AMENDING TITLE 4, OF THE MUNICIPAL CODE ENTITLED "LIQUOR CONTROL',
CHAPTER 6D, SECTION 14 ENTITLED "REGULATIONS FOR LICENSEES OPERATING
VIDEO GAMING TERMINALS ON THE LICENSED PREMISE"
Introduced June 9, 2014
Synopsis This Ordinance will amend and update Title 4 -6D -14 of the Village Code,
Purpose To update and regulate the amount and type of liquor licenses relative to video
gaining available in the Village of Morton Grove.
Background: Village staff periodically reviews Village codes and ordinances to ensure they are in
compliance with state statute and current practices. In order to regulate the number
of video gaming establishments in the Village, staff has proposed only holders of
Class "A" and "C" liquor licenses and holders of Class "B" license holders who
have made a proper application to the Illinois Gaming Board for the
operation of video gaining terminals before August 1, 2014, be permitted to
have video gaming machines. Currently nine establishments in the Village have
video gaming.

AMENDING TITLE 4, OF THE MUNICIPAL CODE
ENTITLED "LIQUOR CONTROL", CHAPTER 6D, SECTION 14
ENTITLED "REGULATIONS FOR LICENSEES OPERATING VIDEO GAMING
TERMINALS ON THE LICENSED PREMISE"
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois is a home
rule unit of government under the provisions of Article 7 of the Constitution of the State of Illinois, can
exercise any power and perform any function pertaining to its government affairs, including but not
limited to the power to tax and incur debt; and
WHEREAS, the Village has a policy of regularly reviewing and revising its Municipal Code, as
necessary, to insure the provisions of the Code remain compliant: with contemporary statutes and
relevant to the current operations and requirements within the Village; and
WHEREAS, In order to limit the number of video gaining establishments, staff has proposed
that Title 4, Chapter 6D, Section 14 of the Municipal Code be updated to no longer allow Class "B"
license holders to operate video gaining unless they had obtained their license prior to June 1, 2014;
and
WHEREAS, the proposed amendments are in the Village's best interest.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF TIIE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance as though fully set forth therein thereby making the findings as hereinabove
set forth.
SECTION 2: Title 4, Chapter 6D, Article 14 entitled "Regulations for Licensees Operating
Video Gaming Terminals on the Licensed Premise is hereby amended by repealing Article 14 and
replacing it with a new Article 14 to read as follows:
4 -6D-14 REGULATIONS FOR LICENSEES OPERATING VIDEO GAMING
TERMINALS ON THE LICENSED PREMISE:
A. It shall be unlawful for any licensed premise to operate a video gaming terminal, except for
Class "A" and "C" license holders, and Class "B" license holders who have made a proper
application to the Illinois Ganging Board for the operation of video gaming terminals before
August 1, 2014. Such holders must have also obtained approval for the operation of video
gaming terminals from the State of IIlinois, and a video gaming terminal permit sticker from
both the State of Illinois and the Village of Morton Grove. The cost for a video gaming
terminal permit sticker issued by the Village of Morton Grove shall be $250.00 per
machine /terminal to be renewed on an annual basis.
B. Regulations governing licensed establishments operating video gaming terminals:
A valid Village video gaming terminal permit sticker shall be clearly displayed at all
times on each video gaming terminal.
2. No more than the maximum amount of video gaming terminals allowed by Illinois law
may be located on the licensed establishment's premises.
3. A11 video gaming terminals must be located in an area restricted to persons 21 years of
age or older. The entrance to such an area must at all times be within the view of at
least one employee who is at least 21 years of age. Video Gaming Terminals must not
be visible from any area outside of the building.
4. No licensed establishment may cause or permit any person under the age of 21 to use,
play or operate a video gaming terminal.
No video gaming terminal may be played except during the legal hours of operation
allowed for the consumption of alcoholic beverages et the licensed premise.
6. The licensed establishment must fully comply with the Illinois Video Gaming Act (230
ILCS 40/1 et seq) and all rules, regulations, and restrictions imposed by the Illinois
Gaming Board which are here as may be amended from time -to -time which are hereby
incorporated by reference into this chapter.
7. The Iicensed premise shall be video recorded pursuant to Section 4- 6D- 13(1-1).
S. Any violation of this section shall be cause for the immediate suspension of the liquor
license for the licensed premise. And such suspension shall remain in effect until the
licensee demonstrates that it is in full compliance with this section.
9. Any licensee that has had its licensed revoked or suspended by the Village of Morton
Grove, or by the Illinois State Liquor Control Commission or has its video gaming
license revoked or suspended by the Illinois Gaming Board shall automatically have its
Village video gaming terminal permit stickers revoked or suspended for the same time
period as its liquor and/or gaming board permit sticker suspended whichever the case
may be.
10. Every video gaming terminal that does not have a valid video gaining terminal permit
sticker issued by the Village of Morton Grove or the State of Illinois operated in
violation of this section or is otherwise unlawful shall be considered a gambling device
subject to seizure and shall be turned over to the Illinois Gaming Board in accordance
with Board regulations and applicable laws unless otherwise ordered by a court of
competent jurisdiction.
SECTION 3: The terms and conditions of this ordinance shall be severable and if any section,
term, provision, or condition is found to be invalid or unenforceable by any reason by a court of
competent jurisdiction, the remaining sections, terms, provisions, and conditions, shall remain in full
force and effect.
SECTION 4: hi the event this ordinance or any Code amendment herein is in conflict with any
statute, ordinance, or resolution or part thereof, the amendments in this ordinance shall be controlling
and shall supersede all other statutes, ordinances, or resolutions but only to the extent of such conflict.
Except as amended in this ordinance, all chapters and sections of the Village of Morton Grove Village
Code are hereby restated, readopted, and shall remain in full force and effect.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.

Purpose:
NIPSTA requires the appointment of a delegate and alternate to the NIPSTA
Board.
Background:
The Village is a member of the Northeastern Illinois Public Safety Training
Academy (NIPSTA). The Fire Chief is the delegate and if he is unable to
attend and represent the Village in NIPSTA Board matters, the alternate
delegate will be needed to represent the Village.

AUTHORIZING THE APPOINTMENTS OF DELEGATES TO THE
NORTHEASTERN ILLINOIS PUBLIC SAFETY TRAINING ACADEMY (NIPSTA)
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, the Village of Morton Grove adopted the contract and by -laws of the Northeastern
Illinois Public Safety Training Academy by Resolution 0 1 -26 and thereby became a member of said
cooperative; and
WHEREAS, said contract provides member units designate a delegate and alternate delegate by
resolution adopted by its Corporate Authorities, to represent that body on the Board of Directors of said
Northeastern Illinois Public Safety Training Academy.
NOW 'THEREFORE, BE IT RESOLVED by the Village of Morton Grove, Illinois thatthe
Village's Fire Chief, Tom Friel, and Police Chief, Michael Simo, are hereby designated to represent the
Village of Morton Grove on the Board of Directors of said Northeastern Illinois Public Safety Training
Academy commencing immediately.
BE IT FURTHER RESOLVED that Ryan J. Horne, Village Administrator, of the Village of
Morton Grove, is hereby authorized to appoint Chief Tom Friel as the delegate and Chief Michael
Simo as the alternate delegate in the event the delegate is unable to carry out his duties as the delegate
and to make proper notification.

Synopsis
This Ordinance will amend and update Title 1 -4 of the Village Code.
Purpose
To regulate the issuance and serving of citations or complaint violations in the
Village of Morton Grove.
Background:
Village staff periodically reviews Village codes and ordinances to ensure they are it
compliance with state statute and current practices. In order to make sure citations
and /or complaints issued by various departments of the Village are delivered and
served in an expeditious manner which protects the due process rights of alleged
offenders, Village staff has proposed changes to 1 -4 -5 to provide citations may be
served by regular mail to the last known address of the defendant, by personal
service to the defendant's usual place of abode, or if the defendant is a licensee by
personal service or regular mail to the address provided to the Village by the
defendant or by posting at the defendants last known residence or place of business.
If the citation pertains to a vehicle, by posting the citation on the vehicle.

1 -4 -3: STIPULATED SETTLEMENT: The Village Administrator or his /her dcsignee
after consulting with the Corporation Counsel, is authorised and given discretion to
settle citations for violations of this Code or any Village ordinance by accepting on behalf of the
Village a fine less than the amount specified in this chapter or any Village ordinance and /or to establish
settlement dates for each such violation. The Village Administrator shall in writing state the basis for
any such settlement. For violations where a showing of compliance is applicable, settlement as
provided for in this section shall only be authorized upon a showing of compliance. The Village
Administrator may establish procedures for the issuance of notices of violations requiring appearance
at an administrative hearing or court not in addition to those procedures set forth in this Code. Under
extraordinary circumstances, the Village Administrator or his/her designee may waive a fine pursuant
to his/her written discretion. (Ord. 09 -16, 10 -12 -2009)
1-4 -4: COMPLIANCE AGREEMENT: In lieu of or in addition to any penalty or
procedure authorized herein or by law, the Village Administrator or his/her designee and
any person accused of violating any Village ordinance, rule or regulation may enter into a written
agreement providing for the proper and timely abatement of such violation. A compliance agreement
may include a description of the specific action that will be taken to abate the violation, a timetable for
such action, a requirement for performance security, notice procedures and reporting requirements,
liquidated penalties and other items reasonably related to the proper and timely abatement of violation.
A compliance agreement shall constitute a written contract which may be enforced by any appropriate
action at law or in equity, including an action for specific performance or injunctive relief. A
compliance agreement may be recorded. The violation of a compliance agreement shall constitute a
separate violation of this Code. A compliance agreement shall not relieve any person from the
continuing obligation to comply with the ordinances, rules, regulations and /or Codes of the Village of
Morton Grove.
1 -4 -5: CITATIONS OR COMPLAINTS:
A. A citation
or complaint
for any ordinance violation or a violation of this
Code
may encompass
more than
one offense
or violation, or offenses or violations continuing
for more
than one day.
B. Unless specifically provided otherwise in this Code, a citation or complaint for any ordinance
violation or any violation of this Code may be served in the following manners:
By regular mail, to the last known address of the defendant.
2. By personal service made either by personally delivering the citation or complaint to the
defendant, or by leaving a copy at the defendant's usual place of abode with some
person of the defendant's household of the age of thirteen (1 years or older, and
informing that person of the contents thereof.
If the defendant has been issued a permit, certificate of compliance, or a license from
the Village, (i) by personal service to the defendant or (ii) by regular mail to the
defendant or the agent for the defendant at the address provided to the Village by the
defendant, or (iii) by posting the citation on the defendant's last lalown residence or
place of business.
4. By posting the citation on any vehicle parked in violation of this Code or any ordinance.
5. By posting the citation at the last known address or place of business of the defendant:
6. By any other means permitted by all applicable provisions of the Illinois Code of civil
procedure, the Illinois Supreme Court rules, or the Local rules of the Circuit Court of
Cools County.
C. Unless an emergency involving public health, safety, or the general welfare of the community
is involved, no citation shall be heard by any court with jurisdiction or by the Village's
adjudication hearing officer sooner than fourteen (14) days nor later than forty -five (45) days
from the date of the issuance of the citation.
1 -4 -6: GENERAL PROVISIONS RELATING TO VIOLATIONS AND
OFFENSES:
A. A separate offense or violation of a Code or ordinance shall be deemed committed on each day
or part thereof on which such offense or violation occurs or continues or is permitted to occur
or continue.
B. Whenever a minimum but no maximum fine is imposed as a penalty by any section or
paragraph of this Code, the offender may be fined any sum exceeding the minimum fine but the
fine shall not exceed seven hundred fifty dollars ($750.00).
C. No provision of this Code designating the duties of any Village officer or employee shall be
construed as to make such officer or employee liable for any fine or penalty provided in this
Code for a failure to perform such duty, unless the intention of the Board of Trustees to impose
such a fine or penalty on such officer or employee is specifically and clearly expressed in the
section creating the duty.
D. The owner or occupant of any premises upon which a violation offense has occurred, the owner
of any object or material placed or remaining anywhere in violation of any Code or ordinance
and the owner or occupant of any premises served by any excavation or structure illegally made
or erected, shall be deemed prima facie responsible for the violation so evidenced, and subject
to all penalties provided therefore.
E. Every act or omission of any nature constituting a violation of any provisions of this Code or
any Village ordinance by any officer, director, manager, or other agent of any licensee, permitee
or holder of a certificate of compliance, shall be deemed and held to be the act of such licensee,
permitee or holder, and said licensee, permitee or holder shall be punishable in the same
mam7er as if said act or omission had been done or omitted by said licensee, permince or holder
personally.
The fact any automobile which is illegally parked is registered in the name of a person shall be
considered prima facie proof such a person was in control of the automobile at the time of such
parking.
G. An unpaid fine or part thereof may be collected by any means authorized by law for the
collection of municipal fines or monetary judgments. Corporation Counsel is authorized to take
any and all action and /or retain attorneys and private collection agents for the purpose of
collecting any unpaid fine or part thereof. Any fees or costs incurred by the Village to collect
any unpaid fine shall be charged to and paid by the offender.
H. The fact a person is obligated to the Village for any unpaid fine or related charge shall be a
basis to deny, suspend or revoke any permit, license, or certificate of compliance issued by the
Village and /or to shut -off water provided to any property owned or occupied by such person.
i. The imposition of any fine shall be in addition to and not exclusive of any other right or remedy
allowed by this Code or otherwise by law and of all obligations of the defendant, and shall not
preclude any additional remedies of the Village including injunctive relief.

SECTION 3: The terms and conditions of this ordinance shall be severable and if any section,
term, provision, or condition is found to be invalid or unenforceable by any reason by a court of
competent jurisdiction, the remaining sections, terms, provisions, and conditions, shall remain in full
force and effect.
SECTION 4: In the event this ordinance or any Code amendment herein is in conflict with any
statute, ordinance, or resolution or part thereof, the amendments in this ordinance shall be controlling
and shall supersede all other statutes, ordinances, or resolutions but only to the extent of such conflict.
Except as amended in this ordinance, all chapters and sections of the Village of Morton Grove Village
Code are hereby restated, readopted, and shall remain in full force and effect.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.

Objective

Purpose:
i
To comply with the requirements of the Illinois Prevailing Wage Act, 820 ILCS 130
et seq.
Background:
1 The Illinois Prevailing Wage Act requires a contractor and subcontractor to pay
laborers, workers and mechanics employed on public works projects, no less than
the general prevailing rate of wages as established by the Village. "Public Works"
are defined by the Act to mean all fixed works constructed by any public body, or
paid for wholly or in part out of public funds. Each year during the month of June,
the Act requires the Village to investigate and ascertain the prevailing rate of wages.
This ordinance adopts the prevailing wage rates established by the Illinois
Department of Labor for Cook County, Illinois as the prevailing wage rates for
public works projects in Morton Grove. A schedule of these rates can be found at
http: / /www.illinois.gov/ idol / Laws - Rules /CONMED /Pages/Rates.aspx . Upon
passage of this Ordinance, the Act further requires the Village to post these rates or
make them available for inspection by any interested party; file a certified copy of
the Ordinance with the Secretary of State and the Illinois Department of Labor; and
publish a notice of these rates in a newspaper of general circulation within the
Village.

ESTABLISHING THE PREVAILING RATE OF WAGES FOR LABORERS, MECHANICS AND
OTHER WORKERS IN THE LOCALITY OF THE VILLAGE OF MORTON GROVE
EMPLOYED IN PERFORMING CONSTRUCTION OF PUBLIC WORKS
FOR THE VILLAGE
WHEREAS, the Village of Morton Grove ( "Village "), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article VII, Section 6 of the 1970; and
WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics
and other workers employed in any public works by the State, County, City or any public body or any
political subdivision or by anyone under contract for public works ", approved June 26, 1941, as amended,
being Chapter 920 ILCS 130/1 -12, Illinois Compiled Statues; and
WHEREAS, the aforesaid Act requires the Village of Morton Grove investigate and ascertain the
prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the Locality of
the Village of Morton Grove employed in performing construction of public works, for the Village; and
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses
into this Ordinance as though fully set forth therein thereby making the findings as hereinabove set forth.
SECTION 2: To the extent and as required by "An Act regulating wages of laborers, mechanics
and other workers employed in any public works by the state, county, city or any public body or any
political subdivision or by anyone under contract for public works" approved June 26, 1941, as amended,
the general prevailing rate of wages in this Iocality for laborers, mechanics and other workers engaged in
the construction of public works coming under the jurisdiction of the Village of Morton Grove is hereby
ascertained to be the same as the prevailing rate of wages for construction work in the Cook County area
as determined by the Department of Labor of the State of Illinois as of June 2013, a copy of that
determination being attached hereto as Exhibit "A" mid incorporated herein by reference. The definition
of any terms appearing in this Ordinance which are also used in the aforesaid Act shall be the same as in
said Act.
SECTION 3: Nothing herein shall be construed to apply said general prevailing rate of wages as
herein ascertained to any work or employment except public works of the Village of Morton Grove to the
extent required by the aforesaid Act.
SECTION 4: The Village of Morton Grove shall publicly post or keep available for inspection by
any interested party at 6101 Capulina Avenue, Morton Grove this determination of such prevailing rate of
wage.
SECTION 5: The Village of Morton Grove shall mail a copy of this determination to any
employer, and to any association of employers and to any person or association of employees who have
filed, or file their names and addresses, requesting copies of any determination stating the particular rates
and the particular class of workers whose wages will be affected by such rates.
SECTION 6: The Village of Morton Grove shall promptly file a certified copy of this Ordinance
with both the Secretary of State Index Division and the Department of Labor of the State of Illinois.
SECTION 7: The Village Administrator shall cause a notice to be published in a newspaper of
general circulation within the area the determination of prevailing wages has been made. Said notice shall
conform substantially to the notice attached hereto. Such publication shall constitute notice that this is the
determination of the Village of Morton Grove and is effective.
SECTION &: This Ordinance shall be in full force and effect from and after its passage and
approval.

This resolution will authorize negotiations for a redevelopment agreement with the contract purchasers of
8700 Waukegan Road for a new mixed use residential and commercial development.
Heartland Real Estate Partners, LLC are seeking to purchase 3.5 acres of property on the southwest corner of
Dempster Street and Waukegan Road in order to build a residential mid -rise rental development along with
two free standing retail buildings. The development is not economically feasible unless the Village provides
TIT assistance.
Over the past several years, the area within the vicinity of the intersection of Dempster and Waukegan
has experienced declining property values, and vacancies. This decline has had an adverse effect on
surrounding properties. In 2011, the owners of the Prairie View shopping center approached the Village
proposing a plan to do major renovations to the center, but informed the Village they will not be able to do so
without Village assistance due to the high cost, the uncertain economic climate, and increased MWR,D and
related requirements. The Village then retained S.B. Friedman and Company to conduct an eligibility
analysis of this area. The eligibility study found the area met the factors of blight necessary for the creation
of Tax Increment Financing District. After holding required public meetings and hearings, the Village
pursuant to Ordinance No. 12 -34 approved a Tax Increment Redevelopment Plan and Project Area,
Ordinance No. 12 -35 designated the Dempster /Waukegan Redevelopment Project Area, and Ordinance No.
12 -36 adopted Tax Increment Allocation Financing (collectively, "TIF Ordinances"), which established the
Dempster/Waukegan Tax Increment Finance Redevelopment Project Area ( "TIFDisfriet ").
Heartland Real Estate Partners, LLC have entered into a contract for the purchase of 8700 Waukegan
Road which is located in the Dempster /Waukegan TIF District. This property is approximately 3.54 acres in
area and consists of an obsolete I and 2 story 61,985 sq, ft. building which has significant vacancies and
structural issues. The developer has proposed to build a multi -story residential building for approximately
172 new rental units and two separate buildings which will consist of approximately 16,000 sq ft of retail
space. The development will have new underground utilities and a detention system compliant with MWRD
standards. The developer believes the new development will improve the area and be a catalyst for new
additional redevelopment. The developer has advised the Village the project is not feasible unless the Village
provides financial assistance. The developer is asking for assistance in the amount of $6,300,000. his
anticipated the new development will generate over $900,000 per year in new real estate taxes, substantial

INCREMENT ALLOCATION FINANCING DEVELOPMENT AGREEMENT
BY AND BETWEEN THE VILLAGE OF MORTON GROVE, ILLINOIS
AND HEARTLAND REAL ESTATE PARTNERS, LLC
WHEREAS, the Village of Morton Grove (Village), located in Cook County, Illinois, is a home
rule unit of government under the provisions of Article 7 of the 1970 Constitution of the State of
Illinois, can exercise any power and perform any function pertaining to its government affairs,
including but not limited to the power to tax and incur debt; and
WHEREAS, the Village has the authority pursuant to the laws of the State of Illinois to
promote the health, safety, and welfare of the Village and its residents, to prevent the spread of blight,
to encourage private development in order to enhance the local tax base, to increase employment, and
to enter into contractual agreements with developers and redevelopers for the purpose of achieving
such objectives; and
WHEREAS, the Village is authorized under the provisions of Article VII, Section 10 of the
State of Illinois Constitution, 1970, to contract and otherwise associate with individuals, associations,
and corporations in any manner not prohibited by law; and
WHEREAS, the Village is authorized under the provisions of Article VIII of the State of
Illinois Constitution, 1970, to use public funds for public purposes; and
WHEREAS, the Village is authorized under the provisions of the Tax Increment Allocation
Redevelopment Act, as amended, 65 ILCS 5/11- 74.4 -1 et seq. ( "Act "), to finance redevelopment
projects in accordance with and pursuant to the Act; and
WHEREAS, On October 8, 2012, the Village, pursuant to and in accordance with the Act,
adopted (i) Ordinance No. 12 -34 approving a "Tax Increment Redevelopment Plan and Project Area,
(ii) Ordinance No. 12 -35 designating the Dempster /Waukegan Redevelopment Project Area, and (iii)
Ordinance No. 12 -36 adopting Tax Increment Allocation Financing (collectively, "TIF Ordinances "),
which established the Dempster/Waukegan Tax Increment Finance Redevelopment Project Area ( "TIF
District "); and
WHEREAS, Heartland Real Estate Partners, LLC, a corporation located at 1200 N. Ashland
Avenue, Suits 60022 (hereinafter the "Developer ") is the contract owner of certain parcels of
improved property approximately 3. 54 acres in area in the Dempster /Waukegan TIF District generally
located at the southwest corner of Dempster Street and Waukegan Road and commonly known as
8700 Waukegan Road, Morton Grove IL, 60053 ( "Developer Property "); and
WHEREAS, the Developer proposes to develop, operate and maintain the property as a mixed
use residential and retail development project ( "the Development "); and
WHEREAS, the Developer has made an application for assistance from the Village pursuant to
the Act and has represented to the Village, without the financial contribution from the Village provided
for herein, the Development is not economically feasible and the Developer would not undertake the
Development. The total amount of economic assistance the Developer has asked for is six million
three hundred thousand dollars ($6,300,000.00).
WHEREAS, the Development represents the Village will benefit from its investment in this
project with
the following public benefits:
1.
The existing obsolete 1 and 2 -story buildings consists of 61,985 square feet will be
demolished and replaced with a new mixed -use development consisting of a residential
midrise rental and two free standing retail buildings.
2.
New underground utilities will be installed through the property along with an underground
detention system compliant with current MWRD standards.
3.
The residential building would be constructed under a Type 4 classification with concrete
and steel structure and a curtain wall of metal panels and windows. The retail buildings
would be steel framing and all buildings would have fire sprinklers.
4.
The development will improve the existing streetscape and be a catalyst for additional
redevelopment of the area.
5.
The development will replace a property that currently is under utilized and current use is
no longer contributing to the community.
6.
An additional $39,000,000 of new property value will be added to the tax base potentially
generating over $900,000 in annual property tax increment as well as substantial sales taxes
from new retail sales.
7.
During the construction there will be 150 construction jobs and approximately 20 new
permanent jobs.
WHEREAS, the Village desires to have the property developed to clear the blighted factors and
characteristics of the Dempster /Waukegan TIF, to promote the health, safety, and welfare of the
Village and its residents, to prevent the spread of those blighting conditions and characteristics in the
Dempster /Waukegan TIF, encourage further private investment and development, enhance the
Village's tax base, increase employment opportunities for Village residents and enhance the future tax
revenues for those overlying taxing bodies who levy against the property and within the
Dempster /Waukegan TIE District, and for those reasons believe it is in the best interest of the Village
to enter into an Economic Incentive and Tax Increment Allocation Financing Development Agreement
with the Developer.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Resolution as though fully set forth therein malting the findings as hereinabove set
forth.
SECTION 2: The Village Administrator, Corporation Counsel, and the Director of Community
and Economic Development are authorized to negotiate an Economic Incentive and Tax Increment
Allocation Financing Development Agreement with Heartland Real Estate Partners, LLC subject to
approval by the Village Board. By authorizing these negotiations, the Village Board agrees in
principal that providing the financial assistance up to the amount requested by the Developer may be in
the best interest of the Village.
SECTION 3: 'Phis Resolution shall be in full force and effect upon its passage and approval.

special use shall be approved subject to conditions and restrictions as set forth herein.

and sealed by an Illinois licensed engineer and manufacturer specifications be submitted at
the time of the building permit application.
5. The equipment shall be a color consistent with the existing tower and brackets.
6. If any of these foregoing conditions and restrictions of this special use permit amendment
are not fully performed and complied with, after thirty (30) days written notice to the owner,
occupant or lessee of the property during which time said failure is not corrected and no
request for a hearing having been received, then the Corporate Authorities of the Village of
Morton Grove may forthwith terminate this special use permit, which shall then have no
further force and effect.
SECTION 3: The Village Clerk is hereby authorized and directed to amend all pertinent
records of the Village of Morton Grove to show and designate the special use permit as amended
hereunder.
SECTION 4: The Applicant /Owner shall comply with all applicable requirements of the

Village Administrator, Corporation Counsel, Building Commissioner and Plan Commission
Chairperson; and
WHEREAS, the Village Administrator, Corporation Counsel, Building Commissioner and
Plan Commission Chairperson have approved the proposed amendment and have found such
amendment with certain conditions as set forth in this ordinance, meets the standard for the
abbreviated process described above; and
WHEREAS, the property is zoned in the R -2 "Single Family Residence" District pursuant to
the provisions of the Village of Morton Grove Unified Development Code; and
WHEREAS, pursuant to the provisions of the Village of Morton Grove Unified
Development Code, the Corporate Authorities have determined the proposed amendment to the
special use shall be approved subject to conditions and restrictions as set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MORTON GROVE, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION 1: The Corporate Authorities do hereby incorporate the foregoing WHEREAS
clauses into this Ordinance, as though fully set forth herein, thereby making the findings as
hereinabove set forth.
SECTION
2: AT & T is hereby
granted an amendment to the special use permit previously
granted pursuant to Ordinance 97 -62 to
allow for the
replacement of three antennas and installation
of three additional
antennas, subject to the following
conditions and restrictions:
All conditions in Ordinance 97 -62 shall remain in effect unless specifically modified
through this special use amendment.
2.
The
applicant shall adhere to the existing lease agreement with the Village
for
this project.
2.
The
installation shall be completed according to the site plans dated March
31,
2014.
The final engineering plans, if deemed necessary by the Village Engineer, shall be signed
and sealed by an Illinois licensed engineer and manufacturer specifications be submitted at
the time of the building permit application.
4.
The equipment
shall be a
color consistent with the existing tower and brackets.
5.
All proposed wire
and/or
service connections between the tower and the equipment in the
structures at ground level shall be installed and buried below ground in such a manner as to
avoid
existing
sidewalks,
driveways
or other existing at -grade improvements.
6. If any
of these
foregoing
conditions
and restrictions of this special use permit amendment
are not fully performed and complied with, after thirty (30) days written notice to the owner,
occupant or lessee of the property during which time said failure is not corrected and no
request for a hearing having been received, then the Corporate Authorities of the Village of
Morton Grove may forthwith terminate this special use permit, which shall then have no
further force and effect.
SECTION 3: The Village Clerk is hereby authorized and directed to amend all pertinent
records of the Village of Morton Grove to show and designate the special use permit as amended
hereunder.
SECTION 4: The Applicant/Owner shall comply with all applicable requirements of the
Village of Morton Grove Ordinances and Codes.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.

AT &T has submitted application for the necessary permits at the above location for proposed
equipment modifications in the Village of Morton Grove, IL. The proposed scope of work is for the
