During the Regular Meeting of the Village Board of Trustees held on November 10, 2014,
Trustee Marcus moved to adjourn to Executive Session to discuss pending litigation,
personnel, real estate matters, and review of Executive Session minutes. The motion was
seconded by Trustee Toth and approved unanimously pursuant to a roll call vote at 6:01 p,m.
Present were: Trustees Bill Grear, She[ Marcus, John Pietron, John Thill, Maria Toth, and
Janine Witko. Staff present included Village Administrator Ryan Horne and Corporation
Counsel Teresa Hoffman Liston.

At the conclusion of the meeting, Trustee Toth moved to adjourn the Executive Session and
reconvene the regular Board meeting in the Council Chambers at 7:00 p.m. The motion was
seconded by Trustee Witko and approved unanimously via a voice vote at 6:58 pm.

Regarding the Minutes of the Special Meeting of October 18, 2014, Trustee Grear moved to
accept the Minutes as presented, seconded by Trustee Witko. Upon the voice vote, the
motion passed unanimously.
Regarding the Minutes of the October 27, 2014 Regular Board Meeting, Trustee Toth moved,
seconded by Trustee Thill, to accept the Minutes as presented. Upon the voice vote, the
motion passed unanimously.

Lovely Varughese expressed her and her family's thanks to the Village for spearheading the
October 18, 2014 press conference, as she and her family seek justice for their son, Pravin.
The press conference was a huge success. She said this is truly a community that cares.
The family has not received the first autopsy that had been done on Pravin, nor any of the
police reports. Mrs. Varughese said she feels the family has a right to see that information.
She stated that it's physically and mentally draining to wait, and added that the family is
seeking an independent investigation because they believe the State's Attorney has already
made up his mind.
Mrs. Varughese said that the family will do anything to get justice for Pravin, and toward that
end, she is traveling to Washington, D.C. this week. She thanked Eric Poders of the North
Shore Voice for helping to keep the memory of Pravin alive and for directing people to a fund-
raising website that has been set up to help the Varughese family fight for justice for their son.
She concluded her remarks by saying that, in Morton Grove, she feels like she's "in heaven,"
and said there are no words to express the depth of her gratitude.
1. Mayoral Update
a. Mayor DiMaria said that he and the Board attended the 251h anniversary memorial service of
Officer Barry Shalin, who had been killed by a drunk driver. It was a touching tribute to him,
and Mayor DiMaria thanked Chief Simo and Ed Pankow for coordinating the service.
Officer Shalin's family is dwindling, but Mayor DiMaria vowed to his remaining family
members that the Village will continue this tradition.
b. Mayor
DiMaria reported that there is interest in
the land across
from the Matra station. This is
good news
because it could be a catalyst for a
new downtown
area.
c. Mayor DiMaria announced that McGrath Audi of Morton Grove was scheduled to open next
week —six weeks earlier than originally thought. He said he toured the building, which meets all
the Village's codes and engineering standards, and was impressed by the state -of- the -art
facility.

1. Mayoral Update (continued)
d. Mayor DiMaria thanked the members of the Village staff who had worked with McGrath Audi to
get through the permitting process expeditiously and kept things moving along. He thanked
Andy DeMonte, who had a rather aggressive schedule to replace the water main on Simpson,
noting that, to Andy's and his crew's credit, completed the work and delivered water to the Audi
facility way ahead of schedule. Mayor DiMaria said that, time and again, the staff steps up to
the plate.
Mayor DiMaria thanked the Board for marching in the Veterans Day Parade yesterday; he was
out of town and said he appreciated the Board members coming out for this event. He asked
the assemblage to join him and the Board in a round of applause and thanks to all veterans
still living.

A. Village Administrator:

a. Village Administrator Ryan Horne said that the proposed budget for calendar year 2015
was completed this past Friday, and is currently available in his office at Village Hall, on the
Village's website, and at the Morton Grove Public Library. The first reading of the Budget
ordinance will be at the November 24, 2014 Village Board meeting and the second reading
will take place at the Village Board meeting of December 8, 2014.
b. Trustee Marcus asked Mr. Horne if any thought had been given to having one more Budget
Workshop once the Board has had achance to review the completed proposed budget.
Mr. Horne said he would be open to holding another meeting, if the Board desires.
c. Trustee Marcus said that maybe the meeting could be scheduled for sometime between when
the budget ordinance is first presented and the second reading. Mr. Horne said we can work
on a date. Trustee Thill agreed that another meeting could be useful.
d. Mayor DiMaria

to come to the next Board
Meeting so that anyone
who wished to
comment publicly on the
proposed budget could do
so.

A. Trustee Grear:

Minutes of November 10, 2014 Bound Meeting)
1. Trustee Grear presented Resolution 14 -53, Authorizing a Contract Extension With the
Morton Grove Firefighters Association.
He explained that the Village and the Morton Grove Firefighters Association have negotiated a
three -year contract (from January 1, 2014 to December 31, 2015) which has been ratified by
the members of the IAFF.
Trustee Grear moved to approve Resolution 14 -53, seconded by Trustee Thill.
Motion passed: 6 ayes, 0 nays.

2. Next, Trustee Grear presented Resolution 14 -54, Authorizing the Adoption of Cook
County Multi- Jurisdictional Hazard Mitigation Plan.
He explained that, in 2011, the Cook County Department of Homeland Security and
Emergency Management formed a coalition of 115 government partners within Cook County
in order to formulate a unified plan for the mitigation of natural disasters. Over the past
18 months, the Village of Morton Grove has participated in the preparation of the Hazard
Mitigation Plan (HMP). Adoption of this plan will allow dl participating jurisdictions to apply for
and receive federal and state grants designed to mitigate the effects of natural hazards and
disasters.
Trustee Grear moved, seconded by Trustee Toth, to approve Resolution 14 -54.

3. Lastly, Trustee Grear noted that tomorrow is Veterans Day. He complimented American Legion
Post 134 on doing a great job with its parades, and said that his proudest moments as a
Village official are when he's marching in these parades. Trustee Grear said that the most
important thing we have in this country is our freedom, and he encouraged everyone to fly
their flags tomorrow. He thanked Village staff for being at the Veterans Day Parade yesterday,
noting that it's an especially nice gesture for them to be there on their day off.
B. Trustee Marcus:
Trustee Marcus had no formal report, but he, too, congratulated Post 134 on a wonderful
Parade. He said he had received an email from a friend with a poem about Veterans Day
which was quite moving. He read it for the assemblage. Mayor DiMaria commented that
tomorrow will be the anniversary of the passing of former Mayor Dan Scanlon, a veteran who
fought in the Battle of the Bulge and said, "It's a true veteran who dies on Veterans Day."

TRUSTEES' REPORTS (continued)
Trustee Pietron presented Ordinance 14 -24, Amending Title 11, Section 1 of the Municipal
Code of the Village of Morton Grove to Adopt and Approve the Industrial Areas Plan.
This is the second reading of this ordinance.
a Trustee Pietron said the Industrial Areas Plan provides recommendations to preserve and
optimize the Village's industrial areas uses so they can continue to be a driving force in the
local and regional economy.
b. This would become the Village's official plan for the industrial areas and will establish goals
and guiding principles to implement action strategies to help retain businesses in these areas
and plan for future development and expansions.

D. Trustee Thill:
Trustee Thill had no formal report, but commented that there is a Memorial Tree in former
Mayor Scanlon's name planted on the front lawn of the American Legion Post #134 building.
Trustee Thill asked Mr. DeMonte when leaf pick -up will end. He responded it will end the
week of Thanksgiving, although Public Works may take one more pass around the Village
the following week to clean up any new piles of leaves.
E. Trustee Toth:
Trustee Toth had no report.
Trustee Witko:
Trustee Witko said that her father is a Marine who served in Viet Nam for 13 months and
earned a Purple Heart and Bronze Star. She wished all veterans at home and abroad a
Happy Veterans Day.

XIV, OTHER BUSINESS
1. Trustee Marcus raised the point that, in informal budget and other discussions, he's heard
references to a "police /municipal facility.' He commented that, a year ago, the Village
purchased land earmarked for a police facility, and a committee is currently working on
recommendations for an architectural firm to provide drawings. His concern was that the
architect's drawing(s) be specific to a police facility, because he did not recall the Board having
a public discussion or voting on having a combined facility.
a. Trustee Marcus did not want the Village to pay additional costs for artist renderings of a
combined facility, and moved that the architect's expenses be related only to a police facility,
not a combined or a municipal facility. He said the Village's budget is tight and he would rather
not spend money on something that has not been decided or voted upon.
b. Corporation Counsel Liston pointed out there's no resolution before the Board on this matter
yet. Trustee Marcus responded that, when there is a resolution, he would like it to specifically
address the police station.
c. Ms. Liston said that a committee comprised of Trustee Grear, Economic Development Director
Razdevich, Finance Director Navarrete, herself, and Plan Commissioner Steve Blonz have
interviewed and tentatively hired a consultant for this project. The committee is now working on
a scope of services. The purchased site on Lehigh has not really been determined to be an
appropriate site for a police facility. Thought must also be given to the present location of the
Police Department. What happens to this building? It sits on two acres of prime residential
property, and the sale of this property could help offset the costs of a new facility. Ms. Liston
asked Trustee Marcus if he could wait to see the scope of services being proposed.
d. Trustee Grear echoed that, saying the committee has a number of challenges to work through
before a Resolution can be brought before the Board. The committee is considering questions
such as, if the police department leaves this building, can we have one part of our operation
here? He commented that the current Village Hall /Police Department building is expensive to
upkeep and reminded the Board that nearly a quarter of a million dollarswas spent last year on
addressing problems with the HVAC system. Trustee Grear said the committee is looking at
all aspects and is doing its due diligence, and will likely have a Resolution for the Board's
consideration before the end of the year.
e. Ms. Razdevich said the committee has not made any decisions about whether there should be
a joint facility or a location. She noted that Commissioner Blonz, a former architect, has been
putting in a lot of time of this and has proven to be a great resource for the committee, adding
that the biggest thing the committee is wrestlingwith now is what happens to the current build-
ing? When drafted, the Resolution will lay out all the steps the committee has taken and the
"next steps" for the Village.

Village owes it to the community to do its
due diligence. It's important
to note that the
Village
purchase property without doing a study —now
we need to be efficient.
There's a lot to
this but
the Board should wait and see what the committee's findings are.

Trustee Marcus said the Board discusses a lot of different things. The location of Village Hall is
important, and it would be important to air comments about the Board's intentions and what it
would liketo do.

OTHER BUSINESS (continued)
h. Trustee Marcus said the Village desperately needs a new Police Station, and obviously needs
a new Village Hall, too, because of its aging infrastructure and maintenance problems. He
wanted to ensure that the Village evaluates all aspects, and that it doesn't spend extra money
on something that may not happen.
Trustee Marcus said he would withdraw his motion.
Trustee Grear said the committee is trying to move as expeditiously as possible while trying to
ensure they're doing everything right. This is a huge matter to consider. Something is going
to happen —the committee is just not sure of how, where, and when.
2. Mayor DiMaria congratulated all those who ran for election and won last Tuesday.

XVI. RESIDENTS' COMMENTS
A 28 -year resident who lives at 8116 Oswego (name not provided) appeared before the
Board seeking help with a water bill of $656. He said he had tried working with the Water
Department but found them unhelpful when they did finally return his calls. He felt that
construction workers working next to his property had used his outside faucet to wash their
hands and then left the water running. He even made a police report on the matter. He said
he's never had a water bill that high before.
Mayor DiMaria asked Mr. DeMonte to look into this matter.
On the subject of water rates, Mayor DiMaria said that the City of Chicago plans to increase
the Village's water rates an additional 15% effective January 1, 2015. This is on top of a 25%
rate increase in 2012, a 15% rate increase in 2013, and a 15% rate increase in 2014. So
basically water rates will have gone up almost 90% in about four years. Morton Grove's cost
of water has cost the Water Fund $2 million in 2010 and it's up to $4.3 million in 2015. He
said his own water bill is quite high. These types of increases passed on by the City of Chicago
are unacceptable, and the Board is proactively searching for solutions and alternative sources
of water.

Synopsis: To authorize the Village President to execute the documentation required by
the State of Illinois for the 2015 Motor Fuel Tax program.
Purpose: To appropriate the Village's estimated motor fuel tax revenue for 2015 as
required by the State of Illinois.
Background: Each year the Village receives a portion of the motor fuel tax collected by the
State. These fluids must be spent on the eligible improvements of roadways.
The State requires an estimate and final statement of the maintenance
expenses for each year of the program.

APPROPRIATION OF 2015 MOTOR FUEL TAX FUNDS
FOR THE MAINTENANCE OF STREETS AND HIGHWAYS
MFT SECTION 15- 00000 -00 -GM
WHEREAS, the Village of Morton Grove (VILLAGE), located in Cook County, Illinois, is a
home rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, the Illinois Highway Code requires the Village of Morton Grove Board of
Trustees to authorize the appropriation of Motor Fuel Tax (MFT) Funds for the purpose of Maintaining
Streets and Highways within the Village from January 1, 2015 to December 31, 2015; and
WHEREAS, the estimated expenditures from the MFT Funds for the period January 1, 2015 to
December 31, 2015, are $945,000; and
WHEREAS, the attached "Resolution for Maintenance of Streets and Highways by
Municipality under the Illinois Highway Code" (BLR 14230) and the "Municipal Estimate of
Maintenance Costs" (BLR 1423 1) have provided for the distribution of the anticipated 2015 MFT
Funds for maintenance of streets within the Village of Morton Grove.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUN`T'Y, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Resolution as though fully set forth therein thereby making the findings as
hereinabove set forth.
SECTION 2: Only those operations listed and described on the Municipal Estimate of
Maintenance Costs approved in connection with this Resolution are eligible for reimbursement with
Motor Fuel Tax during the period specified above.
SECTION 3: The Corporate Authorities hereby approve and the Village President is hereby
authorized to execute the Illinois Department of Transportation Municipal Estimate of Maintenance
Costs (BLR 1423 1) and the Illinois Department of Transportation Resolution for Maintenance of
Streets and Highways by Municipality under the Illinois Highway Code (BLR 14230).
SECTION 4: Two certified copies of this Resolution will be transmitted to the District Office
of the Illinois Department of Transportation at Schaumburg, Illinois.
SECTION 5: This Resolution shall be in full force and effect from and upon its passage and
approval.

revised thereafter. The final budget including a public hearing to be held on December 8, 2014.

The Budget has been available for inspection at the office of the Village Administrator, the Public
Library, and posted on the Village's website since at least November 10, 2014.

WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is ahome
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, pursuant to Ordinance 97 -53 enacted on the 11"' day of November 1997, the
Corporate Authorities of the Village of Morton Grove established by a two - thirds majority vote of the
Village Board then holding office, the budget system, all as authorized pursuant to Statute 65 ILCS
5/8 -2 -9.1 and pursuant to said statute and local ordinance, the Village Administrator of the Village of
Morton Grove has previously prepared and compiled the contents of the 2015 Budget and presented
said Budget in tentative form for consideration by the Village Board; and
WHEREAS, the proposed annual budget has been made conveniently available for public
inspection in the Office of the Village Administrator at least by November 10, 2014, such date being at
least ten (1.0) days prior to the date of passage of this Ordinance by the Village Board; and
WHEREAS, the Village Board held a public hearing on the proposed annual budget on the 81h
day of December 2014, such date being not less than one week after the proposed budget was made
available for inspection; and
WHEREAS, notice of such hearing was given by publication in the Pioneer Press Newspaper
which is a newspaper of general circulation in the Village, at least one week prior to the time of said
hearing; and
WHEREAS the budget documents are too voluminous to attach to this ordinance, but comport
with the budget recapitulation attached hereto as Exhibit "A ".
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION l: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance as though fully set forth therein thereby making the findings as hereinabove
set forth.
SECTION 2: The annual budget of the Village of Morton Grove, Illinois for the calendar year
beginning January I, 2015 and ending December 31, 2015, pursuant to the official budget documents
currently kept in the Office of the Village Administrator shall be and is hereby adopted.
SECTION 3: The Annual Budget of the Morton Grove Public Library for the fiscal year
beginning January 1, 2015 and ending December 31, 2015, is attached hereto as Exhibit "l3" shall be
and is hereby adopted
SECTION 4: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.

This ordinance sets the levy for property taxes for tax year 2014 which are collected m2015.
This ordinance must be adopted and filed with the Cook County Clerk in order to levy property taxes
within the Village of Morton Grove.
Pursuant to Ordinance 14 -27, the Village Board of Trustees passed the 2015 Budget for the Village of
Morton Grove and the Morton Grove Public Library. Said budget calls for expenditures in the amount
of $66,536,389. The amount necessary to be levied for 2014 property taxes is the amount of
$12,540,233. Bylaw the Village is required to levy an additional $3,078,200 for debt service
payments authorized by general obligation notes and bonds for a total levy before abatement in the
amount of $15,618,433. However, the Village Board intends to adopt Resolutions which will
immediately abate $2,621,296 from the levy resulting in the net levy as intended by the Corporate
Authorities in the amount of $12,997,137. After extensions for loss and cost, the effective result is a
2.0% increase in the Village's portion of the tax levy and a 5.0% increase in the Library's portion of
the tax levy, resulting in an overall increase of 2.7% from the requested final extended tax levy from
the previous year.

WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is ahome

WHEREAS, on December 08, 2014, the President and Board of Trustees of the Village passed
and approved by roll call vote, the annual Budget Ordinance 14 -27 of said Village for the fiscal year
beginning January 1, 2015, and ending December 31, 2015, effective from and after January 1, 2015.
The Ordinance was duly signed and approved by the President and Board of Trustees of the Village
and attested by the Village Clerk; and thereafter it was duly published in pamphlet form by order of the
President and Board of Trustees of the Village; and
WHEREAS, a Notice of the Public Hearing for the 2014 Levy was published in the November
27, 2014, Morton Grove Champion, a Pioneer Press Publication in the time and form as required by
the State Statute; and
WHEREAS, a Public Hearing was held at 7:00 pm on Monday, December 08, 2014, in the
Richard T. Flickinger Municipal Center where comments were heard and addressed by the Village
Board of Trustees; and
WHEREAS, the aforementioned Budget Ordinance, as adopted on December 08, 2014,
provided for a total property tax levy including the total levy for all Debt Service requirements before
abatements of FIFTEEN MILLION SIX HUNDRED EIGHTEEN THOUSAND FOUR HUNDRED
THIRTY THREE DOLLARS ($15,618,433); and
WHEREAS, the Village will subsequently pass additional resolutions abating tax levies relating
to the refunded General Obligation Bonds Series 2002 for FIVE HUNDRED ONE THOUSAND
FIFTY TWO DOLLARS ($501,052) and the share provided for by the Village Water /Sewer Fund for
THREE HUNDRED SIXTY FIVE THOUSAND EIGHT HUNDRED FIVE DOLLARS ($365,805)
and the share provided for by the Village's Lehigh Ferris Tax Increment Financing Area Funds for
EIGHT HUNDRED ONE THOUSAND TWO HUNDRED DOLLARS ($801,200) and the share
provided for by the Village's Waukegan Road Tax Increment Financing Area Funds for EIGHT
HUNDRED NINETY THREE THOUSAND SEVEN HUNDRED THIRTY -FOUR DOLLARS
($893,734) and the share provided for by the Debt Service Fund for FIFTY NINE THOUSAND FIVE
HUNDRED FIVE DOLLARS ($59,505); and
WHEREAS, the result of the above abatements will be to reduce the gross property tax from
the original FIFTEEN MILLION SIX HUNDRED EIGHTEEN THOUSAND FOUR HUNDRED
THIRTY THREE DOLLARS ($15,618,433); as indicated in this Ordinance, to a net property tax levy
of TWELVE MILLION NINE HUNDRED NINTY -SEVEN THOUSAND ONE HUNDRED
THIRTY -SEVEN DOLLARS ($12,997,137), a reduction of TWO MILLION SIX HUNDRED
TWENTY -ONE THOUSAND TWO HUNDRED NINETY SIX DOLLARS ($2,621,296).

Introduction:
November 24, 2014
Synopsis:
This is a minor amendment to modify Ordinance 04 -26, which approved the Trafalgar Square Planned
Unit Development, in accordance with Section 12- 16 -4 -B of the Unified Development Code. This
amendment would approve a Plat of Vacation and Abrogation of the utility easement for the property
located at 8320 -8342 Concord Drive. The applicant had previously applied for and been granted approval
of an amendment to Trafalgar Square PUD to allow for a change from the previously approved 78 unit
multi- family development to a 31 unit townhome development, commonly known as Lexington Station
(Ordinance 13 -29).
Purpose:
( To modify the approved Trafalgar Square Planned Unit Development (Ordinance 04 -26) to vacate and
abrogate an existing utility easement around the previously approved multifamily structure based on
changes to the development plan for the property located at 8320 -8342 Concord Drive.
Background:
The Trafalgar Square Development (Ordinance 04 -26) originally included two (2) 6 -story buildings, with
a total of 78 dwellings units each, as part of the overall approved Planned Unit Development. The
approved site plan (Ordinance 04 -26, August 9, 2004) included utility easements that surrounded both
r mid -rise buildings.
On December 10, 2013, the Board approved an amendment to that PUD (Ordinance 13 -29) to alter the
approved site plan for the remaining, undeveloped portion of the site at 8320 -8342 concord Drive from a
78 unit midrise residential building to a 31 unit attached dwelling) development. The previously approved
plan included a utility easement around the multi - family building. This amendment to the PUD allows for
the vacation and abrogation of the easement based on the subsequent changes to the development plan
(Ordinance 13 -29). This Plat of Vacation and Abrogation does not change the approved Planned Unit
Development amendment or site plan (Ordinance 13 -29) nor the approved Lexington Station Plat of
Subdivision (Ordinance 14 -10).

WHEREAS, the Village of Morton Grove, located in Cook County, Illinois, is a Home Rule
unit of government and under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, and as such can exercise any power and perform any function pertaining to its government
affairs, including but not limited to, the power to tax and incur debt; and
WHERAS, in 2004, pursuant to Ordinance 04 -26, the Board approved the Trafalgar Square
Planned Unit Development; and
WHEREAS, in 2013, pursuant to Ordinance 13 -29, the Board approved an amendment to
the Trafalgar Square Planned Unit Development to allow for 31 attached dwelling units on a site
where a 6- story, 78 dwelling unit building was previously approved; and
WHEREAS, in 2014 the Board approved Ordinance 14 -10 which subdivided the area
designated for the 31 townhome development to allow for the creation of seven (7) new lots within
the development parcel where each of the six proposed townhome buildings will be on individual
lots and the remaining common open space will be the seventh lot; and
WHEREAS, the applicant, Lexington Station LLC, pursuant to Plan Commission Case PC
14 -21 has made a proper application to amend Ordinance 04 -26 to vacate and abrogate the utility
easement that covered the area around the previously approved midrise residential building where
the building footprint has subsequently been amended and approved as the Lexington Station
Development and amendment to the Trafalgar Square PUD (Ordinance 13 -29); and
WHEREAS, pursuant to Ordinance 07 -07, the Village adopted a Unified Development Code
which set forth an abbreviated procedure for minor revisions to special use permits which allows for
the granting of such amendments without a formal public hearing process subject to the
recommendation for approval by the Village Administrator, Corporation Counsel, Building
Commissioner and Plan Commission Chairperson and subsequent approval by the Village Board;
and
WHEREAS, the Village Administrator, Corporation Counsel, Building Commissioner and
Plan Commission Chairperson, have found this amendment as set forth in this ordinance, meets the
standard for the abbreviated process described above, and as such recommend approval of the minor
amendment to Ordinance 04 -26; and
WHEREAS, the property is zoned in the CR Commercial Residential District pursuant to
the provisions of the Village of Morton Grove Unified Development Code; and
WHEREAS, pursuant to the provisions of the Village of Morton Grove Unified
Development Code, the Corporate Authorities have determined the proposed amendment to the
special use shall be approved subject to conditions and restrictions as set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance, as though fully set forth herein, thereby making the findings as
hereinabove set forth,
SECTION 2: Lexington Station LLC, is hereby granted an amendment to Ordinance 04 -26
to allow for the vacation and abrogation of the utility easement where the Lexington Station
development has been approved (Ordinance 13 -29) subject to all conditions of Ordinance 13 -29 and
Ordinance 04 -26 remaining in effect unless specifically modified by this amendment.
SECTION 3: The Village Clerk is hereby authorized and directed to amend all pertinent
records of the Village of Morton Grove to show and designate the preliminary and final plat of
survey as amended hereunder.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.

Approval of Easement Vacation Plat
Dear Mayor DiMaria:
With what we hope is the last stage of approvals or the Lexington Station project, on Monday
the Village Board will be presented for approval with a Plat of Vacation of Easements. When the
project was originally approved for the second condominium building, a blanket utility easement was
recorded. Now that the townhomes were approved (and built) separate utility easements have been
approved through the Plat of Subdivision. Through some confusion, a Plat of Vacation (of the
existing utility easements) was not presented for approval. That is what is before you on November
24`x'.
Unfortunately, time is very much of the essence. Lexington has closings scheduled but
cannot go forward with them until the Plat of Subdivision is recorded, along with the Plat of
Vacation. It is for that reason we respectively are requesting that a second reading on approval of the
Plat of Vacation be waived. This plat is solely to correct a technical issue. The Plat of Subdivision
has already been approved and executed. We hope to pick up both plats on Monday evening or
Tuesday so they can be recorded.
