CALL TO ORDER
Chairman Bloomfield called the Morton Grove Zoning Board of Appeals
to order at 7 :30 p.m.
APPROVAL OF MINUTES
Commissioner Kanzer made a motion for the approval of the minutes of
the August 23 , 1988 meeting as submitted. Commissioner Grand
seconded the motion. The motion was approved by a vote of Yes - 6 ;
No - 0; Absent - 1 .
CASE 1159
Chairman Bloomfield mentioned that Case 1159 , Wayne Gripman of 8224
N. Central , applicant , requesting variations from Sections 12-3-7C,
12-5B-3A, 12-5B-3B , 12-5B-4B (1 ) and 12-5B-4B (2) will not be heard
for the reason that the this case had been heard in February 1988 and
that it is extremely similar, therefore, the petitioner has to wait
for at least a year to be heard.

Lane.
Mr. Doyle the owner was present. He said that the plat of survey was
updated. The front yard is facing Palma with the following varia-
tions : front yard requested: 25 ' , proposed: 17 .071 , and variation re-
quested 7 . 93 ' ; side yard (facing Foster) requested : 25 ' , proposed
22 .74 ' after the fact , and variation requested 2 . 26 ' . Mr. McMahon
said that it should be the reverse. Foster Avenue should be the
front otherwise the backyard will not conform.
Chairman Bloomfield said that having observed the property and the
use of the deck , that his major concern at this time is that he wants
to assure that this deck remain a deck and never have any kind of
cover extended over a portion of this deck.
Commissioner Kanzer said that with the 2 ' height it blends in very
nicely and from the appearance standpoint it does not appear to be
requiring much of a variation. Mr. Doyle said that his son is a
landscaper and he will landscape the northside . They will put bushes
around so that the wood deck will be hidden.
Commissioner Brenner said that Mr. Doyle is in a unique situation,.
Because of miscommunication on his part and the Building Department
that caused the delay getting a permit. Commissioner Brenner said
she is considering this in favor of the applicant. Commissioner
Brenner commended the applicant ' s landscaping being done very nicely .
However , Commissioner Brenner said that she does not want this to
set a precedent. She wants the Commission to adopt a deck ordinance
to address this new trend in home building.
Commissioner Strybel said the first time he saw the property , it
seems that the front yard was turned into a backyard with the storage
of mats thrown up against the front window. Mr. Doyle said that was
only done because of the rain and that this is only temporary. Ccrr-
missioner Strybel disagreed since every time he has driven past , the
condition has remained the same.
Chairman Bloomfield called for any interested parties from the
audience. No one came forward. For the record, Chairman Bloomfield
indicated that the adjacent property owners were not present. All
neighbors were previously determined to be in favor of his request .

Commissioner Blonz said that he is familiar with the applicant .
However , Commissioner Blonz said that he agrees with the concerns of
Commissioner Brenner that the Commission does not start any prece-
dent of allowing decks in the front yard. Because of the uniqueness
of this case, Commissioner Blonz made a motion to accept this request
for variations from Sections 12-5A-4A and 12-5A-4B (2) as follows :
side yard required 25 ' ; proposed 17 .07 ' , and variation requested
7. 93 ' ; front yard required 25 ' , proposed 22. 741 , and variation re-
quested 2 . 26 ' . Chairman Bloomfield added that this deck remain a
deck without cover, that the deck should not be used a storage, and
that this variation is only for this deck and any other intrusion to
this yard would have to come back to this Commission. Mr. McMahon ,
Building Commissioner , said that any other structure added to this
case will have to apply for another variation and have to come back
to the Board.

Carole Heath, representing her mother Agnes B. Heath, and Joan Heath
Fortner were present .
Commissioner Brenner said the variations requested and those required
by the site plan submitted are inconsistent. Commissioner Kanzer
said that the applicant had expanded the length of the house, as well
as the width from the original proposal . Commissiorer Kanter men-
tioned thot the Commission had indicated to the applicant as what
would be acceptable. Commissioner Kanzer said that the house is
shown as 69 ' long.
Commissioner Strybel said that in the first meeting the applicant
was told that the proposed building for this property too big. The
applicant, Mrs. Fortner said that at that time they did not have the
blue print showing the 24 ' width, which is what they want. Commis-
sioner Strybel said he has yet to see a drawing of a smaller house on
this property.
Chairman Bloomfield said that Commissioner Kanzer did indicate to the
applicants the guidelines for the size of the house namely, that the
house should be a maximum of 50 ' in length and 24 ' in width. Chair-
man Bloumfield said the applicant has gone far beyond that and is
still asking for 5 ' variation in the front yard.

Chairman Bloomfield said that the applicant has the right to build on
this property, however, the Commission has the right to dictate
how much of the property will be covered and what variation will be
granted to the applicant. Chairman Bloomfield said that the ap-
plicant has not recognized that their lot is a substandard lot.

Kanzer said no variation should be granted at all . The applicant said

Commissioner Blonz said it is unlikely that this plan will work.
Commissioner Brenner suggested that it would be to the benefit of the
applicant to go to back their architect with the exact requirements
as presented to them by the Board.
Commissioner Kanzer stated that the applicant should abide by the that 50 '

Bill Pazen of 8206 Mango said his house is 27 ' x 371 .
Mr. Smedberg and Mr. Pazen , and other neighbors present expressed
concern over the alley being opened up.
Commissioner Brenner said that in the first meeting the applicant had
been asked to come back with the costs involved in opening the alley
and to talk to the public utilities such as Commonwealth Edison to
determine the cost involved. The applicant said that the Village
said it would cost $1 , 700 . 00 .

Mr. McMahon said that the alley in question is a dedicated alley so
that the public utilities will have a free access right away. The
Public Works Department will make improvement at the cost of the
resident. The Village will maintain the alley after it is con-
structed.
Commissioner Brenner said that the Commission does not usually extend
cases for three times, however, she would like to make this case an
exception. Commissioner Brenner then made a motion to allow the ap-
plicants to come back to the Commission for one more time with a
structure within the parameters that have been defined and specifi-
cally designed for this situation.
Commissioner Kanzer seconded the motion made by Commissioner Brenner.
The motion was carried by a vote of: Yes - 4 ; No -2 ; Absent -1 .

Chairman Bloomfield said that the case will be continued until Novem-
ber 21 . Chairman Bloomfield reminded the applicant that they need tc
go back to the architect and that they should bear in mind that they
have to keep the 3 ' side yard, maintain a 25 ' setback in front yard
and not to exceed 50 ' for the length of the building .
Mr . Scheck requested that the applicant submit their materials ahead
of time at least two weeks so they can be delivered on time to the
Commission.
Chairman Bloomfield said that the applicant should submit readable
materials and a minimum of ten (10) copies . Chairman Bloomfield
reiterated the case will be heard again on November 21 , 1988 .

the Village Code of Morton Grove to permit park-
ing in the Front Yard of Lots 7 , 8 and 9 :

The parcel is located in the M Limited Manufac-
turing District commonly known as 6201 Park
Avenue, 6301 Park Avenue, and 6325 Park Avenue.
Leonard Rose of 412 Sunset Drive , Wilmette , was sworn in . Mr .
Preves, the architect of the project also was present and said that
they have coordinated with the Village staff and Traffic Commission
and had submitted a revised plan eliminating the truck dock on the
LeHigh side and relocated these truck docks on the center of each
building with access from the Park Avenue. Mr. Preves also indicated
that on the revised plan, the driveway at the Park Avenue-River Drive
intersection was eliminated.
The applicant , Mr. Leonard Rose said that he prefers utilizing the
truck docks on the northside of the buildings fronting on Park Avenue
with direct access off of Park Avenue for maneuvering. Mr. Rose said
that the Village staff suggested we provide for on site truck tur-
naround rather than back trucks into the docks directly from Park
Avenue. Mr . Rose said this would reduce the amount of on-site park-
ing available for the project . Mr . Rose said that he agrees to
providing for on-site truck turnaround, however , if in the future,
additional on-site parking is required by the tenants , Mr. Rose asked
if he would be allowed to replace the truck turnaround with addi-
tional on-site parking .
Commissioner Blonz said that it would not be acceptable to grant the
request at this time, however, the applicant is allowed to come back
to the Zoning Board for a variance request when he feels it is
needed.
Chairman Bloomfield said that the applicant has the option to return
to the Zoning Board and ask for a reconsideration to change the area
to allow for additional parking spaces.
Commissioner Blonz asked how many times these truck docks will have
to be used. Mr. Rose indicated that each dock would attract ap-
proximately six trucks daily. The applicant said his son made an ex-
tensive survey on the issue of truck docks fronting on streets and
maneuvering trucks on the streets in the surrounding villages such as

Skokie, Niles, and Northbrook. The applicant said that in these vil-
lages the trucks are allowed to back into the industrial site from
the main street directly into truck docks.
Mr. Scheck said in his conversations with the Traffic Engineer of
Skokie, Fred Schattner and Eric Graepp, Village Engineer of
Northbrook, he was told there are exceptions such as small lots al-
lowing this practice, but with lots of 4 plus acres, there would no
reason for the design to require trucks to utilize the public street
to maneuver so that they can get in the loading area.
Mr. Leonard Rose said that they will agree to provide for on-site
truck turnaround, provided that in the future, if additional on-site
parking is required for the tenants, that they will be allowed to re-
place the truck turnaround with additional on-site parking.
Chairman Bloomfield called for any interested parties in the audience
to address the case. For the record, no interested parties were
present.
Chairman Bloomfield said that the applicant had submitted revised
site plans which satisfied the requirements of the Village staff. If
parking relief is required in the future, the applicant would have to
re-appear before the Board.
Commissioner Kanzer made the motion to approve the 20 ' variation re-
quested and to require that the development conform to the site plans
submitted as of 9/19/88 at the meeting. Commissioner Grand seconded
the motion.

The developer prefers utilizing the truck docks on the north side
of the buildings fronting on Park Avenue with direct access from
and into Park Avenue for loading and unloading. The Village
suggested we provide ,for on site truck turnaround rather than

Dear Leonard:
Pursuant to our recent conversation, I have contacted a number of
village officials and developers regarding the issue of truck
docks fronting on streets within industrial parks and the truck
maneuverability that is therefore typically required on the
street immediately adjacent to the dock area. I have spoken to
the building departments of Niles, Skokie, and Northbrook. All
three villages inform me that unless a building is located on a
busy street with high traffic levels, they would not be concerned
about such an arrangement. Wayne Hansen of the Village of Skokie
and Todd Bavaro of the Village of Niles indicated to me Chat
there are numerous buildings both of older and newer construction
that were designed in this fashion throughout their villages.
Wayne Hansen of the Village of Northbrook informed me that there
are numerous examples of this type of design throughout Sky
Harbor Industrial Park in Northbrook, which is a relatively new
park developed in the late 1970's.
In addition to these villages, I spoke to several large
developers to get their perspective on the positions of various
municipalities on this issue. Pete Barber, Vice President of
Real Estate of Opus Corporation told me that his experience on
this issue has been that villages only seem to have strong
concern when trucks are backing into high traffic streets. Les
Korman of Korman/Lederer Associates informed me of the numerous
buildings they have developed both in Northbrook and Wheeling
which often have trucks maneuvering on the street adjacent to the
loading area and informed me that they have not encountered a
great deal of resistance from the villages that they have dealt
with. He also indicated that sometimes villages will insist on
this issue in an effort to discourage development. He cited the
Village of Schaumburg as such a village that feels pressure from
the over-development of the area.

Based on my conversations with these various parties, and my own
experience as an industrial broker working throughout the Chicago
metropolitan area, I have difficulty understanding why the
Village would indicate such strong concern about a truck
maneuvering on Park Avenue, a 300 yard long street, which
certainly is not a main thoroughfare and is likely to experience
little traffic except from those vehicles coming from the
proposed development itself. Because of the high expense of land
at North Grove Corporate Park and the need for every possible
parking space that can possibly be created, I highly encourage
you to do your best to urge the village to reconsider its
position on this issue.

Leonard Rose , developer of North Grove Corporate Center and
Richard Preves, architect, appeared before the Commission to dis-
cuss the subject project . Mr. Preves had provided CopieS of
plans to the Community Development Department for prior distribu-
tion to the Commmission. It was determined that the site plans
distributed were identical to the one submitted to the Zoning
Board of Appeals.

Mr. Preves then provided revised site plans for review by the
Traffic Safety Commission. After discussion, the Commission
identified the comments and concerns listed below:
1 . The truck docks , relocated to face Park Avenue, still re-
quire all truck manuevering to be completed on public street
rather than private property. This creates a substantial
safety hazard which should be eliminated by redesigning the
site plan.
2 . The double entrance on Park Avenue should be eliminated in
favor of a single entrance and/or modified to provide for
one way movement on each side of the center island. If the
modified split entrance is maintained, the driveway areas
must be reduced in size to 24 feet on each side.
3 . The Morton Grove Fire Department should review access to the
south side of each proposed structure.
4 . The driveway openings onto both Lehigh Avenue and River
Drive should be reduced in width to 24 feet, allowing for a
slight increase in parking adjacent to them.

The applicant indicated that revised plans incorporating the com-
ments noted above would be available for distribution to the
Zoning Board of Appeals by September 13. Please contact me im-
mediately if clarification of any of the comments is required.

reduce the amount of the on site parking available for the

If the Village Board will not allow us to back trucks into the

sent so that plans will be received by the Board in advance of to the
meeting.

Mr. Doyle asked for continuance of the case as he was not able to
secure a plat of survey. He was told by the surveyor that it takes
about seven 'weeks to make the plans. Commissioner Strybel asked if
they tried to contact the original builder. Mr. Doyle said they
tried to locate the builder with the help of Mr. McMahon, but could
not find the plat of survey. Commissioner Ranzer asked if the
petitioner has plans to scale back the deck in the front to conform
with the Village Code.
Commissioner Bloomfield said that the survey is necessary in order to
verify the exact variation requests. Mr. Doyle stated that on the
front he is encroaching into the front yard by 2 feet 4 inches but
contends that the deck is still symmetrical as the building site.
Commissioner Ranzer said that in order to clear the controversy , the
petitioner will have to secure a survey so he will know the relation-
ship of his building and the deck with the property lines.
Chairman Bloomfield asked for the continuance of the case. Commis-
sioner Brenner made a motion for the case to be continued to the next
meeting which was seconded by Commissioner Ranzer.

APPLICANT: Leonard H. Rose
PROPERTY LOCATION: 6244 Oakton Street
PETITION : Requesting a variation from Section 12-7A-4A of
the Village Code of Morton Grove to permit park-
ing in the Front Yard of Lots 7, 8 and 9 :
Front Yard :

The parcel is located in the M Limited Manufac-
turing District commonly known as 6201 Park
Avenue, 6301 Park Avenue, and 6325 Park Avenue.
Mr. Preves, the architect of the applicant , Leonard Rose , was sworn
in . He said that the reason for the variation request relates to the
size and shape of the lots -- shallow and long. The owner is trying
to make this a commercially viable project and needs to get a cer-
tain amount of building on this property while still complying with
the requirements of the Morton Grove Ordinance. Generally, the two
buildings proposed are identical to each other (approximately 47 ,000
square feet ) , and will be for mixed use of small offices and
warehousing . He said there will be a 5 foot strip of landscaping on
the north property line along Park Avenue. The landscape plan
originally showed the 5-foot landscaped strip along the south
property line. This has been moved to the north property line along
the Park Avenue right-cf-way, and an additional 5-foot landscaped
strip will be constructed on the property south of the subject par-
cel , which is also owned by Mr. Rose.
Chairman Bloomfield asked if they are retaining the sidewalk along
Park Avenue. The architect said yes and extra planting will be made
in the public parkway area.
Mr. Scheck said that he made comments on the original submission that
had not been addressed. The first concern is the dual entrance or,
Park Avenue which is not acceptable from a traffic engineering point
of view. There are too many conflicts on Park Avenue. Converting
the central driveway to a single entrance would allow for extending
the parking bays , while minimizing the conflicts.
Chairman Bloomfield said it might be a possibility that if the middle
section is redesigned , the west building could be moved so that there
might be plenty of room for the parking area.
Commissioner Strybel expressed a concern over the ability of a semi-
truck to manuever inside the property line rather than make turning
movements on the street.

Commissioner Brenner questioned as to what activities will go inside
the premises that will require the large amount of additional parking
over that which is required by the ordinance. Mr. Preves said that
the 175 parking spaces are for the benefits and convenience of the
tenants in the building.
Commissioner Karp asked if there were questions from the Engineering
Department. Mr. Scheck said that they are of developmental nature
related to building permit issuance, but those which related to traf-
fic issues do affect the site design and need to be addressed.
Chairman Bloomfield said this case will have to go back to the staff
for further review. Commissioner Kanzer said that there are too many
questions unanswered at this point for 25 ft. variation request.
Commissioner Brenner made a motion to continue the case until next
month for further input and exploration by staff and the Traffic
Safety Commission. It was seconded by Commissioner Kanzer.
The motion was carried by a vote of: Yes - 7; No - 0; Absent - 0 .

The Zoning Board of Appeals met on August 23 , 1988 to review
your request for front yard parking on the parcels commonly known
as 6325 Park Avenue, 6301 Park Avenue, and 6201 Park Avenue.
During the discussion with your architect, Mr. Richard Preves,
two issues were raised which require additional consideration on
your part:
1 . The double two-way driveways off-of Park Avenue were
described by Community Development staff as dangerous and
inviting accidents.
2 . Possible relocation of the east structure farther off-of
Lehigh Road was suggested by a Commissioner.
The Zoning Board of Appeals voted to continue this case to the
September 19 , 1988 meeting to allow for further review by your
staff and by the Traffic Safety Commission of the Village of
Morton Grove. I am asking that twelve (12) sets of the revised
site plans be forwarded to the Department of Community Develop-
ment for distribution to the Traffic Safety Commission.
Materials will be distributed to the Commission on September 2
for its meeting on September 10, and your cooperation in

Parking:
1 . Although "Sheet 1 , Site Plan and Elevation" indicate that
"Actual Parking" ( 175 spaces) greatly exceed the "Required
Parking" ( 135 spaces) , there is no additional information to
allow the verification of required parking. Gross building area,
area devoted to warehousing, area devoted to offices, and dock
and traffic-way area should be identified. This will allow the
appropriate minimum parking requirements to be applied to
determine the "required parking" . At present, a rough
calculation of the parking density shows one ( 1 ) space per 567
square feet.
This information is necessary for review of this project since
the provision of parking may dramatically affect the size and
location of structures.
2. Parking bay and aisles on the west side of the parcel do not
meet existing on proposed zoning ordinance requirements.

Lighting:
A photometric analysis must be submitted. The ordinance
requirement for parking area lighting is one ( 1 ) foot-candle on
the surface of the lot .
Landscaping:
1 . The parking lot landscaping ordinance requires that a minimum
five ( 5 ) foot landscaped strip be included along public
rights-of-way, with a minimum of one ( 1 ) tree per forty ( 40 ) feet
of right-of-way, and a dense planting of shrubbery. According to
the current site plan, there is no landscaping strip provided
along Park Avenue.
2. The ordinance also calls for one ( 1 ) tree per eighty ( 80 )
feet along other property lines. The current site plan shows a
five (5) foot landscaped strip along the south property line.
3. The ordinance calls for a maximum of twenty ( 20) parking
stalls per bay, interrupted by a landscaped island containing a
tree and shrubbery. Landscaped islands are provided for,
however, the islands should be slightly moved to accommodate the
twenty (20 ) space per bay provision.

4 . The recommendation is made that the five ( 5) foot landscaped
strip be moved from the south property line to the Park Avenue
right-of-way. A detailed landscape plan must be provided showing
planting locations and plant lists.
Access:
1, The driveway at the Park Avenue - River Drive intersection
must be eliminated for safety considerations.
2. The driveway at the southeast corner of the property onto
Lehigh Avenue must be eliminated -- traffic safety consideration.
3. The double driveway onto Park Avenue must be combined to a
single driveway for traffic safety considerations.
General Commentary:
1 . From an aesthetic viewpoint, facing the truck docks to the
center drive area would be much superior to their being viewed
from the public right-of-ways.
