financial Report, Standard Form SF-
425(and Federal Financial Report Attachment, SF -425A, if required for reporting
multiple awards), must be submitted annually. These reports are due 90 days after the
reporting period ending December 31. The final SF -425 (and SF -425A, if applicable)
must be submitted either with the final payment request or no later than 90 days from
the expiration date of the award. These forms may be found at
www.whitehouse.gov/omb/grants forms.
K. PROGRAM PERFORMANCE REPORTS. The recipient shall perform all actions
identified and funded in application/modification narratives within the performance
period identified in award.
In accordance with 2 CFR 200 301, reports must relate financial data to performance
accomplishments of the federal award.

L. NOTIFICATION. The Recipient shall immediately notify the Forest Service of
developments that have a significant impact on the activities supported under this

notification must include a statement of the action taken or contemplated, and any
assistance needed to resolve the situation.
M. FREEDOM OF INFORMATION ACT (FOIA). Public access to award or agreement
records must not be limited, except when such records must be kept confidential and
would have been exempted from disclosure pursuant to Freedom of Information
regulations (5 U.S.C. 552). Requests for research data are subject to 2 CFR 315(e).
Public access to culturally sensitive data and information of Federally -recognized
Tribes may also be explicitly limited by P.L. 110-234, Title VIII Subtitle B §8106
(2009 Farm Bill).
N. TEXT MESSAGING WHILE DRIVING. In accordance with Executive Order (EO)
13513, "Federal Leadership on Reducing Text Messaging While Driving," any and all
text messaging by Federal employees is banned: a) while driving a Government owned
vehicle (GOV) or driving a privately owned vehicle (POV) while on official
Government business; or b) using any electronic equipment supplied by the
Government when driving any vehicle at any time. All Cooperatives, their Employees,
Volunteers, and Contractors are encouraged to adopt and enforce policies that ban text
messaging when driving company owned, leased or rented vehicles, POVs or GOVs
when driving while on official Government business or when performing any work for
or on behalf of the Government.
O. PUBLIC NOTICES. It is Forest Service's policy to inform the public as fully as
possible of its programs and activities. The Recipient is encouraged to give public
notice of the receipt of this award and, from time to time, to announce progress and
accomplishments.
The Recipient may call on Forest Service's Office of Communication for advice
regarding public notices. The Recipient is requested to provide copies of notices or

U. DISPUTES.
I. Any dispute under this award shall be decided by the Area Director. The Area
Director shall furnish The Recipient a written copy of the decision.
2. Decisions of the Area Director shall be final unless, within 30 days of receipt of the
decision of the Area Director, The Recipient appeal(s) the decision to the Forest
Service's Director, Acquisition Management (AQM). Any appeal made under this
provision shall be in writing and addressed to the Director, AQM, USDA, Forest

3. In order to facilitate review on the record by the Director, AQM, The Recipient

The Village has an annual program, dependent on funding appropriations, to

Works Department considers it to be cost-effective to hire a contractor to
furnish and plant those trees. This year, the Village solicited bids for the
purchase and planting of 190 trees which will be planted on Village property
and rights-of-way. Acres Group was the low bidder in the amount of
$36,465. Village staff has verified the contractor's qualifications and grant
funds will be used to pay for this work. The remaining funds from the
$50,000 grant and $13,000 Village match will be used to purchase trees
directly from a nursery which will be planted by Public Works' crews. The
bid tabulation is attached as Exhibit "A".

The estimated contract value is $36,465 for this portion of the 2016 Tree
Planting Program. Since this is a unit price contract, the final contract
amount will be based on the actual quantity of work performed. The
remainder of the funds will be spent directly by Public Works to purchase

WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of Illinois,
can exercise any power and perform any function pertaining to its government affairs, including but not
limited to the power to tax and incur debt; and
WHEREAS, the 2016 Tree Planting Program is an annual program designed to purchase and
install trees in the Village; and
WHEREAS, the Public Works Department advertised on the Village's website from January 12,
2016, through January 27, 2016, and by fax distribution to a list of tree nursery contractors inviting bids
for the "2016 Tree Planting Program"; and
WHEREAS, fifteen (15) businesses obtained the bidding materials; and
WHEREAS, six (6) bids were received, publicly opened and read at the Public Works Facility at
10:00 a.m. on Wednesday, January 27, 2016, with the tabulation of bids included in Exhibit "A"; and
WHEREAS, Resolution 16-11 accepted a Federal Financial Assistance Grant No. 16 -DG -
114200004 -006 which will help the Village replace trees in the rights-of-way and on Village properties
when such trees are lost due to disease and development in the amount of up to $50,000. It should be
noted the Village is required to provide a cost share in the amount of $13,000; and
WHEREAS, funding for the above work is included in the Village of Morton Grove 2016 Budget
as account number 025017-552240,Tree Replacement; and
WHEREAS, Public Works staff has verified the availability and qualifications of the low bidder,

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF

to the terms expressed in the Bond referring to these presents, the party of the second part agrees
with said party of the first part and his/their own proper cost and expense to do all the work, furnish
all materials and all labor necessary to complete the work in accordance with the Plans and
Specifications hereinafter described, and in full compliance with all of the terms of this Agreement
and the requirements of the Village under it.
3. And it is also understood and agreed that the -Notice to Contractors, General Provisions,
Special Provisions, Standards Specifications, Proposal and Contract Bond hereto attached, and the
Plans for the Village of Morton Grove 2016 Tree Trimming Program are all essential documents of
this Contract and are a part hereof.
4. IN WITNESS WHEREOF, the said parties have executed these presents on the
date above mentioned.
